THE  STATES  were  informed  by  the   Bailiff  that  Her Majesty's  Secretary  of  State  for  Home  Affairs,  The  Right Honourable Leon Brittan, Q.C., M.P., having had to postpone his visit in April, 1984, would pay an official visit to the Island on 1st and 2nd October, 1984. The States were therefore convened to meet at 10.30 a.m. on Tuesday, 2nd October, 1984, in order to welcome him.

Visit of Home Secretary – filming by BBC TV Southwest.

The Bailiff informed the House that BBC Television Southwest, Plymouth, had requested permission to film the visit to the States Chamber of the Right Honourable Leon Brittan, Q.C., M.P., Her Majesty's Secretary of State for Home Affairs.

Contingencies vote of credit – Defence Committee.

THE STATES noted an Act of the Finance and Economics Committee dated 22nd August, 1984, informing the House that it had made available to the Defence Committee the sum of £7,100 from the Contingencies vote of credit for additional stores and equipment to ensure that the Island could cater adequately for

passengers who might become stranded in Jersey at the harbour or airport during the rest of 1984.

Agricultural Statistics for 1983.

The Agriculture and Fisheries Committee by Act dated 24th July, 1984 presented to the States the Agricultural Statistics for 1983.

THE STATES ordered that the said statistics be printed and distributed.

The Establishment Committee by Act dated 29th August, 1984, presented to the States a Report on Manpower for the half year to 30th June, 1984.

Matters noted – land transactions.

THE STATES noted Acts of the Finance and Economics Committee dated 22nd August, 5th September and 19th September, 1984, showing that in pursuance of Standing Orders relating to certain transactions in land, the Committee had approved –

1. as recommended by the Public Works Committee, the leasing from Mrs. Enid Amy Gautier, née Gray, of Field 1272, St. Helier , measuring 8 vergées and adjoining and cultivated in connexion with, the Parks Nursery, Warwick Farm, Mont à l'Abbé, for a period of nine years with effect from 25th December, 1984, at an annual rent of £400, with rent reviews every three years;
2. as recommended by the Harbours and Airport Committee, the leasing to Marine Management and Deliveries (Jersey) Limited (Letting No. A18) of office accommodation on the Albert Pier, Port of St. Helier , having an area of 100 square feet, for a period of three years with effect from 1st August, 1984, at an annual rent of £400, equating to a rate of £4 a square foot, the rent being based on market comparisons;
3. as recommended by the Harbours and Airport Committee, the lease to Summerday Tours Limited of storage accommodation in a bunker on the Albert Pier, Port of St. Helier (Letting No. A26a) at an annual rent of £447.12, being a rate of £2.07 a square foot;
4. as recommended by the Housing Committee, with the support of the Island Development Committee, the purchase from Mr. Maurice O'Connell of No. 19, Columbus Street, St. Helier , required for redevelopment purposes, for a consideration of £22,500 for the realty, with the Committee being responsible for the payment of all legal fees; (The Committee rescinded paragraph (c) of Act No. 3 of 27th June, 1984, which had been notified to the States on 31st July, 1984.)
5. as recommended by the Housing Committee, with the support of the Island Development Committee, the purchase from Mr. Leonard Charles Huish of No. 17, Columbus Street, St. Helier , required for redevelopment purposes, for a consideration of £40,000 for the realty, with the Committee being responsible for the payment of all legal fees;

6. as recommended by the Housing Committee, the granting to Mrs. Susan Margaret Marsh, née d'Abbot Doyle, of a vehicular right of way from the rear of her property, No. 20 Journeaux Street, across Journeaux Court, St. Helier , for a consideration of £1,000 and the payment by Mrs. Marsh of all legal fees;
7. as recommended by the Housing Committee, with the support of the Island Development Committee, the purchase from the Norfolk Hotel Limited of an area at the rear of No. 40 Don Road, St. Helier , shown on Drawing No. 2722/1 for a consideration of £12,000 plus £500 legal fees;
8. as recommended by the Public Works Committee, the passing of a Contrat de Bornement with Charles Le Quesne (1956) Limited and Charles Le Quesne Limited to agree the boundary line between their property and the property owned by the public at the site at Montrose, Mont Mado, St. John , with Charles Le Quesne (1956) Limited being responsible for the payment of all fees involved in the transaction;
9. as recommended by the Public Health Committee and in pursuance of an Act of the States dated 20th November, 1979, accepted the devise of the late Mrs. Eunice Jane Bailhache , née Hubert of specified properties, the assignment from Cathay Enterprises Limited to Mr. Maurice George Vowden and Mrs. Eileen Maria Vowden, née Bullman, of the head lease of No. 52 Don Street, St. Helier ;
10. as recommended by the Housing Committee, with the support of the Island Development Committee, the sale to Mr. Peter Paul Foley and Mrs. Dulcie Phyllis Foley, née Le Gros, of 1,200 square feet of land shown hatched in red on Plan No. 204.25B at La Rue de la Poterie, Grouville , for the sum of £500 plus the payment of all legal expenses;

11. as recommended by the Housing Committee, the passing of a Contrat de Transaction with Mr. James Walter Bromfield and Mrs. Moyra Ann Bromfield, née Seear, to allow the building of a garage at their property, No. 8, Deloraine Close, Deloraine Road, St. Saviour , in contravention of the sale agreement, with Mr. and Mrs. Bromfield being responsible for the payment of all legal fees;
12. as recommended by the Cottage Homes Committee, the passing of a Contrat de Transaction with Mr. James Walter Bromfield and Mrs. Moyra Ann Bromfield, née Seear, of 8 Deloraine Close, St. Saviour , for the construction of an east gable wall of a garage on the party wall between Deloraine Close and the Victoria Cottage Homes, with Mr. and Mrs. Bromfield being responsible for the payment of all legal fees;
13. as recommended by the Education Committee, the leasing from Miss Eleanor Anne Forster of 12, Bel Royal Gardens, St. Lawrence , for the period from 15th July, 1984 to 3rd April, 1985 at a monthly rent of £325 to accommodate Education Service staff;
14. as recommended by the Education Committee, the leasing from Mrs. Jennifer McMullan, née Gaudin, of Nos. 1 and 2, Belle Rive Villas, Le Hocq Lane, St. Clement , for a period of three years, with effect from 1st August, 1984, at an annual rent of £2,860 for each property, to accommodate teaching staff;
15. as recommended by the Public Works Committee, the granting to the Jersey Gas Company Limited of any wayleaves that might be required in respect of the new gas main from La Collette to Don Road where the new main must traverse open ground administered by that Committee, in accordance with instructions received from the Autorisé de la Partie Publique, with the Company being responsible for the payment of all legal fees.

Senator Jane Patricia Sandeman asked Senator John Le Marquand, President of the Public Health Committee, the following questions –

"1. Will the President say how many Consultants have

been appointed since January, 1982?

2. Which Consultants were appointed without the post being advertised nationally?
3. How were these appointments advertised?
4. When does the Committee intend to appoint a successor to Mr. Guy Clendinnen and will the post be advertised nationally?"

The President of the Public Health Committee replied as follows –

"1. FIVE – three Consultant Physicians, one Consultant

Surgeon and one Consultant Obstetrician.

2. The Consultant Obstetrician and Consultant Surgeon.

3. These posts were not advertised, they were upgraded from within the hospitals on the recommendation of the Medical Staff Committee. Both doctors being experienced and highly respected members of the hospitals' staff who have been employed by the Committee for 25 and 13 years respectively.
4. The Committee, in consultation with the Medical Staff Committee, isin the process of reviewing the medical staffing structure at the General Hospital, bearing in mind the additional beds which will become available on completion of Phase II of the General Hospital Redevelopment Scheme. It has been decided that, for the time being, no further consultant appointments will be made. The situation will be reviewed in the new year and any further consultant posts recommended will be advertised nationally."

Senator Jane Patricia Sandeman asked Deputy Norman Stuart Le Brocq of St. Helier , President of the Island Development Committee, the following question –

"Does the President agree that it is not in the public interest for his Department to discuss with members of the public the possible industrial or residential development of green or white zone land prior to the rezoning of those areas for industrial or residential purposes as such discussion could lead to land speculation?"

The President of the Island Development Committee replied as follows –

"A priori, my Committee believes in open government; and therefore encourages the officers to participate in such discussion. This is done on the strict assumption that if the land in question needs rezoning then the States are the final arbiter, and if not, the Committee itself makes any decision.

The Planning Department would be failing to perform a fundamental duty of any States Department if it did not advise the public in matters relating to any form of development.

It would be an impossible situation if the public could not readily obtain assistance or advice on planning proposals or possibilities, of whatever extent or wherever located.

Any land speculation that follows such discussion must take place at the risk of the speculator who may find the result to be far from his expectations."

Self-catering accommodation. Questions and answers.

Senator Jane Patricia Sandeman asked Seantor John Stephen Rothwell, President of the Tourism Committee, the following questions –

"1. Will the President say when the Committee intends

to bring its proposals for the development of self- catering accommodation to the States?

2.  Is the President satisfied that hotels and guest houses will have adequate time to provide a substantial percentage increase in self-catering accommodation for the 1985 season?"

The President of the Tourism Committee replied as follows –

"1. The Committee has pursued its policy of reviewing

various facets of tourism, including the policy adopted by the former Committee in relation to self- catering.

The opinions of various interests in the tourism industry have been sought, including the Jersey Hotel and Guest House Association, the Channel Islands Tour Operators Group and Committees of the States, and having taken their views into account, the Committee is now in a position to bring its proposals to the States next month.

2.  In view of the limited amount of registered self- catering accommodation at the present time and the interest expressed by potential developers, there is little doubt that there will be more self-catering accommodation available next year."

Re-employment by the States of persons receiving a States Pension. Questions and answers.

Deputy Graham Douglas Thorne of St. Brelade asked Senator John Clark Averty, President of the Establishment Committee, the following questions –

"1. Could the President inform the Assembly how many

people who have retired on a States pension have been re-employed by the States in the last twelve months?

2.  What steps is the Establishment Committee taking to stop people who have been retired on States pensions from being re-employed?"

The President replied as follows –

"1. Only one person who has retired on a States

occupational pension has been re-employed by any States department in the last twelve months, namely a teacher appointed to a part-time post. In addition, a number of teachers and doctors have been employed on a temporary basis for very short periods to cover sickness and similar emergencies.

2.  It has since 1981 been the policy of the Establishment Committee that employees of the States must retire on reaching normal retirement age and, if in receipt of a States occupational pension, cannot be re-employed. Departures from these rules are allowed only in exceptional circumstances. There is provision for exceptions where the person concerned, though in receipt of a States pension, is below the normal retirement age laid down for the post for which he has applied; however, the approval of the Establishment Committee is required in each case, and no such approvals have been given.

The policy has been strictly applied in those areas where the Establishment Committee is itself the employer. As the figures given in answer to the Member's previous question show, other employing Committees have followed the policy laid down by the Establishment Committee."

Consents granted to essential employees during 1983. Statement.

The President of the Housing Committee made a statement in the following terms –

"On 21st February, 1984, Deputy M.C. Buesnel of St. Helier asked the following question of the President of the Housing Committee –

Will the President inform the States how many permits were granted in 1983 in respect of the lease or purchase of residential property by essentially employed persons, and the total number of dependants of such persons?'

I pointed out that the answer to the question, as put, was meaningless because they included existing essential employees moving from one property to another, replacements for essential employees who had left the Island, as well as net additional essential employees. I further stated that the Department was undertaking a more detailed analysis of the consents and that more meaningful figures would be presented to the States as soon as possible.

After discounting consents granted to existing essential employees who were either moving property or changing jobs, there were 106 consents granted to essential employees who were either replacements for other essential employees leaving the Island or, who were net additional essential employees. Of these, 34 were known to be definite replacements for persons leaving the Island and 27 were definitely additional appointments. Applying these proportions to the balance suggests that there was a total of 59 replacements and 47 additional appointments. Based on the information available, it is estimated that the total number of persons involved with additional consents was 117, i.e. that the 47 additional essential employees brought with them a total of 70 dependants. Of the 47 additional appointments, 17 were for limited periods so that time could be allowed for recruits to be trained as replacements.

Doctors' fees. Statement.

The  President  of  the  Social  Security  Committee  made  a statement in the following terms –

"On 31st May, 1983, the States debated a report of the Social  Security  Committee  on  the  Health  Insurance Scheme. The States approved a proposition as follows –

The States accordingly endorsed the Social Security Committee's  approach  to  the  development  of  the Health Scheme as set out in its report, subject to the making of provision by the Committee for doctors' charges to be monitored, a doctor's charges to be displayed in his waiting room and a scale of charges as set out on pages 43 and 44 of its report to be published from time to time in the media.'

I  confirm  that  in  close  consultation  with  the  medical profession the Committee is indeed monitoring doctors' charges. The Committee has also recently published in the Jersey Gazette a table showing the range of charges which were in use in July 1984 and will continue to make such figures available regularly.

In the matter of the display of a doctor's charges in his waiting room, this has proved to be a very difficult area, particularly  from  the  ethical  point  of  view.  The Committee has discussed the matter at length with the profession. It has accepted the point that a waiting room may be used by several doctors forming part of one or more  practices  and  therefore,  in  such  a  situation, comparative scales of fees for differing practices placed side  by  side  would  be  inappropriate.  The  Committee recognises  that  individual  doctors  within  one  practice may also vary their fees. Accordingly, the Committee has decided at this stage not to press for the display of fees, or  for  legislation  to  be  enacted  that  would  make  it compulsory to display doctors' fees, particularly as the Committee has accepted assurances from the profession that they will continue, as in the past, to have available at their  surgeries  a  current  fees  list.  This  list  would  be available  to  patients  on  request  from  receptionists,  as before."
