The following enactment was laid before the States, namely –

Post Office (Postal Orders) (Amendment No. 8) (Jersey) Order, 1986. R & O 7500.

Cottage Homes Committee: appointment of President.

There were nominated for appointment as President of the Cottage Homes Committee –

Deputy Francis Hedley Morel of St. Saviour – proposed by Deputy Leonard Norman of St. Clement .

Deputy  Margaret  Sylvia  Rose  Beadle  of   St. Brelade – proposed by Senator Terence John Le Main.

Deputy Mervyn Renouf Billot of St. Saviour – proposed by Deputy John Le Gallais of St. Saviour .

States of Jersey Fire Service Report 1985.

The Defence Committee by Act dated 1st May, 1986, presented to the States a Report on the administration of the States of Jersey Fire Service for the year 1985.

THE STATES ordered that the said Report be printed and distributed.

Jersey Cost of Living Index. Report. R.C.13.

The Finance and Economics Committee by Act dated 17th March, 1986, presented to the States a Report on the Jersey Cost of Living Index.

THE STATES ordered that the said Report be printed and distributed.

Broadcasting Committee: Report. 1985. R.C.14.

The Broadcasting Committee by Act dated 28th April, 1986, presented to the States its Report for 1985.

THE STATES ordered that the said Report be printed and distributed.

Matters lodged.

The following subjects were lodged "au Greffe" –

Presented by the Policy Advisory Committee. The States decided to take this subject into consideration on 10th June, 1986.

Housing Committee: consents under Regulation 1(1)(k). P.15/86.

THE STATES acceded to the request of Senator Richard Joseph Shenton that the Proposition regarding the issue of consents under Regulation 1(1)(k) by the Housing Committee (lodged on 28th January, 1986) be taken into consideration on 10th June, 1986.

Queen's Valley Reservoir Law. Questions and answers.

Senator Jane Patricia Sandeman asked H.M. Attorney General the following questions –

"1. P.36 of 1986, the draft Queen's Valley Reservoir

Law, a hybrid law in that if it is passed it will provide certain conditions, (i.e. the denial of the right of the individual to seek an injunction or interim injunction from the Royal Court without being able to prove negligence, the extinguishment of parish roads, the variation even within the law concerning arbitration over compensation and that arbitration' is not defined in Article 1) which do not apply to the construction, reconstruction or extension of any other existing reservoir or future reservoirs?

2.  What is the constitutional procedure in Jersey with regard to hybrid laws?".

H.M. Attorney General replied as follows –

"1. The term hybrid law' is not a term to which any legal

meaning can be attached in Jersey. I cannot therefore say whether or not the draft Queen's Valley Reservoir (Jersey) Law, 198 , is a hybrid law' because the answer would depend on what is meant by that term.

2.  It follows that there is no constitutional procedure in Jersey with regard to hybrid laws'.".

Teachers' Salaries. Statement.

The President of the Education Committee made a statement in the following terms –

"1. Since March 1984, teachers employed by the

Education Committee have been paid on a local Jersey salary scale, subject to local negotiations. In September 1985, as part of the annual pay settlement, it was agreed to consider the levels of pay appropriate to teachers in Jersey and possible changes in the salary structure. Talks began in the autumn of 1985 and have continued up to the end of last month.

2.  As Members will know from the press reports, an offer was made to the teachers' representatives on Tuesday, 29th April, 1986 and that offer is still under active consideration. Further meetings will be held during this week and I hope to be able to make a further statement to the House in the near future.".

Rent Control Tribunal: reappointment of members.

THE STATES, adopting a Proposition of the Housing Committee, appointed in pursuance of paragraph (1) of Article 3 of the Dwelling Houses (Rent Control) (Jersey) Law, 1946, as amended, the following persons to act as Chairman and members of the Rent Control Tribunal until 11th April, 1987, namely:

Philip Arthur Weston, Chairman Edward Malcolm Pearmain Machon George Norman Simon

and in pursuance of paragraph (2) of the said Article 3, appointed the following persons to act for the same period in place of members of the Tribunal unable to act by reasons of absence or incapacity, namely:

Alfred Vibert Derek Le Seelleur.

Fuel Oil Price s: Committee of Inquiry. P.97/85 and P.59/86.

THE STATES, having accepted an amendment of Senator Jane Patricia Sandeman that for the words "the matter of fuel oil prices in the Island" there should be substituted the words "matters relating to the supply and distribution of fuel oil in Jersey and to report to the States with recommendations thereon within six months of the appointment of the Committee", adopted her Proposition and –

  1. agreed that a Committee of Inquiry should be appointed under Article 30 of the States of Jersey Law, 1966, to inquire into matters relating to the supply and distribution of fuel oil in Jersey and to report to the States with recommendations thereon within six months of the appointment of the Committee;
  2. agreed that the Committee so appointed under paragraph (a) should be designated as a Committee of Inquiry for the purposes of Articles 41 to 46 inclusive and Article 49of the said Law.

Queen's Valley Reservoir (Jersey) Law, 1986. P.36/86.

THE STATES, subject to the sanction of Her Most Excellent Majesty in Council, adopted a Law entitled the Queen's Valley Reservoir (Jersey) Law, 1986.
