Senator Anne Baal asked Deputy Hendricus Adolphus Vandervliet of St. Lawrence , President of the Housing Committee, the following questions –
"1. Would the President provide a breakdown of the
professional fees quoted of £142,071.00?
- Will the President explain why the percentage of professional fees is so high at 13.5 per cent (excluding supervision fees) compared with other Housing projects where fees, including supervision fees, have been limited to 10 – 12 per cent to reduce costs?
- Will the President confirm that, in addition to the pre- contract professional fees mentioned in paragraph (d)of the Proposition, other supervision fees will be payable and, if so, to whom and how much will these be?
- Will the President provide costs for flats of similar developments in built-up town areas completed over the last two years to compare with the cost quoted of £54,000 per flat for this development?"

(Disbursements consist mainly of the printing of contract documents and drawings, are charged at net costs and have been allocated equally between pre- and post-contract stages.)
- Paragraph (d) of the Proposition as originally circulated contained an error. This is the reason for the amendments to the Proposition. The total fees of £142,071 include both the pre-contract element and post-contract supervision (paragraph 13of the report does make it clear that the sum of £142,071 relates to both pre-contract and post-contract professional fees). Most housing developments require three professional disciplines – architect, quantity surveyor and structural engineer. On this development a fourth discipline was required – a services engineer. This is mainly due to the design and installation of a district heating system for what is going to be a large and complex development in this respect. Smaller developments, with a simple night storage electrical system, do not require this professional input. (The district heating system was chosen by the Housing Committee in accordance with its Heating Policy Report presented to the States in 1985.) The service engineer's fees represent 1.37 per cent of the contract price (see answer to Question 1) with the balance of approximately 12 per cent being consistent with the range of professional fees normally charged on housing developments.
- The sum of £142,071 quoted is for total professional fees, including both the pre-contract element and fees for post-contract supervision.
Post-contract fees will be paid as follows –

- In providing costs for flats at similar developments in town areas, we need to ensure that we are comparing like with like'.
In Phase I of the proposed development, the breakdown of costs for each flat are as follows –
- Site acquisition – £12,292
- Costs relating to abnormal/extra features – £6,383
- Professional fees – £5,074
- Net building costs (i.e. excluding (a), (b), (c)) – £30,464
Mention of each of these areas of costs needs to be made.
- Most of the property bought or to be acquired for this development is town commercial property. Site costs are, therefore, unfortunately high but this is necessitated by the States' policy to reduce the amount of open land taken for housing development.
- Abnormal costs' are also high reflecting, as the report states, extra costs involved in the demolition of existing buildings, the shoring up and making good of adjacent gable walls, and poor ground conditions requiring expensive foundations. Other additional costs will be incurred in order to meet a Planning requirement that blocks be provided with hipped roofs, to be in keeping with the locality; provision of lifts because of the number of elderly people expected to be housed in the new development; and the district heating system referred to in the answer to Question 2.
- Professional fees relate to the total development – including abnormal or extra features – and, therefore, should also be excluded from the comparison.
- The net building cost per flat for Phase I is, therefore, £30,464. Examples of net building costs per flat for other recent developments in town area include the following –

The building cost per flat for Phase I of the proposed development is, therefore, within the range of costs of other town developments over recent years. The proposed agreement with Mark Amy Limited is for a fixed price contract, which will not be affected by any price and labour cost increases which take effect in the meantime.
Phase II of the development, which will also involve a negotiated contract with Mark Amy Limited, will be subject to States' approval.
Finally, I would draw attention to Paragraph 25 of the Committee's Review of Housing Policy (P.84/85) which was debated by the States on 29th October, 1985: "To meet the objective of the Island Plan to provide a proportion of the additional housing requirement by the conversion of large houses into flats and by the redevelopment of outworn commercial land with residential accommodation, a substantial capital investment will be required. If that capital investment is not made, then that part of the Island Plan will fail."
Monitoring debates in the States' Chamber. Question and answer.
Deputy Corrie Stein of Grouville asked Deputy Donald George Filleul of St. Helier , President of the Public Works Committee the following question –
"How many departmental officers and others have a direct means of listening in to the proceedings in the States' Chamber and why?"
The President of the Public Works Committee replied as follows –
"The Public Works Committee is not the responsible authority for installing equipment in various Departmental offices which enable proceedings in the States' Chamber to be relayed directly to those offices, and perhaps the question ought more correctly to have been directed to the President of the Harbours and Airport Committee, one of whose Departments (Electronics) carries out the work of installation.
To avoid delay in providing the response to the question, however, I have established that relay equipment is installed in the following Departments –
States' Greffe
Social Security
Public Building and Works Island Development Committee States' Airport.
Arrangements are also in hand to install equipment in the Harbour Office.
I am advised that before any installation is carried out by the Department of Electronics, authorisation is secured through the Bailiff 's Office and I would draw attention to the fact that the equipment can be switched off from within the States' Chamber when sittings are held in camera.
As to why this equipment is installed in various Departments is probably self-evident. It enables Departmental staff to continue with their normal duties whilst being able to keep in touch with debates in the House which are the concern of their employing Committee.
Additionally its use facilitates the business of the House when information is required from the Department so that the preparation of such information can begin as soon as the request is made."

Channel Islands Services Limited: lease.
THE STATES, adopting a Proposition of the Harbours and Airport Committee –
- agreed to lease to Channel Islands Services Limited trading as Huelin Renouf Airfreight Services freight bays numbers 9 and 10 in the Airport Freight Terminal Building, comprising 2,880 square feet of cargo/warehousing space, for a further term of 3 years with effect from 1st January, 1986, at an annual rent of £7,056, representing a rate of £2.45 a square foot;
- authorised the Greffier of the States to sign the necessary agreement with Channel Islands Services Limited;
- authorised the Treasurer of the States to receive the payments as they became due.

THE STATES, subject to the sanction of Her Most Excellent Majesty in Council, adopted a Law entitled the Attendance Allowances (Amendment No. 3) (Jersey) Law, 1986.
Draft Amendment (No. 7) to the Tariff of Harbour and Light Dues. P.159/85.
THE STATES, in pursuance of the Harbour and Light Dues (Jersey) Law, 1947, as amended, approved the draft Amendment (No. 7) to the Tariff of Harbour and Light Dues.
Gorey Boat Builders: lease of shop and quarry. P.1/86.
THE STATES, adopting a Proposition of the Public Works Committee –
- approved the leasing to Gorey Boat Builders Limited of a shop and quarry at Gorey shown hatched on Drawing No. 3/78 for a period of 8 years with effect from 29th September, 1980 at an initial annual rent of £5,350 a year with rent reviews after the second and fifth years;
- authorised the Greffier of the States to sign the necessary agreement;
- authorised the Treasurer of the States to receive the rent as it became due.
Halcyon House, West Hill: approval of drawings. P.2/86.
THE STATES, adopting a Proposition of the Housing Committee –
- approved Drawings Nos. 84-187-01, 84-156-04, 05 and 06 and 84-156-11D, 13,14,15,16,17 and 18 showing the conversion of Halcyon House and gardens to provide 17 units of accommodation;
- authorised the Greffier of the States to sign the said Drawings on behalf of the States.
Great Union Road/Columbus Street, St. Helier : development. P.4/86.
THE STATES commenced consideration of a Proposition of the Housing Committee regarding the development of Great Union Road/Columbus Street, St. Helier and accepted amendments of that Committee –
in paragraph (d), for the amount £142,071 substitute the amount £103,670.
for the existing paragraph (e), substitute a new paragraph –
(e) to approve the payment of professional fees in the sum of £38,401 for post-contractual supervision;
re-letter paragraphs (e), (f) and (g) as (f), (g) and (h).
re-letter paragraph (h) as (j) and in sub-paragraph (ii) of paragraph (j) for and (d) substitute (d) and (e) and in sub-paragraph (iii) of paragraph (j) for (e) substitute (f);
then adopting the Proposition –
- approved the acquisition from Mark Amy Limited of Nos. 33 and 35 Columbus Street and 104 Great Union Road, St. Helier , for a consideration of £285,000, with each party being responsible for its own legal fees;
- approved Drawings Nos. 1470.04, A.02, A.03, A.04, B.02,B.03,B.04, C.02, C.03, C.04, C.05, C.06, C.07, C.08, R.01, R.02 and S.01 showing the construction of 28 one-bedroomed flats on the Columbus Street/Great Union Road site (Phase I);
- approved a fixed price contract with Mark Amy Limited for the construction of the said flats, for use as States' rental accommodation, in the sum of £1,054,719;
- approved the payment to Mark Amy Limited ofpre- contract professional fees in the sum of £103,670;
- approved the payment of professional fees in the sum of £38,401 for post-contractual supervision;
- approved the leaseback to Mark Amy Limited of part of the workshops and offices shown on Drawing No. 1470/1 measuring approximately 4,000 square feet for a period not exceeding one year, at a monthly rental of £866.00;
- authorised the Attorney General and/or the Greffier of the States to pass the necessary contracts in the matter;
- authorised the Greffier of the States to sign the said Drawings on behalf of the States;
(j) authorised the Treasurer of the States to –
- pay the amount specified in (a) above out of the Housing Committee's Capital Vote of Credit "Land Purchase" (Vote No. C.1104);
- pay the amounts specified in (c), (d) and (e) above out of the Housing Committee's Capital Vote of Credit "Building, Purchase and Rehabilitation of Dwellings" (Vote No. C.1103);
- receive the amount specified in (f) above at the appropriate time.
