Committee of Inquiry into controls over public entertainments.

Jersey Council for Safety and Health at Work: Report and Accounts for the year 1985–1986. R.C.23.

The Social Security Committee by Act dated 27th November, 1986, presented to the States the Report and Accounts of the Jersey Council for Safety and Health at Work for the year 1985–1986.

THE STATES ordered that the said Report and Accounts be printed and distributed.

Three Oaks Vineries, St. Lawrence : Green Zone exception (P.118/86): further information. P.166/86.

The Island Development Committee by Act dated 24th November, 1986, presented to the States a Report containing further information regarding the proposed Green Zone exception to permit the construction of a dwelling at Three Oaks Vineries, St. Lawrence (lodged on 2nd September, 1986).

THE STATES ordered that the said Report be printed and distributed.

Administrative Decisions (Review) (Jersey) Law, 1982: report of the Panel of Members regarding complaints received between 1st February, 1985 and 31st January, 1986. R.C.24.

The Special Committee to consider the relationship between Committees and the States by Act dated 28th November, 1986, presented to the States a Report of the Panel of Members regarding complaints received under the Administrative Decisions (Review) (Jersey) Law, 1982, during the period 1st February, 1985 to 31st January, 1986.

Department of Postal Administration: report for 1985. R.C.25.

The Committee for Postal Administration by Act dated 4th December, 1986, presented to the States a Report of the Department for Postal Administration for the year 1985.

Resources Recovery Board: report for 1985. R.C.26.

The Resources Recovery Board by Act dated 20th November, 1986, presented to the States a Report on the operation of the services administered by the Board for 1985.

Matter noted – land transaction.

THE STATES noted an Act of the Finance and Economics Committee dated 1st December, 1986, showing that in pursuance of Standing Orders relating to certain transactions in land, the Committee had approved, as recommended by the Agriculture and Fisheries Committee, the renewal of the lease to Mr. Donald John Le Sech of La Grande Maison, St. Catherine, St. Martin , for a further period of one year with effect from 25th December, 1986, at the existing annual rent of £2,628.

Matter noted – financial transaction.

THE STATES noted an Act of the Finance and Economics Committee dated 1st December, 1986, showing that in pursuance of Rule 5 of the Public Finances (General) (Jersey) Rules, 1967, as amended, the Committee had noted that the Defence Committee had accepted the lowest of three tenders, namely that submitted by B & C Construction Limited in the sum of £40,734.22 in a contract period of 20 weeks, for the construction of an improved security system at Police Headquarters.

Matter lodged.

Tourism: Paris Office – reduction in cost. P.167/86. Presented by Deputy Corrie Stein of Grouville .

Licensing Law: report and recommendations. Questions and answers.

Deputy Leonard Norman of St. Clement asked Senator John Stephen Rothwell, President of the Tourism Committee, the following questions –

"In May, 1982, the Tourism Committee set up a Sub- Committee to report upon and recommend appropriate amendments to the Licensing Law. The report was, I understand, completed and presented to the Tourism Committee on 11th October, 1984.

Will the President please advise –

  1. Why the report and recommendations have not yet been made available to the States?
  2. When he intends to make the report and recommendations available to the States?".

The President of the Tourism Committee replied as follows –

"1. In April 1982, the Tourism Committee appointed a

Sub-Committee to review the present Licensing Law.

That Sub-Committee met or corresponded with a great number of local organisations and individuals to seek their opinions and advice and in December 1983 presented its report and recommendations to the Tourism Committee. These were discussed at length during several meetings of the Committee, and in April 1984 sent to the Bailiff 's office for comment by the Licensing Bench. In August 1984 the Sub- Committee and President met with the full Licensing Assembly to discuss the proposals.

After further work by the Sub-Committee, the Tourism Committee accepted the review, and in November 1984 it was lodged with the Crown Officers' Department for comment by the Attorney General.

I wrote to the Attorney General in June 1985, asking if he was in a position to comment on the proposals, and the Attorney General replied that due to extreme pressure of work, he hoped that the matter would be dealt with that summer.

In the meantime considerable activity had taken place in  relation  to  the  present Law. In March 1985 the States repealed Articles 27, 36 and 51 (R & O – 7373) which restricted the sale of goods in hotels, and in November 1985 repealed Article 14 (R & O – 7442) which dealt with the strength of spirits.

Unfortunately no comments on the revision were forthcoming from the Attorney General's office. I wrote again in February 1986 acknowledging that the Attorney General had recently taken up his new appointment. However, I enclosed a list of actions taken by the Sub-Committee since 1982 in order that the Attorney General should be fully briefed.

The Attorney General wrote to me in June 1986, agreeing it was time that the revision was given priority and that endeavours would be made to give the Committee a reply before the end of the month. Regretfully up until the time that these questions were lodged no reply had been received.

2.  I am sure that this House will not be unsympathetic towards the situation in which the Crown Officers have found themselves over the past two years in relation to their changing roles, and the enormous workload imposed on them.

Since being notified that Deputy Norman intended asking questions today, I wrote again to the Attorney General, requesting that the revision of the Law be given urgent priority.

The Attorney General has now informed me that he will give the revision of the Licensing Law as much priority as he is able, bearing in mind all the other urgent matters he has to deal with at the present time.".

Planning applications – re-advertisement. Statement.

The President of the Island Development Committee made a Statement in the following terms –

"1. In 19th August, 1986 the States adopted a Proposition

by Deputy C. Stein requesting the Island Development Committee to alter its procedures to ensure that where a development proposal is the subject of a revised or new application, or is reconsidered on appeal, the application should be re-advertised in the Jersey Evening Post'.

  1. I wish to inform the House that the Committee has since altered its procedures, where necessary, to implement the wishes of the House with regard to each category of application mentioned in the Proposition, as follows.
  2. Revised plans

All such applications of public or neighbourhood consequence are being re- advertised.

  1. New applications

New applications always have been advertised, so no alteration of procedure is involved.

  1. Applications reconsidered on appeal

All applications subject of request for reconsideration that are of any public or neighbourhood consequence, and might have any prospect of the Committee changing its original decision, are being re-advertised prior to any redetermination. Fresh applications are, in fact, often being required in this category if the circumstances so dictate.

  1. The Committee believes that the re- advertising just described fulfills the spirit and intent of the Proposition. In other words, it allows objectors every opportunity to make further representations in all those cases where changes are involved that may affect their properties or the public interest.
  2. The Committee fully accepts that re-advertising in these cases represents correct procedure and, indeed, this was already being done to a considerable extent. However, the main concern of the Committee at the time of the debate was that the Proposition actually called for the total re-advertising of any revised plans or any appeal, irrespective of whether these related to purely technical or other completely non-public matters, or where there was no prospect of the Committee making any change in its original decision.
  3. The Committee remains concerned that the re- advertisement of these types of revised plans, orof appeals carrying no prospect of success, is both a major and meaningless exercise. It could only irritate the public as being invited to see plans that are of no possible public consequence, cause serious delays in the flow of work on the building sites awaiting decisions over purely technical amendments, and require additional resources in the Planning Department for the time-consuming task of showing and explaining plans.
  4. The Committee hopes that the House will accept that the Committee should be left to administer its affairs with commonsense and also its reassurance that any revised plans or appeals of public or neighbourhood consequence are now the subject of complete re- advertisement.".

Radio interference and radio transmitter licence enforcement in Jersey. Statement.

The President of the Telecommunications Board made a Statement in the following terms –

"Jersey Telecoms currently acts as an agent for the Department of Trade and Industry (DTI) in all matters relating to radio and television interference and law enforcement concerning unlicensed transmissions. To this end the Board employs an engineer for two days each week and operates a van for which it is fully reimbursed by the Department of Trade and Industry. Anyone with radio or television interference problems can obtain a form, from any Post Office, which when completed is returned to Jersey Telecoms which then investigates the source of the interference and takes or recommends remedial action.

The Department of Trade and Industry has now decided that it will take back the running of these services in Jersey and the transfer will be made as soon as it is practical to do so after 1st January, 1987. From the transfer date, Jersey Telecoms will cease to have any responsibility either for investigating cases of radio and television interference or for licence enforcement.

The Department of Trade and Industry's policy, in interference cases, will be to encourage customers to employ their dealers to do investigations and any remedial work. A booklet, aimed at both customers and dealers, showing what to do in such cases, will be available from most Post Offices. In addition, the Department of Trade and Industry is also working with receiver manufacturers to improve their equipment's interference immunity. However, the Department of Trade and Industry will still provide a full Radio and Television Interference Service and any person may report interference by using the form available from most Post Offices. If householders so choose, they may ask the Department of Trade and Industry to visit their homes, but for this service will be asked to pay £21.00 per visit. A radio interference service is also provided for commercial undertakings.

The Department of Trade and Industry will operate from a base in Southampton and visit the Island at least four times a year to carry out licence enforcement work but will provide a response within 24 hours to urgent radio or television interference complaints.

As far as the customer is concerned there will be little change in the level of service available but, from takeover, the service will tend to come from the retailers of electrical equipment and the Department of Trade and Industry will concentrate on licence enforcement rather than tracing interference.

The Board has consulted the Broadcasting Committee, Channel Television and the B.B.C. concerning this transfer of responsibility and none of these bodies has objected.".

Public Employees' Contributory Retirement Scheme. Statement.

The Vice-President of the Establishment Committee made a Statement in the following terms –

"It is with pleasure that I inform the House that the Establishment Committee and representatives of the staff who are members of the Public Employees' Contributory Retirement Scheme, the main pension scheme for States' and Parish employees, last week reached agreement on proposals for reform of the Scheme. Those proposals, which meet long-standing objectives of the Staff Groups and the Establishment Committee, are now being put to the employee groups for ratification. Thereafter my Committee will be bringing specific recommendations to this House.

As a consequence of the proposals, the Establishment Committee has decided that if the agreement is ratified it will modify its present strict rule that women members of the Scheme must retire at the age of 60.

A further report will be made to the House in due course.".

Airport Departures Hall Buffet extension.

THE STATES, adopting a Proposition of the Harbours and Airport Committee –

  1. approved Drawings Nos. 193/429 and 430 showing the construction of an extension to the Departures Hall Buffet at the Airport; and
  2. authorised the Greffier of the States to sign the said Drawings on behalf of the States.

Airport – lease of land and accommodation to Esso Petroleum Company Limited.

THE STATES, adopting a Proposition of the Harbours and Airport Committee –

  1. approved the renewal of the lease to Esso Petroleum Company Limited of office accomm- odation and hard standing area at the Airport, and land adjoining the Quennevais Road (areas shown coloured red on Drawing No. 1.02.01.182) at an annual rent of £11,604, the whole for a term of eight years, with effect from 1st January, 1986, with a rent review clause at the third and sixth years;
  2. authorised the Greffier of the States to sign the necessary agreement with the company; and
  1. authorised the Treasurer of the States to receive the payments as they became due.

Health Services Disciplinary Tribunal: appointment.

Minimum income for elected Members of the States: Act. THE STATES resolved as follows –

  1. In the Act, dated 28th April, 1981, with regard to the

provision of a minimum income for elected Members of the States, as amended –

  1. in the preamble after the word "becoming" there shall be inserted the words "or remaining";
  2. in paragraph 1 after the words "sixty-five years of age" there shall be inserted the words, "or who has attained that age since the date of his most recent election to the States,".
  1. This Act shall be deemed to have come into force on the

first day of January, 1986.

THE STATES, subject to the sanction of Her Most Excellent Majesty in Council, adopted a Law entitled the Merchant Shipping (Registry of British Ships) (Jersey) Law, 1986.

THE STATES, subject to the sanction of Her Most Excellent Majesty in Council, adopted a Law entitled the Customs and Excise (General Provisions) (Amendment) (Jersey) Law, 1986.

Sheltered Workshop at Highlands: Grant Aid and Management. P.127/86.

THE STATES, adopting a Proposition of the Education Committee –

  1. approved the transfer of responsibility for grant aid for the Sheltered Workshop from the Education Committee to the Social Security Committee with effect from 1st January, 1987;
  2. agreed that the States should be represented on the Board of Management by a member of each of the Social Security, Public Health and Education Committees.

THE STATES, having accepted an amendment of Deputy John Le Gallais of St. Saviour that after the word "Jersey" there should be added the following words "the Finance and Economics Committee should be instructed to consider, in concert with the appropriate Committees, the following proposals and to report back to the States without delay", and that the letter (a), sub-paragraph (a)(ii) and sub- paragraph (b) should be deleted and sub-paragraphs (iii) (iv), (v) and (vi) renumbered, adopted a Proposition of Senator Richard Joseph Shenton and agreed that having regard to the recommendations set out in the Report of the Committee of Inquiry into matters relating to the supply and distribution of fuel oil in Jersey the Finance and Economics Committee should be instructed to consider in concert with the appropriate Committees, the following proposals and to report back to the States without delay –

  1. a fourth supplier of fuel oil should be established in the Island;
  2. the storage tanks to be used by the fourth supplier should be installed by the States and leased to the supplier;
  3. the clause in the lease of land at La Collette to the La Collette Consortium which enables the area described as the "expansion area" to be released in the public interest, should be invoked;
  4. the fourth supplier and the existing La Collette Consortium should be required to maintain minimum stock levels;
  5. there should be regular publication of the prices of oil products in the Island.

THE STATES, having accepted an amendment of Deputy Edgar John Becquet of Trinity that in paragraph (a) for the words "to amend the appropriate" there should be substituted the words "to consider whether there is a need to enact", adopted a Proposition of Senator Richard Joseph Shenton and requested the Legislation Committee –

  1. to consider whether there is a need to enact legislation to change the name of the Petty Debts Court to something more in keeping with modern society; and
  1. to investigate whether the present practice and procedures of that Court need amending in any way.

THE STATES, adopting a Proposition of the Public Works Committee –

  1. approved the acquisition by that Committee of No. 76 Val Plaisant, St. Helier required in connexion with road improvement proposals contained in Proposition
    1. of the Island Plan, lodged "au Greffe" on29th July, 1986, from Mrs. Phyllis Gorfil, née Menkin, representing Cardav Limited for the sum of £76,000;
  2. authorised the payment or discharge of expenses to be incurred in connexion with the acquisition of this property and all interests therein, from the Committee's Capital vote of credit under the heading "Roads – improvements, property acquisition and investigation" (Vote No. C0303), each party being responsible for the payment of its own legal fees;
  3. authorised the Attorney General and the Greffier of the States to pass, on behalf of the public, any contracts which it may be found necessary to pass in connexion with the acquisition of the said property and any interests therein.

Deputy Michael Adam Wavell of St. Helier , having declared an interest in the matter, withdrew from the Chamber prior to the debate.
