Senator Richard Joseph Shenton paid tribute to the late Mr. Wilfred James Tomes, a former Deputy of St. John and Connétable of St. John , who served in the States from 1965 to 1980. The States observed one minute's silence as a mark of respect.

The  Telecommunications  Board  by  Act  dated  24th  June,  1988, presented to the States its Report for the year ended 31st December, 1987.

Welfare Benefit: revised rates from 1st October, 1988. R.C.16.

The  Finance  and  Economics  Committee  by  Act  dated  19th September, 1988, presented to the States a Report setting out the revised rates of Welfare Benefit from 1st October, 1988.

Matters noted – land transactions.

THE STATES noted Acts of the Finance and Economics Committee dated  22nd  August,  5th  September  and  19th  September,  1988, showing that in pursuance of Standing Orders relating to certain transactions in land, the Committee had approved –

  1. as  recommended  by the  Tourism  Committee,  the leasing  to  Mr. Bertrand Pilz and Mrs. Jill Pilz, née Mackie, of Driftwood Café, Archirondel, for a period of three years with effect from 25th December, 1988, as follows –

  1. as  recommended  by the  Tourism  Committee,  the leasing to Mr. Charles William Frederick Wagner of the site of Café Casino, Grève de Lecq, St. Ouen , for a period of three years with effect from 25th December, 1988, as follows –

  1. as  recommended  by the  Harbours  and  Airport Committee,  the  assignment  by Mr. Wilfred  James Kent  and  Mrs. Ann  Kent,  née  Le Bleaus,  to Mr. Auguste  Matos  of the  remaining  period  of the lease  to  expire  on 31st  March,  1991, of the  café known as the Sailor's Rest, New North Quay, Portof St. Helier , at the existing annual rent of £2,500 and subject to the Committee's right to terminate the lease by giving six months' notice at any time during the term;
  2. as  recommended  by the  Housing  Committee,  the granting to The Jersey Electricity Company Limited of a lease of a site for an electricity sub-station at Le Jardin du Crocquet, St. Aubin, St. Brelade , for a period of 99 years, at a nominal annual rent of £1, with all payments commuted forward to the inception of the agreement, and the granting to the company, free  of charge,  of any  servitudes  required for high tension cables, with each party being responsible for the payment of its own scale legal fees;
  3. as  recommended  by the  Housing  Committee,  the granting to The Jersey Electricity Company Limited of any wayleaves required for high tension cables in respect of the Brighton Close Phase II development, St. Helier , for a nominal consideration of £10, with each party being responsible for the payment of its own scale legal fees;
  1. as recommended by the Housing Committee, the passing of a Contrat de Transaction with Mr. Nigel Royston Stansfield and Mrs. Fiona Carol Stansfield, née Yeadon, the owners of No. 59, Garden Lane, St. Helier , in order that they could utilise the party wall joined by its north, its west and its south to property belonging to the public of the Island, for the purpose of constructing an extension to the rear of their property, with Mr. and Mrs. Stansfield's being responsible for the payment of all scale legal fees;
  2. as recommended by the Housing Committee, the passing of a Contrat de Transaction with Mr. Antonio Rodrigues Pita and Mrs. Rosa Maria Pita, née Perez, the owners of No. 20, New St. John 's Road, St. Helier , to award them a right of access across land owned by the public of the Island in order to maintain the north boundary wall of the property, with Mr. and Mrs. Pita's being responsible for the payment of all scale legal fees;
  3. as recommended by the Housing Committee, the passing of a Contrat de Transaction with the purchasers of No. 1, Victoria Terrace, St. Helier , in order to ratify certain existing encroachments, towards the Old Orchid Site, Mont Millais, St. Helier owned by the public of the Island, with the purchasers of No. 1, Victoria Terrace being responsible for the payment of all scale legal fees;
  4. as recommended by the Public Works Committee, the purchase from Mr. John Edward Le Cornu and Mrs. Florence Ivy Le Cornu, née Knott, and Mr. David Mallett Le Cornu and Mrs. Ada Le Cornu, née Woodward, of an area of land at Greenfield Cottages, La Rocque, Grouville , measuring 873 square feet, required for road widening purposes, for the sum of £1,746, with the Committee's being responsible for reasonable accommodation works and all scale legal fees.

THE STATES noted that Senator Richard Joseph Shenton had withdrawn the Proposition relating to the display of the price of goods (P.153/87 – lodged on 22nd September, 1987).

Price of alcohol. Statement.

The President of the Tourism Committee made a statement in the following terms –

"1. At the States Sitting on 12th April, 1988, I replied to two questions asked by Senator Shenton concerning price increases earlier in the year by local breweries.

In response to one of the questions asked by the Senator, I indicated that a fuller reply would be made once the Economic Adviser's Office had had an opportunity to investigate the background to the recent price increases and assess whether such increases were indicative of excessive wholesale and retail margins by the local breweries.

  1. In undertaking the investigation, the Economic Adviser's Office has obtained information from the local breweries and from a major brewery in the United Kingdom. From this and other information relating to the costs faced by the local breweries, the Economic Adviser's Department can find no evidence that the price increases earlier this year were other than in response to increased costs generally: that is, labour costs, brought in materials and excise duty.
  2. The Economic Adviser's Department had carried out an enquiry into the pricing of alcoholic drink in 1987 at which time it was concluded that –
  1. There was no evidence that for the major suppliers wholesale/retail margins were excessive, nor was there any evidence to suggest that, in general, margins were out of line with those obtained by other traders in the Island. Within the public houses the profit mark-up also compared reasonably with United Kingdom practice.
  2. There was no evidence that price increases were other than in response to increased costs generally. There were particular traders who argued that their costs were higher than the average and that this was the reason for higher prices, not a higher profit margin.
  3. There was no evidence of a lack of competition between traders.
  1. The  further  research  undertaken  by the  Economic Adviser's  Office  in  response  to  Senator  Shenton's questions in April 1988, suggests that this situation has not tangibly altered over the twelve months that have  elapsed  since  the  previous  study  was undertaken."

Halkett Place, St. Helier : purchase of Nos. 2–10.

THE  STATES,  adopting  a  Proposition  of  the  Public  Works Committee –

  1. approved the purchase by the public of the Island of Nos. 2–10 Halkett Place, St. Helier , by tender orby negotiation, from Barclays Bank PLC;
  2. authorised  the  Island  Development  Committee  to make  the  necessary  funds  available  from  its  vote "Acquisition of Land – Major Reserve";
  1. authorised the Attorney General and the Greffier of the States to pass the necessary contracts in the matter;
  2. approved  the  transfer  of the  administration  of the property from the Island Development Committee to the Public Works Committee.

Café at Le Braye slipway, St. Brelade .

THE STATES, adopting a Proposition of the Tourism Committee –

  1. approved  the  renewal  of the  lease  of the  café  at Le Braye  slipway,   St. Brelade  to  Mr. Arthur Robert Gibbins,  Mrs. Phyllis  Gibbins,  née  Kent,  Mr. Peter Ivan Gibbins and Mrs. Anne Huelin, née Gibbins, for a further period of three years from 25th December, 1988, at annually increasing rates as follows –

  1. authorised  the  Greffier  of the  States  to  sign  the necessary lease;
  2. authorised the Treasurer of the States to receive the rent as it becomes due.

Victoria Cottage Homes: modernisation of Blocks A and I.

THE  STATES,  adopting  a  Proposition  of  the  Cottage  Homes Committee –

  1. approved Drawings Nos. 2822/14A/24/25/26/27/28 showing the modernization works in Blocks A and I, Victoria Cottage Homes;
  2. authorised the Greffier of the States to sign the said Drawings on behalf of the States.

South Pier, Port of St. Helier : lease.

THE STATES, adopting a Proposition of the Harbours and Airport Committee –

  1. agreed to lease to the Jersey Yacht and Boatyard Company Limited the premises on the South Pier, Portof St. Helier , (designated Lettings No. S8, S13, S14 and S15) presently occupied by the company, for a further term of nine years commencing on 24th June, 1988, at a rent of £27,984.00 a year, subject to rent review clauses at the third and sixth year of the lease for the storage workshop and shop, and on an annual basis for the one-bedroomed flat;
  2. authorised the Greffier of the States to sign the necessary agreement;
  3. authorised the Treasurer of the States to receive the rent as it becomes due.

Les Cinq Chênes, St. Saviour (Phase III).

THE STATES, adopting a Proposition of the Housing Committee –

  1. approved Drawings Nos. 3516/10, 11,13,14,15 and 16, showing the development of Les Cinq Chênes, St. Saviour (Phase III) to provide two small blocks each comprising four two-bedroomed flats, with two three-bedroomed houses and one two-bedroomed house;
  1. authorised the Greffier of the States to sign the said Drawings on behalf of the States.

THE STATES, adopting a Proposition of the Education Committee, amended their Act of 25th June, 1986 and approved, in principle, the construction of two residential properties at Les Quennevais School and Community Centre instead of one each at Grands Vaux and St. Mark's schools.

THE STATES, in pursuance of Article 2 of the Census (Jersey) Law, 1951, made Regulations entitled the Census (Jersey) Regulations, 1988.

Licensing (Licence Fees) (Jersey) Regulations, 1988. P.110/88.

THE STATES, in pursuance of Article 11 of the Licensing (Jersey) Law, 1974, as amended, made Regulations entitled the Licensing (Licence Fees) (Jersey) Regulations, 1988.

Hilgrove House, St. Helier : lease. P.111/88.

THE STATES, adopting a Proposition of the Housing Committee –

  1. approved the assignment of the unexpired portion of the head lease from Chase Bank (C.I.) Limited, of Hilgrove House, Hilgrove Street, St. Helier , effective from 29th September, 1988, for the purpose of providing office accommodation for the Housing Department at an annual rent of £67,500, payable quarterly in advance and subject to review in line with market forces at the end of1991 and thereafter at the end of every fifth year;
  1. approved, in principle, the expenditure of up to £150,000 by the Housing Committee to bring the building to a condition required under the terms of the full repairing lease and on modifications to the internal areas of the building to meet the practical requirements of the Housing Department;
  2. authorised the Attorney General and the Greffier of the States to pass the necessary contracts in the matter;
  3. authorised the Treasurer of the States to pay the rent as it becomes due.

Airport – noise disturbance: newspaper aircraft. P.114/88.

THE STATES, adopting a Proposition of the Harbours and Airport Committee, referred to their Act of 19th November, 1969, and substituted for paragraph (1), the following paragraph –

"(1) to agree that there shall be no operation of jet aircraft

into and out of Jersey Airport by night except –

  1. in extenuating circumstances;
  2. to allow the British Aerospace 146jet aircraft to fly into and out of the Island each morning in connexion with the carriage of the national newspapers, etc.

night being defined for the purposes of noise measurement as the period between 22.30 and 07.30 hours local time."
