Senator Richard Joseph Shenton asked Deputy Leonard Norman, President of the Housing Committee the following questions -

The President of the Housing Committee replied in the following terms -
- I amaware that houseshavecome
in t o t h e ownership of companies
fo l lo w ing a dégrèvement, some of
w h i ch are subsequently acquired
an d o c cupied by persons who do not h av e r esidential qualifications.
It i s a matter of great concern to
m y C o mmittee. However, it is a
p er f e c tly legitimate process and
o n e w h ich the Housing Law does not
cu r r e n tly control.
- On28thFebruary this year, my
C o m mittee instructed the Law Draftsman t o p repare an amendment to the Housing L a w to close what we see as an
u n a cceptable loophole. In my
C o m mittee's Consultative Paper entitled R e view of the Housing Regulations',
d a te d March 1992, circulated to all
S t a tes' Members and presented to the
S t a tes on 31st March, we say the
f o ll owing -
T h e C ommittee is alarmed
th a t occupancy conditions which it m a y h ave over residential
p ro p e r ties may be lost due to
d ég r è v ement procedures. Whilst the in c i d en ce is infrequent, the fact
th a t i t may happen at all is
u n ac c e ptable. It has already been
th e su b ject of correspondence
b et w e e n the Committee, the
Ju d i c ia l Greffier and Crown
O f fi c e rs, and the Committee has
in s tr u c ted the Law Draftsman to
p re p a r e amendments to the Law.'
T h e matter is still with the Law
D ra ftsman but I am advised that a draft
a m e ndment has been produced which is t h e subject of discussion between the
L a w Draftsman, Crown Officers, Judicial G re ffier and my own department.
3 . I am unable to inform the Senator on t h e number of properties currently
b e in g advertised for acquisition in
t h is way.
T h e acquisition of property through
t h e dégrèvement procedure is not a
t ra n saction which requires either
a p p lication or notification to, or
c o n sent of, the Housing Committee and h e n ce we have no record of such
a c q uisitions.
H o wever, I am advised by the
J u d icial Greffe that there have been 16 d é g rèvements in the last ten years, and a f u rther two are pending. I should add t h at any unqualified resident acquiring a h o use in this way does not obtain
h o u sing qualifications in his own
r ig h t.''

THE STATES, adopting a proposition of the Public Services Committee, received the reports of the British Geological Survey WD/91/15 and the Working Party on the Safeguarding of the Water Resources of Jersey, and charged the Public Services Committee -
( a) to prepare legislation for the better m an agement of the Island's water
r e so urces in accordance with the
p r in ciples outlined in Appendix II of t h e Working Party's report;
( b) to consider measures and recommend a c ti on for the further extension of
w at er mains and main drainage;
( c) to investigate and recommend
a p p ropriate action to ensure the

THE STATES commenced consideration of a proposition of Senator Richard Joseph Shenton that all increases in revenue income in the
public sector resulting from additional charges above four per cent a year should require the prior approval of the Finance and Economics Committee. After discussion Deputy Ronald Winter Blampied of St. Helier proposed that the States move to the consideration of the next
item on the Order Paper, which proposition was carried, more than 20 Members voting in support thereof.
