The President of the Policy and Resources Committee replied as follows -
1. T he Policy and Resources
C om m ittee, at its meeting on 28th
N ovem ber 1995, considered a
reques t from the Finance and
E co nom ics Committee that a draft
L im it e d Liability Partnerships Law sh oul d be included in the 1995
L eg is l ation Programme. Both
C om m ittees were informed that, as the dr af ting of the Law would, for
the m os t part, be undertaken by
law yer s in the private sector
incl udi ng eminent Q.C.s in London, the i nvol vement of the Law
D r a ft s man's office should be
m i ni m al and, in particular, there
w oul d be n o impact on the 1996
L eg is l ation Programme. It was on
thi s bas is that the Committee
ag r ee d t o the request and it is
not , t her efore, correct to say
that t hi s Law was given priority
ove r i t ems in the 1996 programme ap pr ove d by the States.
I n t he event, the draft Law which was s ubm itted for scrutiny by the Law
D r af tsman's office proved to be less
t ha n s atisfactory to the Island, and,
i n t he course of redrafting it, a
num ber of unresolved issues were
i de nt ified, on which it was necessary
t o r each decisions after some
cons ultation with the potential users
of t he legislation, their professional advi sers and others. As a result, the
dr a fting of the Law took considerably
l on ger than the Committee originally ant i cipated. This has led the Committee t o t he conclusion that, contrary to the vi ew s expressed in some circles, the cont racting out of law drafting to
per sons who do not have extensive expe rience in that field is counter-
pr od uctive.
I s houl d add that strenuous efforts
have been made in the Law Draftsman's of fi ce to make up the time which was gi v en over to the draft Limited
L i a bility Partnerships Law, and, as a
r es ul t, the effect on items at the top
of t he 1996 Legislation Programme has not been significant.
2 . As I have indicated in the answer to
t he pr evious question, the decision to
go ah ead with drafting the Limited
L i a bility Partnerships Law was made
bef ore my statement to the House on
16t h January 1996. However, the
expe rience of the Limited Liability
P ar tnerships Law subsequent to that
deci sion having been made has served to f ur t her emphasise the need for the
pr oc edures to which that statement
r ef er s.
T he P olicy and Resources Committee in deci ding to support the drafting of the
l egi slation, in November 1995, did so beca use it was satisfied the
l egi slation would be of considerable bene fit to the Island and, as mentioned i n m y answer to question 1, because it w a s assured that the drafting of the
l egi slation would not be demanding of
t he r esources of the Law Draftsman's depa rtment.
3 . The nature of law drafting is such that
i t i s impossible to specify an exact
num ber of days in response to this
ques tion, but the Law Draftsman informs m e t hat, as at 21st May 1996,
appr oximately 45 working days had been s pen t on the drafting of this Law. The
S t a tes are being asked to adopt the
dr a ft Law, following which a further
com mitment of drafting resources will
be r equired for the purposes of
pr e paring subordinate legislation in
t he f orm of Regulations to deal
par ticularly with the winding up of
i ns ol vent limited liability
par tnerships. The best estimate which
can now be given for this is 15 working days .

l egi slation. I have therefore asked the
V i ce -President of the Policy and
R es ources Committee, in his capacity as P r es ident of the Finance and Economics C om mittee, which is the Committee

I n t he case of the Jersey Law Society F i na ncial and Commercial Law Sub- C om mittee, that body circulated the dr a ft amongst Jersey law firms and
r ep lies were collated by one of their num ber.
A l l the replies were considered and a r ev ised draft sent to those firms which had s ubmitted comments. This process w a s repeated a second time and,
even tually three separate Jersey legal f ir m s received all successive drafts unt il the project was finalised.''
Bull bars'' - questions and answers (Tape No. 341)
Deputy Philip John Rondel of St. John asked Deputy Michael Adam Wavell of St. Saviour , President of the Defence Committee, the following questions -

ve hi c les in Jersey from 1st
Ja nuar y 1997, would the President ad vi s e t he States what
co ns i der ation the Committee has gi ven t o the impact this decision m ay ha ve on visitors wishing to br i ng t heir cars to Jersey?
2 . How is the Committee going to notify vi si tors that it is illegal to have
bul l bars' on their vehicles once they have booked their vehicles to Jersey?''
The President of the Defence Committee replied as follows -
1. L ast year 26,000 visitors' cars vi s it ed the Island. The number
fi tt ed w ith bull bars is not known but i t i s unlikely to exceed
ab out 0 .5 per cent, i.e. only 130.
2 . So far as visiting vehicles are
conc erned the Department wrote to the O p er ations Managers of all shipping
com panies bringing cars to the Island and s aid -
I n a n ef fort to improve road
sa f et y a nd promote Jersey as a
pe des t rian friendly Island, the
D ef ence Committee has, from 1st Ja nuar y 1997 banned the fitting
an d us e of bull bars on all
local l y registered vehicles.
A s yo u w ould expect, Jersey
pr ovi des the warmest of welcomes to al l vi siting motorists, but
bot h l ocal and visiting
pe des t rians would really
ap pr ec iate it if drivers of
4 x 4' s would leave their bull
ba r s a t home. Whilst temporary
ci r c ul a tion in Jersey would not be ref us ed t o visitors, we would hope w her eve r possible they would
res pe ct our bull bar policy.
C ons equen tly, the Committee would be gr a teful if you include this
inf or m ation in your literature to
vi s it i ng m otorists.

D e par tment who also produced a report f or t heir own Committee, dated 16th A p r il 1996.

T he r efore to support a policy of ba nni n g bull bars on locally
regi st e red vehicles can only
cr eat e g ood publicity for the
Is l and w hen the rest of Europe and es peci al ly the United Kingdom are be com ing more aware of the
pr obl em .'
We therefore hope that Tourism will i nc l ude similar sentiments in its 1997 br oc hure.

conf irmation from Brussels that the
D e f ence Committee's policy cannot be chal lenged by reference to the Island's obl igations to the European Community under Protocol 3.

F rom 1997 onwards we will continue to deal with visiting motorists who do not com ply with our local Construction and U s e l egislation in a sensitive and

THE STATES, in pursuance of Article 92 of the Licensing (Jersey) Law 1974, as amended, made Regulations entitled the Licensing (No. 10) (Jersey) Regulations 1996.
Establishment of a casino in Jersey - P.36/96, P.66/96 and P.91/96
THE STATES rejected a proposition of Senator Richard Joseph Shenton requesting the States -
( 1) to agree, in principle, to the
es tabl ishment in Jersey of a single, t ight ly controlled casino offering
f ac i lities competitive with those in t he U nited Kingdom and France;
( 2) to charge the Gambling Control
C om mittee to prepare the appropriate R egul ations under the Gambling
( C ont rol) (Jersey) Law 1964, as
am ende d, to license the operation of t he cas ino.
