Senator Richard Joseph Shenton asked Deputy Frank Harris on Walker of St. Helier , President of the Establishment Committee, the following questions -

2 . Will the President inform members of t h e cost to the taxpayer of the early
r e ti rement packages?
3 . Will the President inform members of t h e number of senior civil servants who h a v e been re-employed by the States in a n y capacity after accepting voluntary e a rl y retirement?''
The President of the Establishment Committee replied as follows -
1. I n answering this question, I have
h ad t o make some assumptions.
F ir s t, I have assumed that the
p er i o d to which the question
re f e rs dates from when I became
P re s i d ent of the Establishment
C o m m ittee at the end of 1993;
se c o n d , I have interpreted the
ex p r e s sion senior civil servant'
as c iv i l servants in grade 11 and
ab o v e - i.e. the management
g ra d e s ; and third, I have assumed th a t t h e Senator is referring to
v o lu n t ary redundancies as well as v o lu n t ary early retirements given th a t t h ere can be a very fine
d is ti n c tion between the two.
I c a n advise the Senator that since
D ec ember, 1993, 22 senior civil
s ervants have been granted voluntary e a rl y retirement or voluntary
r e d undancy. This figure includes the f iv e applications from the Public
S e r vices Department recently
a n n ounced.
2 . The total cost of voluntary early
r e ti rement and voluntary redundancy
s in c e December 1993, for the 22 senior c i vi l servants referred to, is £1.84m.
T h e total cost of the programme
t h ro ughout the entire public sector
o v e r this period is £3.19m. These are
o n e -off costs.
T h e voluntary early retirement and
v o l untary redundancy programme forms a m aj or part of my Committee's initiative
t o m ake the public service more
e f fi cient and effective. These
s e v erances normally result in the
d e le tion of posts, and I can advise the
H o use that these policies (approved by
t h e States in 1995 when accepting the
m an power section of Strategic Policy
R e v iew) have resulted in savings of
£1 . 17m a year.
I n s ome cases, posts are not saved but t h e voluntary retirement is allowed in t h e interests of promoting greater
e f fi ciency within the service.
3 . In order that there can be no
m is understanding whatsoever, I can
a d v ise the House that there is one
s e n ior medical officer, who has
r e ce ntly accepted voluntary early
r e ti rement and who, for many years, has h a d a private, ad hoc arrangement
w h ereby in his own time, he has
a s s isted the police with counselling
o f fi cers who have been involved in
t ra u matic, stressful incidents.
I u n derstand that this arrangement
c o u ld continue in the future, but this
i s e ntirely a matter for the Defence
C o m mittee, and is unrelated to the post f ro m which the officer has retired. As a r e sult of this retirement, a post
s a v ing has been achieved.
A p art from this one possible, unusual s it u ation, I can inform the House that
t h er e are no recorded examples of
s e n ior civil servants having accepted
v o l untary early retirement or voluntary r e d undancy, being re-employed by the S t a tes in any capacity.''
Les Viviers de Ste. Catherine, St. Martin - questions and answers (Tape No. 334)
Deputy Frederick John Hill of St. Martin asked Senator Antony Beresford Chinn, Vice-President of the Harbours and Airport Committee, the following questions -
1. T he previous lease by the public
o f L e s Viviers de Ste. Catherine
an d t h e surrounding area on which th e p o rtakabins and freezer units
cu r r e n tly stand having expired on 3 1 st M arch 1996, would the
P re s i d ent advise members what
p la n s t he Committee has for the
fu t u re use of the area? Does the
C o m m ittee intend to continue to
le a s e t he land and, if so, what
st e p s i s it taking to find a
su i ta b l e tenant?
2 . While the Committee considers its
f u tu re plans for the area what steps
d o e s it propose to take regarding the p r e sent condition of the property, and d o these steps include the removal of t h e portakabins and freezer unit that
a r e presently on site?
3 . Following the recent landslides in and a r o und the tunnel area, would the
P r e sident advise members how safe the a r ea is at present and whether any
r e m edial measures are necessary to
e n s ure the general safety of the area
a n d to allow for it to be used
p r o ductively in future?''
The Vice-President of the Harbours and Airport Committee replied as follows -
1. T he tunnels and surrounding areas
w e r e u ntil 31st March 1996 leased
to F is h Port Limited and the
C o m mittee had for a considerable
ti m e b een involved in negotiations
w i th th e beneficial owner of that
co m p a ny to grant a further lease
w h i ch would have enabled a new
co m p a ny, Kingdom of the Sea
(J e r se y ) Limited, to convert the
tu n n e l s for use as an aquarium,
se a li fe and interpretation
ce n t r e. A report and proposition
(P . 2 3 /9 4) was lodged on 1st March
1 9 94, but subsequently withdrawn
w h e n i t became known that the
co m p a ny wished in addition to the
af o r e m entioned development, to
p ro v i d e a restaurant on the site.
T h e c o mpany's lawyers have
re c e n tl y asked the Committee
w h e th e r it would still be prepared
to g ra n t a new lease and the
C o m m ittee has responded that it
w o u l d be willing to recommend such a n e w lease provided that no
re s ta u r ant or similar facility was
in c l u d ed within the development.
H o w e v er no further detailed
n eg o t i ations have taken place,
al t h o u gh a meeting with the
v ar i o u s parties has been arranged
to w ar d s the end of May. No other
ap p r o a ches have been made to the
C o m m ittee for alternative uses for
th e tu n nels and the Committee has
ta k e n n o steps to find another
te n a n t. Any proposals the
C o m m ittee may have with regard to th e fu t ure use of these areas will
b e b r o ught to the House for its
ap p r o v al.
2 . The Committee intends to tidy up the
a r ea and has advised the previous
t e na nt that it would not give approval
f o r the portakabins and freezer units
t o r emain on the site beyond 31st March 1 9 9 6 and steps are being taken to
e n sure the removal of these units as
s o o n as possible.
3 . There has been no general landslide,
b u t a small rockfall occurred recently
i n t he area near to the tunnel entrance
o n the western side of the rock. An
i n v estigation was undertaken by the
P u b lic Services Department in order to d e te rmine the degree of instability of
t h e rockface and to establish the cost
o f r emedial action. The results of this
i n v estigation suggest that the rockface a b o ve this entrance could be secured at a c o st of approximately £15,000. In the m ea ntime the area has been roped off, t h e doors to the tunnels secured and
s ig n s have been erected advising the
p u b lic to keep clear of the area. The
C o m mittee has yet to decide whether to p r o ceed with the securing of the
r o c kface and the future use of the
t u n nels will have some bearing on this d e c ision.''
Public Service recruitment policy - statement
The President of the Establishment Committee made a statement in the following terms -
Members will recall from the discussions
h eld in connexion with the 1995 Strategic
P olicy Review that the Establishment
C ommittee had put forward a number of
p roposals concerning those who do not
p ossess residential housing qualifications
a nd their recruitment and employment by the p ublic sector.
O f the eight proposals that had been
r ecommended by the Establishment Committee, s ix had been accepted by the Policy and
R esources Committee and are in the process
o f being implemented. The remaining two,
w hilst recognised by the latter Committee
a s putting the public sector on a level
p laying field with the private sector,
n evertheless caused concern to that
C ommittee that their implementation would
a dversely affect the job opportunities
a vailable to Island residents. As a result,
t he Policy and Resources Committee
r equested the Establishment Committee to
r eport to the States on its recruitment and
t raining policies in order to assist the
S tates to judge whether it would wish to
a dopt the two outstanding proposals put
f orward by the Establishment Committee.
I n the light of the concerns expressed by
t he Policy and Resources Committee, the
E stablishment Committee has reviewed its
e arlier decision and has decided not to
p roceed in the way that it had originally
i ntended. It has, instead, determined that
i t would want to adjust its existing
p olicies to provide, in future, that those
w ho have been resident in the Island for a
m inimum period of five years and who have -
( a) attended full-time schooling at one of t h e local schools; or
( b) qualified in a profession or trade
w h ere it has been demonstrated to the s a ti sfaction of the Establishment
C o m mittee that it is most unlikely that s u f ficient local residents would be
a v a ilable to fill potential vacancies
o v e r a period of the following three
y e a rs,
w ill be entitled to be employed on a
p ermanent basis within the public sector.
I t is important to note that this approach
w ill only be adopted where the
E stablishment Committee is satisfied that
a n administering Committee's requirements c ould not be fully met by the application
o f a suitable training course for Island
r esidents. In addition, the Committee would s eek to establish whether there were any
l ocal students being educated in the United K ingdom who would be suitable to fill a
v acant post and who were likely to return
t o the Island in the near future.
I t is stressed that employment of people
o n these revised terms will not give rise
t o entitlement to lease controlled
a ccommodation in the Island. The offer of e mployment will, as far as the rules in
c onnection with local accommodation is
c oncerned, be on the basis that such people w ill be subject to the same rules that
a pply to those who are employed by the
p rivate sector.
T he changes that my Committee are about t o implement will bring about an easement i n the rules that apply to those who have
b een connected with the Island for five
y ears or more. However, as the government
o f this Island, my Committee recognises
t hat we should seek, wherever possible, to e mploy those who have attained full r esidential status.
I n advising States' members of these
c hanges, I would, therefore, also want to
r emind them of the considerable investment, b oth of time and money, that the
E stablishment Committee and other
C ommittees have made in recent years to
t rain local people for public sector jobs.
I am happy to confirm this morning that the e fforts of the Establishment Committee to m aintain this emphasis on training local
p eople to take up positions within the
p ublic sector remain undiminished and that t he proposals that I have just announced
w ill not detract in any way from these
i nitiatives.
F inally, in order to assist Committees and S tates departments, I have asked the Chief E xecutive Officer of the States Personnel D epartment to write to all chief officers
t o explain in more detail the manner in
w hich these proposals will now be put into e ffect.''
