Arrangement of public business for the present meeting
THE STATES acceded to the request of the President of the Public Services Committee
that the proposition regarding the purchase of land for the Stopford Road/Wellington Road gyratory road scheme (P.86/97 - lodged au Greffe'' on 17th June 1997) which was set down for debate at the present meeting be withdrawn, the Planning and Environment Committee having presented this day a new proposition for
debate.
THE STATES rejected the request of the Connétable of Grouville that consideration of the proposition relating to land at Ville ès Rénauds, Grouville (P.149/96 - lodged au Greffe'' on 24th September 1996) be deferred from the present meeting.
Mains drains - connection to all properties: petition - P.108/97
Deputy Frederick John Hill of St. Martin presented to the States a petition on behalf of Lady Brownlow and others regarding the connection of all properties to the mains drains.
THE STATES referred the petition to the Public Services and Finance and Economics Committees and lodged au Greffe'' a proposition of Deputy Hill to the effect that the prayer of the

Bill of Rights for Jersey - questions and answers (Tape No. 398)
Senator Stuart Syvret asked Senator Pierre Françoise Horsfall, President of the Policy and Resources Committee, the following questions -

w h ether the proposed Bill of Rights
w il l reflect all the Island's existing
o b l igations under the European
C o n vention for the Protection of Human R i g hts and Fundamental Freedoms?''
The President of the Policy and Resources Committee replied as follows -
1. O n 13th September 1995 the States,
in a cc e pting an amendment of
D e p u ty G. Matthews of St. Brelade
to su b - paragraph (d) of the 1995
S tr a te g ic Policy Review, agreed
th a t t h e Policy and Resources
C o m m ittee should be requested to
p re p a r e a report on the case for
an d a g ainst the introduction of a
B il l o f Rights for Jersey.
T h e first draft of a comprehensive
r e p ort on this subject was considered
b y the Policy and Resources Committee l a te last year. The Committee agreed to r e fe r this draft to both Deputy
M a tthews and to the Law Officers for
c o m ment. The comments of the Law
O ff icers have recently been received
a n d a second draft of the report is
b e in g prepared in the light of these
c o m ments.
2 . The draft report is a lengthy document
w h ich provides a comprehensive analysis
o f t he case for and against the
i n tr oduction of a Bill of Rights, and
t h e analysis is based on the rights
c o v ered in the European Convention for
t h e Protection of Human Rights and
F u n damental Freedoms and in Bills of
R i g hts from other Commonwealth
j u ri sdictions and British Dependencies.
S i n ce the report was drafted the
p r e sent United Kingdom Government has a n n ounced its intention to produce a
B i l l that will incorporate the European
C o n vention into domestic law and we
n e e d to have regard for what the United
K in gdom Government is proposing. This s h o uld become clearer in the near
f u tu re. Any decision on whether to
i n tr oduce a Bill of Rights for Jersey
a n d if so in what form, will need to be
m ad e by this House, following a full
a n d informed debate.''
Income tax arrangements - question and
answer (Tape No. 398)
Senator Stuart Syvret asked the Connétable of St. Saviour , in the absence of the President and Vice-President of the Finance and Economics Committee, the following question -
Would the President provide members with a list of all those types of undertakings
o perating in or through Jersey, which have,
o r would be able to, secure any form of
n egotiated income tax arrangement?''
The Connétable of St. Saviour replied as follows -
Negotiated income tax arrangements have b een reached with undertakings in the
f ollowing areas -
B a n king
I n v estment dealing I n te rnational leasing M in ing finance
E x p ort/import.
B y way of background I should explain that t hese arrangements relate to International
B usiness Companies, or IBCs.
T he IBC was introduced in 1992 as a means
o f attracting to the Island business which
w ould not come here at the standard rate of t ax. The international business profits of
a n IBC are charged to tax as follows -
In t ernational Profits T ax Rate
F ir st £3 million 2 p er cent N e xt £1.5 million 1 .5 per cent N e xt £5.5 million 1 p er cent R e mainder 0 .5 p er cent
O ther income is charged at 30 per cent. If a prospective IBC is to have premises and s taff in Jersey some of its profits arise
f rom trading locally and those profits are t axed at 30 per cent. There is no hard and f ast way of determining the level of
p rofits arising in or out of the Island so
i n practice some negotiation takes place. I n the course of those negotiations due
a ccount is taken of such matters as the n umber of employees in Jersey and whether a ny will require a 1(1)(j)' licence, in
o rder to ensure that the economic benefit
o f the proposed IBC is commensurate with t he take-up of resources in the Island.
T he IBC has been a great success for the
I sland. Currently there are 110 of them and i t is expected that the exchequer will
b enefit from them this year to the extent
o f £9 million, most of which will be paid b y those IBCs that pay tax at 30 per cent
o n part of their income.
A further sizeable benefit to the Island is t hat some banks have used IBC status to i ncrease substantially the bank deposits t hey hold in Jersey.
I t is not possible to give a list of
t hose undertakings which would in the
f uture be able to enjoy IBC status. Subject t o regulatory approval, the IBC can be used f or any kind of undertaking.
F or the sake of completeness, I should add t hat a non-resident company is liable to
i ncome tax if it carries on trading
a ctivities through a branch in Jersey.
H ere again, the lack of a precise method of c alculating the element of local profits
p ermits a degree of flexibility in the
a mount of tax paid. This sort of
a rrangement has largely been superseded by t he introduction of the IBC.''

The President of the Planning and Environment Committee replied as follows -
1. T he reasons why planning
p er m is sion was granted for an
ex t e n s ion to the car park at Le
R ic h e s supermarket, Red Houses,
S t. B re lade, are fully set out in
a r e p o rt presented to the States
b y t h e (previously constituted)
P la n n i ng and Environment Committee
o n 1 9 t h November 1996
(R .C . 3 3/96). That report sets out
th e b ac kground to the application,
d et a il s of the proposal,
co n s u l tations undertaken,
re p r e se ntations received and an
ap p r a i sal of the various planning
is s u e s involved. The report
co n c l u ded that the Committee was
m i n d e d to grant permission, having
re g a r d to the circumstances of the
ca s e , f or the modifications to a
si n g le level car park rather than
th e tw o level car park given
p la n n i ng permission in May 1993
an d t h e potential highways and
am e n it y improvements associated
w i th th e scheme.
T h e permit would have been issued
s h o rtly thereafter, if it had not been
f o r representations submitted to the
C o m mittee by myself in a written
re s ponse' to the Committee's report,
w it h an associated request for me to
a d d ress the Committee on the matter.
T h e Committee agreed to my request, but t h is did not occur because it coincided
w it h the end of the previous
C o m mittee's life, and I then became the
n e w President!
T h e applicant company, having been i n fo rmed of the further deferral (in
a d d ition to the previous deferral while t h e matter was being reported to the
S t a tes) were considering legal action
a g a inst the Committee, to require a
f o rm al determination of their
a p p lication under the Island Planning
L a w . However, because of the
c i rc umstances associated with the
c h a nge in Committee, the applicants
s u b sequently indicated their agreement t o h ave the application temporarily
h e ld in abeyance for a three month
p e r iod. When the application came back f o r consideration by the Committee at
i ts m eeting on 10th July, my previous w ri tten representations were submitted t o t he Committee and, because of my
p r e vious involvement I withdrew from t h e meeting. The Committee decided to g r a nt permission, having taken into
a c c ount all the background
c i rc umstances and details of the
p r o posal, including the previous
p e r mission for a two level car park in
1 9 9 3, the previous Committee report to t h e States, the residents' petition and
a l l other consultations and
r e p resentations received.
I n r esponse to the question as to
w h ether any indication was given to
i n te rested parties that the application w as being considered on that particular d a y , I should mention that although all
o b j ection letters on all applications
a r e acknowledged, with further letters s e n t to objectors notifying them of
C o m mittee decisions, objectors are not n o t ified of the actual day' on which
a n a pplication is to be considered.
B e c ause of the time delay associated w it h the deferral following the
N o vember 1996 report, the Planning O ff icer did telephone the immediate
n e ig hbours to inform them that the
a p p lication was due to be considered.
I s h ould also emphasise that the
a p p lication had previously been
a d v ertised in the normal manner, and
a l l objections had been taken into
a c c ount and were indeed outlined in the r e p ort presented to the States in
N o vember 1996. The Greffier of the
S t a tes had also been consulted in
O ct ober 1996 and had agreed with the C o m mittee's procedures in reporting the m at ter back to the States.
H av ing gone through this procedure and h a v ing set out the Committee's
i n te ntion to grant permission, it would h a v e been inappropriate to re-advertise t h e application. All normal procedures h a v e been followed in the processing of t h is application.
2 . The Planning and Environment Committee h a s a duty to determine applications
u n d er the Island Planning (Jersey) Law
1 9 6 4, as amended.
T h e report presented to the States in
N o vember 1996 clearly stated that the
C o m mittee was minded to grant
p e r mission for the proposed development a n d , on this basis, I cannot accept
t h at there was a general expectation
t h at the application would be referred
b a c k to the States. Any expectations
t h at the issue would be referred back
t o t he States will be from the
i m m ediate neighbours' residents whom I h a d represented. This could reflect the
o u t come of the debate on the petition
w h ich I presented to the States, the
C o m mittee of the day accepted that it
w o uld consider the matter again and
r e p ort back to the States. A vote was
n o t taken.
T h a t said, the proposed development is
n o further forward than in May 1993.
T h e applicant has received planning
p e r mission for a car park which has a
r e d uced impact on the area than the
s c h eme given planning permission in May 1 9 9 3.''
Audit Commission - statement

Strategic Policy and Action Plan 1997 - statement
The President of the Policy and Resources Committee made a statement in the following terms -
The Policy and Resources and Finance and
E conomics Committees have together reached t he conclusion that the States should be
a sked to debate the Strategic Policy Review
a nd Action Plan 1997 on 21st and 22nd
O ctober 1997 rather than 9th and 10th of
S eptember as previously proposed. The
r eason for this change is two-fold. The
P olicy and Resources Committee wishes to
h ave more time to complete the section of
t he report which will cover population
p olicy. The Finance and Economics Committee w ishes to have more time to complete
c onsideration of its future budget strategy
a nd the cash limits for Committees for

Jersey Council for Safety and Health at Work: appointment of Chairman
THE STATES, adopting a proposition of the Employment and Social Security Committee, approved the appointment of Mr. Noel Nat Martin as Chairman of the Jersey Council for Safety and Health at Work for a further term of three years with effect from 1st August 1997.

THE STATES commenced consideration of the proposition of the Connétable of Grouville regarding land at Ville ès Renauds, Grouville ,
and rejected an amendment of Deputy Alan Simon Crowcroft of St. Helier that for the words to delete'' to the end of the paragraph there
should be substituted the words and, in
respect of land at Ville ès Renauds, Grouville , identified as item 4/2 in Appendix 3, to charge
the Planning and Environment Committee to examine the feasibility of constructing some category A' houses on the said land, together with an Environmental Interpretation Centre, and to report back to the States before the
construction of any dwellings on the said land
is approved''.

THE STATES then rejected the proposition which referred the States to their Act, dated 23rd September 1987, in which they adopted paragraph 3 of a proposition of the Island Development Committee entitled Island Plan - Volume 2: plan and policies' (P.126/87), as amended, and approved the zoning of Category A housing sites shown on the Island and Town Maps and listed in Appendix 3 of the report lodged au Greffe'' on 30th June 1987, and to delete 4/2 Ville ès Renauds, Grouville '' from the approved list of Category A' housing sites.
