Budget 1998

THE STATES resumed consideration of the Budget 1998 and the estimates of capital expenditure

for the financial year commencing 1st January 1998, on pages 64 and 65 of the Budget.

THE STATES rejected an amendment of Deputy Robert Charles Duhamel of St. Saviour that in

the estimate of capital expenditure of the

Public Services Committee the amount of £900,000 in Vote No. C1637 Green Composting Site'' should be disallowed.

THE STATES adopted a proposition of the Finance and Economics Committee and agreed that the additional £1,350,000 granted to the Public Services Committee in Vote C0452 Foul Sewer Extensions'' on 2nd December 1997, should be funded from the general reserve in 1998 and that the capital estimates for 1999 would be reduced

by the same amount.

Deputy Philip John Rondel of St. John withdrew paragraph (b) of his amendment.

T he estimate of the capital expenditure of

t he Public Services Committee appearing on p age 65 of the Budget was allowed.

T he estimate of the capital expenditure of t he Planning and Environment Committee a ppearing on page 64 of the Budget was

a llowed.

T he estimate of the capital expenditure of t he Agriculture and Fisheries Committee a ppearing on page 65 of the Budget was a llowed.

T he estimate of the capital expenditure of

t he Defence Committee appearing on page 65

o f the Budget was allowed.

T he estimate of the capital expenditure of

t he Housing Committee appearing on page 65

o f the Budget was allowed.

T he estimate of the capital expenditure of

t he Sport, Leisure and Recreation Committee a ppearing on page 65 of the Budget was

T he estimate of the capital expenditure of t he Prison Board appearing on page 65 of t he Budget was allowed.

T HE STATES allowed the estimate of capital e xpenditure allocated to Millenium Projects a nd WEB Ltd. (sinking fund) appearing on

p age 67 of the Budget.

T HE STATES noted that the amount to be v oted from the Capital Fund was

£ 36,274,000.

T HE STATES then proceeded to consider the e stimates of capital expenditure to be

f inanced from the trading funds appearing

o n page 66 of the Budget and -

T he estimate of the capital expenditure of t he Harbours and Airport Committee was a llowed.

T he estimate of the capital expenditure of

t he Telecommunications Board was allowed.

T he estimate of the capital expenditure of t he Committee for Postal Administration w as allowed.

THE STATES, having noted the estimated transactions of the trading funds, decided to allow the said estimates as detailed in the undermentioned pages of the Budget as follows -

THE STATES considered the estimates of income to be produced from taxation appearing on page 2 of the Budget and agreed the estimate as follows -

THE STATES commenced consideration of a Bill to continue certain expiring fiscal Laws; to

prescribe the standard rate of income tax for

the year nineteen hundred and ninety-eight; to amend further the Law relating to income tax to increase certain personal allowances and

reliefs, to exempt certain payments from income tax, to alter the charge payable on an

application to be treated as an exempt company

and to provide for the variation of the rate of

tax chargeable on certain profits or gains of an international business company; and to amend the Laws relating to wines and spirits duty, beer

duty, tobacco duty and oils and spirits duty.

The Preamble and Articles 1 and 2 were adopted.

THE STATES rejected an amendment of Senator Nigel Lewis Quérée that in Part III, Article 3

( a) in paragraph (1) -

( i) in sub-paragraph (a), for the

w o r d s sixteen thousand seven h u n d re d and fifty pounds'' there sh o u l d be substituted the words se v e n teen thousand one hundred an d t en pounds'',

( ii ) in sub-paragraph (b), for the

w o r d s two thousand three hundred p o u n d s or four thousand six

h u n d re d pounds'' there should be

su b s t it uted the words two

th o u s a nd four hundred and twenty p o u n d s or four thousand six

h u n d re d pounds'';

( b) paragraph (2) should be deleted;

 ( c) paragraph (3) should be re-numbered as p a r agraph (2), and in clause (i) of

s u b -paragraph (a) and sub-paragraph (b)

Articles 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18 and 19, were adopted.

The said Bill was lodged au Greffe'' in second reading.

THE STATES, in pursuance of Article 25 of the Public Finances (Administration) (Jersey) Law 1967, as amended, declared that the Bill to continue certain expiring fiscal Laws; to

prescribe the standard rate of income tax for

the year nineteen hundred and ninety-eight; to amend further the Law relating to income tax to alter certain personal allowances and reliefs,

to exempt certain payments from income tax, to alter the charge payable on an application to be treated as an exempt company and to provide for the variation of the rate of tax chargeable on certain profits or gains of an international

business company; and to amend the Laws relating to wines and spirits duty, beer duty, tobacco

duty and oils and spirits duty (which Bill had

this day been lodged au Greffe'') should immediately have effect as it it were a Law

passed by the States and sanctioned by Her Majesty in Council.

THE STATES, having completed consideration of the Budget, agreed the summary of the estimated income and revenue expenditure for 1998 appearing on page 67 of the Budget as follows -

THE STATES commenced consideration of the draft The Lloyds TSB (Jersey) Law 1997 (Appointed Day) Act 199  and adopted the preamble, and

paragraphs 1 and 2.

The Schedule was adopted, the States having accepted an amendment of the Finance and Economics Committee that, in paragraph 2, after the word undertaking'' there should be

inserted the words in Jersey''.

Public Lotteries Board: membership - P.183/97

THE STATES, adopting a proposition of the Gambling Control Committee, and in pursuance of Regulation 3(5) of the Gambling (Channel Islands Lottery) (Jersey) Regulations 1975, as amended, as a result of the resignation of Mr. Colin Hill

and Mrs. Cynthia Rumboll, appointed the following persons as members of the Public Lotteries Board for a period of five years,

namely -

La Collette, St. Helier: transfer of administration of Elan Animal Products building - P.184/97

THE STATES, adopting a proposition of the Public Services Committee, approved the transfer of administration from the Public Services
