The conference Jersey - In or Out of

 E urope'? was considered by the States

 P ersonnel Department to be an extremely  i mportant one for the chief officers to

 a ttend. That department's training vote

s ponsored half the cost of the conference f or 10 chief officers - the balance would p resumably have been funded from

 d epartmental votes. A further four chief

o fficers and nine other civil servants also

 a ttended at the cost of the departmental

 b udgets.''

Police Services in Jersey: Independent Review - question and answer - (Tape No. 407)

Deputy Frederick John Hill of St. Martin asked Deputy Michael Adam Wavell, President of the Defence Committee, the following question -

  With reference to the Police Services in  J ersey, Independent Review P.184/96

 ( Clothier Report), on the 21st January this  y ear after the constitution of the Working  P arty had been determined, the President  s tated that he was hoping to bring a report  t o the States within six months.

W ould the President inform the States -

 ( a) what are the reasons for the delay in p r e senting the report?

 ( b) what steps are being taken to bring the r e p ort forward?

 ( c) when he now expects that the report w  il l be presented to the States?''

The President of the Defence Committee replied as follows -

  As the three questions are inter-related

 i t is simpler and more coherent to provide  a combined answer. Firstly I would wish to  t hank the Deputy of St. Martin for raising

 t he issue as it provides me with the

o pportunity to update the States on this

 s ignificant and complex matter of police

 r eform in the Bailiwick.

A s reflected in the question I was hopeful i n January of bringing to the States a

r eport from the Working Party set up to

a ddress issues related to certain

r ecommendations of the Clothier Report. The t enth meeting of that Working Party is to take place on Tuesday, 14th October, to

t ease out conflicting issues and advice

w hich have been offered in abundance during t he necessarily prolonged consultation

p rocess. Many of these matters are both

i ntricate and challenging. Few attract

s imple solutions. I am, however, pleased to

a dvise that the research and consultation

p hase is nearing an end which will enable

t he analytical and report writing process

t o commence.

A t this stage I am not in a position to

t ell members what the Working Party may

p ropose as it has yet to produce its

r ecommendations. What I am in a position to a dvise is that the Associations of the

H onorary Police are undertaking a

f easibility study into the merger of their

t wo Associations. This is just one of a

n umber of significant developments

r esulting from the consultation process.

T he Working Party is of the opinion that it w ould be unwise not to include in its

r eport to the States the outcome of such

d evelopments as their influence on the

r ecommendations could be significant.

I n summary I would wish to assure the S tates generally, and the Deputy of St. M artin in particular, that the Working P arty -

 ( a) has canvassed widely in the hope of

c a p turing all relevant factors and

s h a des of opinion regarding the

r e co mmendations of the Clothier Report;

 ( b) is aware that the consultation process

h a s been necessarily prolonged to cover u n f oreseen work generated by the

p r o cess; and

 ( c) would be disappointed if its report was n o t available to the States by Easter

1 9 9 8.''

Lease of premises on South Pier Shipyard - question and answer - (Tape 407)

Deputy Philip John Rondel of St. John asked Deputy James Thomas Johns, President of the Harbours and Airport Committee, the following question -

The arts in Jersey - questions and answers (Tape 407)

Deputy Michael Edward Vibert of St. Brelade asked Senator Leonard Norman, President of the Education Committee, the following questions -

 3 .  As the Jersey Arts Trust proposals for r e st ructuring the arts in Jersey were

c l ea r opposition to these proposals by m  an y interested in the arts locally and

l it tl e sympathy with the Trust's ideas

f o r the future and none at all with the

m et hods by which their plans have been f o rm ulated', that the Arts Trust's

p r o posals have clearly failed to unite

s p li t them instead; and that these

p r o posals should be withdrawn and the J e rs ey Arts Trust should reconsider its p o s ition?''

The President of the Education Committee replied as follows -

1.  T he progress which has been

ac h i e v ed by the Jersey Arts Trust ag a i n s t its stated targets is a

q u es t io n which should be directed to th e Chairman of the Arts Trust. H o w e v er, I have, on behalf of

D e p u ty Vibert , raised his

q u es t io ns with the Chairman, Sir P e te r C rill, and will advise

D e p u ty Vibert of Sir Peter's

re s p o n se as soon as I receive it.

 2 .  The Opera House Restoration Appeal is n o t part of the responsibilities of the

E d u cation Committee. However, to assist D  ep uty Vibert , I have contacted the

A  d ministrator of the Arts Trust and can

c o n firm that a sum of £867,409.47 has

b e e n raised to date. Further pledges

a m o unting to £585,000 have also been

m  ad e. I am advised that donations are

b e in g received on a daily basis.

T h e Administrator has also informed me t h at the restoration of St. James

C h u rch will be put to tender in January 1 9 9 8. Remedial work including the re- p o i nting of the church is presently

b e in g undertaken and the major

r e st oration is scheduled for completion i n N ovember 1998.

3 . The present débâcle which has attracted s o m uch attention cannot, in my view,

r e as onably be attributed to the Trust's

p r o posals for developing an

o r g anisation that can best meet the

i n te rests of the arts in Jersey. Rather

t h e difficulties are caused by

i n d ividuals who are clearly not

p r e pared to commit themselves to a

c o m mon purpose. I would remind Deputy V  ib ert that the common purpose was

c l ea rly identified and accepted by the

S t a tes when, in 1992 the Education

C o m mittee's proposition to establish

t h e Arts Trust was approved. I have

b e e n saddened to witness the energy

w  h ich has been expended in manipulative a n d destructive activity but will

c o n tinue to offer my best endeavours to

r e co ncile the various factions in the

i n te rests of all who wish to benefit

f ro m the best possible provision for

t h e arts in Jersey.''

Quangos - questions and answers (Tape 407)

Senator Stuart Syvret asked Senator Frank Harris on Walker , President of the Finance and Economics Committee the following questions -

The President of the Finance and Economics Committee replied as follows -

Holdings - question and answer (Tape 407)

Senator Stuart Syvret asked Deputy Jeremy Laurence Dorey, President of the Agriculture and Fisheries Committee, the following question -

According to the Department of A griculture and Fisheries statistics for 1 996, there were 433 holdings' in

a griculture in the year 1996. Will the

P resident provide the Assembly with a d efinition of the word holdings' as used i n this context?''

The President of the Agriculture and Fisheries Committee replied as follows -

  Since 1930 the term holding' has been

u sed as the most appropriate word to cover t he wide range of establishments covered by t he agricultural statistics, i.e. -

Sutton House, The Parade, St. Helier - statement

The President of the Finance and Economics Committee made a statement in the following terms -

  Members will recall that on Tuesday, June  1 7th 1997, they approved a report and

 p roposition to permit the Finance and

 E conomics Committee to enter into a lease

 f or the 2nd and 3rd floors of Sutton House

 i n The Parade to accommodate the Financial  S ervices Commission.

I advised the House on that occasion that a

n umber of premises had been investigated

b ut that Sutton House was by far the most

s uitable. The principal terms of the lease

h ad been negotiated beforehand with the

l andlord's representatives. These included

a 21 year lease, the rental, the fitting

o ut period, a service charge capped at 10

p er cent of annual rental, a break clause

a t 15 years, rent reviews, alterations, and

t he condition of the building. An amendment w as approved on the day to provide an

a dditional break clause at nine years at a

c ost of one year's rental.

A fter long and detailed negotiations it is w ith much regret that I have to inform the H ouse that the Finance and Economics C ommittee has decided that it will not be p roceeding with the lease as it has not

b een able to agree terms with the

l andlord's representatives within the

p roposition approved by the States.

This is particularly disappointing to my

C ommittee as the principal terms contained i n the proposition had been agreed in

w riting by the landlord's representatives.

I n the event, however, they sought material c hanges to those terms which were

u nacceptable.

A lthough premises are urgently required for

t he Financial Services Commission the

C ommittee was not prepared to enter into

t he lease at any cost and has now requested

i ts officers, together with officers from

t he Property Services Department, to seek

a lternative accommodation. This is going to

b e a difficult task. As of today I am not

a ware of any suitable premises which will

b e available when the Commission is likely

t o be established. There are a number of

n ew developments under way but the majority

o f those will not be completed for 18

m onths to two years. Meanwhile, we will

c ontinue to investigate all options open to

u s.

C ome what may, this unfortunate situation w ill not be allowed to delay the

e stablishment of the Commission which is of m ajor importance to the finance industry

a nd the Island's economy.''

States' computer systems and the year 2000 - statement

Deputy David Leon Crespel made a statement in the following terms -

  I would like to alert the House to the

n e e d for all Committees to present to

t h e Establishment Committee by the end

o f O ctober their plans for dealing with

    t h e year 2000 date change. I think it

a l so appropriate to stress the

i m p ortance of this issue to our Island

a s a whole.

I imagine everyone here is clear about the

p roblem. The computer systems of the 1970s a nd 1980s did not have the luxury of the

l arge amounts of computer storage space we h ave today. The millennium seemed far away a nd, with storage space expensive, dates

w ere often stored on computer using only

t he last two digits of the year. Strange

t hough it may seem, some of the software

d ating from that era is still in use today

t hroughout the world.

 T he change of century from 1999 to 2000

s e e ms a simple matter to we human

b e in gs but not so to many of our

c o m puters. If required to add, subtract

o r c ompare dates, computers may produce

i n co rrect or unpredictable results

a f te r 31st December 1999 and in some

c a s es even sooner. Nor is the problem

co nfined to business - any device which

i n co rporates a microchip could be

a f fe cted. Unfortunately, there is no

s im  ple way of predicting what errors

w  il l arise. All depends on the logic

a p p lied by hundreds of computer

p r o grammers in the thousands of

p r o grams used by the States. The only

s o lu tion is to check every computer

s y s tem we use.

W ith these issues in mind, the

E s t ablishment Committee some months ago fo r med a Year 2000 Project Board. The

B o a rd was tasked with co-ordinating the

w  o rk of departments in planning for the

y e a r 2000. The Board is presently

o v e rseeing a review and audit of all

S t a tes computer systems. This review is

t o b e concluded by the end of this

m  o nth. The picture beginning to emerge

s h o ws the States relatively well placed

t o d eal with the problem because most

o f o ur older computer systems were

r e d esigned and brought up to date in

t h e 1990s and are already year 2000

c o m pliant.

W here we do have a problem, however, is w it h packaged computer systems. These

o f f the shelf solutions were produced

i n t he United Kingdom or further afield f o r use by the States and other

o r g anisations to tackle a particular

a r ea of business such as corporate

f in a ncial functions. In most of these

c a s es, the solution will be to move our

w  o rk to a new version of the software

p a c kage. In some cases we may take the

o p p ortunity to transfer to a new p a c kage offering more facilities.

I turn now to costs. The cost of modifying

p ackaged software should fall mainly on the s oftware package supplier. On the other

h and, where a system has been produced

e xclusively for the States of Jersey and is

n ot year 2000 compliant, the States may

h ave to meet the cost of changes to the

s oftware. My Committee has not as yet been a dvised of any substantial costs in this

l ast category.

M ost States computer equipment will

f u n ction correctly beyond the end of t h e century. Old equipment is suspect a n d will need to be examined, though m  o st older items are due for renewal b e f ore the year 2000.

M uch the most costly consequence of the

y e a r 2000 will be the staff time

r e q uired to test software systems for

y e a r 2000 compliance and to train

S t a tes employees to use new and amended s y s tems. We will quantify these

r e so urce demands as soon as all

C o m mittees have advised us of the

r e su lts of their year 2000 assessments

b u t already it is apparent that most

C o m mittees will need to give priority

t o m aking staff time available for year

2 0 0 0 acceptance trials during 1998/99.

E arlier this year my Committee advised the Policy and Resources Committee and the

F inance and Economics Committee that

u pdating our computer systems for the year

2 000 could cost the States £1.5 million.

T his estimate was based on the number of

m ajor systems and on advice from elsewhere. W e have still to receive year 2000 costs

f rom some Committees, but present

i ndications are that our initial estimate

w ill not be exceeded. This amount has been

s et aside in the States IT investment plan

f or 1998 and 1999 but no new money has been m ade available, in view of which many of

t he new developments planned by Committees w ill need to be put on hold until the year

2 000 or beyond.

 I should mention to the House that my

C o m mittee has consulted with the Chief A d viser of the States on the prospects

o f u pdating our computer systems

c o n currently for both the year 2000 and

E u r opean Monetary Union. There would be p r o s and cons were we able to do so.

B u t in any event the indications are

t h at timescales for these two major

c h a nges, the one very real, the other

o n l y a possibility at this stage, are

m  o st unlikely to coincide.

N  ev ertheless, my Committee will keep

t h e issue under review.

I am briefing the House on the year 2000 d ate change at this time -

f ir s tly, to remind Presidents and their

C o m mittees that they are responsible

f o r ensuring that their own

d e p artmental computer systems and other a u to mated processes will continue to

o p e rate correctly beyond the year 2000; a n d ,

s e c ondly, to request all Committees to a p p rove a year 2000 plan for their

D  ep artment by 31st October 1997, so t h at the overall cost of year 2000 can b e e stablished and an action plan

a g r eed to encompass the States as a

w  h ole.

M y Committee will continue to monitor the p osition on a regular basis to ensure

D epartments are pulling together and

p ooling their knowledge of the problem.

W ith the permission of the House, my

C ommittee will present a further progress

r eport by June 1998 or earlier should any

s erious unforeseen difficulty arise.

 I said at the outset that the year 2000

d a te change is an issue for our Island

a s a whole. If even one key business

g r in ds to a halt, it could have serious

c o n sequences for us all. I take this

o p p ortunity to urge Jersey enterprises,

l a rg e and small, to act early to

r e so lve the problem. The longer we wait t h e more expensive the solution is

l ik e ly to be and the more strain it

w  il l put on the Island's specialist IT

s ta f f, already in very short supply.

M ay I recommend to organisations (such as t he Institute of Directors, the Chamber of C ommerce and the Small Business

A ssociation) that they ensure their members r eceive all necessary support in dealing

w ith the problem. Any organisation

i nterested in a copy of the States Year

2 000 Guidelines will find them freely

a vailable on the internet and from my

D epartment. Finally, I remind businesses

t hat they may be eligible for financial

s upport and invite them to approach the

J ersey Business Venture for further

i nformation.''

Stopford Road/St. Saviour's Road Gyratory System: transfer of administration of part of new road

THE STATES, adopting a proposition of the Housing Committee, approved the transfer of the administration of the new section of road and associated footpaths which would be part of the new Stopford Road/St. Saviour's Road gyratory system, St. Saviour , as shown on drawing No. 010, from the Housing Committee to the Public Services Committee.

Jersey Airport: lease of accommodation to Airline Services (Channel Islands) Limited

THE STATES, adopting a proposition of the Harbours and Airport Committee -

 ( a) approved the lease to Airline Services

( C h annel Islands) Limited of

a c c ommodation in the passenger pier at

J e rs ey Airport, (Letting No. B21),

t o ta lling approximately 1,710 square

f e et , for use as a Business Class

L o u nge, for a period of nine years

c o m mencing 1st April 1997, at an annual r e n t of £40,185.00, subject to annual

r e n t reviews on 1st April, commencing

i n t he year 2000;

 ( b) authorised the Greffier of the States t o s ign the necessary lease on behalf

o f t he public;

 ( c) authorised the Treasurer of the States t o r eceive the rent as it became due.

Deputy David Leon Crespel of Trinity , having declared an interest in the matter, withdrew from the Chamber prior to the consideration of this proposition.

THE STATES, adopting a proposition of the Harbours and Airport Committee -

 ( a) approved the lease to Servisair

( J er sey) Limited of accommodation at

J e rs ey Airport, comprising

a p p roximately 520 square feet of office a c c ommodation located in the passenger p i er (Letting Nos. B92 and B129), and

a p p roximately 2,880 square feet of

c a rg o bay in the Freight Terminal

t o ta lling 3,400 square feet, (Letting

N  o s. B115 and B116), for a period of

n i n e years commencing 1st April 1997, a t a n annual rent of £18,003.20,

s u b ject to annual rent reviews on 1st

A  p ril throughout the term of the lease;

 ( b) authorised the Greffier of the States t o s ign the necessary lease on behalf

o f t he public;

 ( c) authorised the Treasurer of the States t o r eceive the rent as it became due.

Deputy Crespel, having previously declared an interest in the matter, remained outside the Chamber during the consideration of this proposition.

Jersey Child Care Trust: appointment of Chairman

THE STATES, adopting a proposition of the Education Committee, approved the appointment of Advocate Mrs. Deborah Jane Lang, née Nance, as Chairman of the Jersey Child Care Trust for a term of three years with effect from 1st December 1997.

Channel Islands lottery: future use of profits - P.119/97

THE STATES, adopting a proposition of the Gambling Control Committee, agreed -

 ( a) to continue to pay the Association of

J e rs ey Charities the lottery profits

f ro m the Summer Bumper Draw' and the C h r istmas Bumper Draw' for the benefit

o f t he community and the charitable

n e e ds of the Island;

( b) that the Committee should designate 10 t o 12 lottery draws each year for community p urposes, the Jersey proportion of the

p rofits to be distributed to selected

c ommunity projects Island wide;

 ( c) to pay the Sport, Leisure and

R e c reation Committee the Jersey

p r o portion of the profits from the r e m aining lottery draws each year;

 ( d) to review the above arrangements after a p e riod of three years.

THE STATES, adopting a proposition of Deputy Terence John Le Main of St. Helier , referred to their Act dated 28th January 1986, in which they decided that the Island should make a voluntary contribution to the defence expenditure of the United Kingdom, and to their Act dated 8th December 1987, in which they agreed to implement their decision of 14th February 1987 by agreeing

to the establishment in the Island of a Territorial Army Royal Engineer Field Squadron; and requested the Defence Committee to present to the States no later than 31st January 1998 a report -

 ( i) setting out the year by year cost of

i n cl ude the cost of accommodating the v a r ious personnel who, from time to
