Jersey Island Games - congratulations and thanks

THE STATES acceded to the request of the President of the Public Services Committee that consideration of the proposition regarding the Stopford Road/Wellington Road gyratory road scheme (lodged au Greffe'' on 17th June 1997) be deferred from the present meeting to 22nd July 1997. The States agreed that the matter be taken as the first item of matters lodged under Public Business on that date.

Termination of pregnancies - questions and answers (Tape No. 397)

Deputy Alastair John Layzell of St. Brelade asked the Connétable of St. Saviour , President of the Health and Social Services Committee, the following questions -

is e f f e ctively abortion on demand

in Je r s ey?

2 . Would the President inform the A s sembly -

( a ) in the years 1995 and 1996, the

n u m b e r and grounds of terminations ca r r ie d out at the General

H o s p it al?

( b ) in the year 1996, the last figures

av a i la b le of the number of

te r m i n ations carried out in the

U n i te d Kingdom on women travelling fr o m J ersey and whether this shows

an i n cr eased trend or otherwise?

( c ) in the year 1997, since February, t h e n u mber of terminations which h av e b een carried out at the

G e n e ra l Hospital, in each case

st a ti n g the statutory ground and

th e ag e of each of the women?

3 .  Would the President inform the Assembly

w  h en the Order will be made by his

C o m mittee to provide for the

i n fo rmation to be set out in an annual

r e p ort of the Medical Officer of Health i n a ccordance with Article 9 of the

T e r mination of Pregnancy (Jersey) Law 1 9 9 7?''

The President of the Health and Social Services Committee replied as follows -

1.  I am aware of the article

p u b li sh ed in the Jersey Law

R e v ie w ' on the Termination of

P re g n a ncy Law and the opinion

ex p r e s sed that there is abortion

o n d e m and in Jersey. At this

st a g e , however, I can only repeat

th e v ie w I expressed in July 1996, d u ri n g the debate on the new Law, w h e n t he question of abortion on

d em a n d was raised, which was as fo l lo w s -

 ( i) Terminating a pregnancy is a medical

p r o cedure, and as such is subject to

t h e same checks and controls as any

o t h er medical procedure.A doctor will

o n l y carry out a termination if, after

f u ll discussion and appropriate

c o u nselling, he considers it is in the

b e s t interests of his patient. The Law

d o e s not override the professional and

e t hi cal duties of the medical

p r a ctitioner. No doctor is obliged by

t h e Law or by my Committee to carry out a t e rmination of pregnancy.

 ( ii)  T he Law does not require the

H e a lt h and Social Services

C o m m  ittee to provide a service for th e te r mination of pregnancy,

al t h o u gh the Committee accepts its re s p o n sibility to do so.

H  av ing said that, it seems the crux of

t h e article in the Jersey Law Review is r e la ted to the interpretation of

s ta t ute and that part is largely

w  ri tten in French. I am afraid my

F r e nch is not up to subtle distinctions a n d neither am I learned in the rules

o f s tatutory interpretation.Therefore,

I h a ve asked my officers to seek the

o p i nion of the Attorney General on this m  at ter.

 2 (a)  I n 1995, 67 terminations of

p re g n ancy were carried out in the G e n e ra l Hospital and in 1996, 90 te r m i n ations were carried out in

th e G e neral Hospital.

T h e legal grounds for termination of

p r e gnancy at that time were advised to

t h is House, during the initial debate

o n Termination of Pregnancy. If I may,

s ir , I would refer members to the

o p i nion of the then Attorney General

w  h ich I quoted at that time. In simple

t e rm s, an abortion was permissible if

c a rr ied out in good faith to save the

l if e of the mother or when the

c o n tinuance of the pregnancy would make t h e woman a physical or mental wreck. I a m advised the terminations that took

p l ac e in 1995 and 1996 were carried out

o n those grounds.

 2 (b)  T he only information that is

av a i la b le relates to the number of

te r m i n ations carried out in the

U n i te d Kingdom on women who have g iv e n home addresses in Jersey.

M a n y Jersey residents have

co n n e c tions in the United Kingdom

an d s o me might prefer to return

h o m e ' for a termination, or give

a U n i t ed Kingdom address during

th e i r s tay in the United Kingdom

fo r t r e atment. These figures would

n o t b e included in the statistics

m a d e a vailable by the United

K i n g d om Office for Population

C e n s u ses and Surveys.

I n 1 996, 181 women who obtained a

t e rm ination of pregnancy in the United K in gdom gave a home address in Jersey. O n the basis of the figures we have

a v a ilable, the overall trend has been a

d e c rease since 1990, when 323

t e rm inations were reported for Jersey

r e si dents in the United Kingdom.

 2 (c)  F rom the beginning of February, to th e en d of June this year, 121

te r m i n ations of pregnancy have

b ee n n otified to the Medical

O f fi c e r of Health. All were

ca r r ie d out on the statutory

g ro u n d under Article 2(2)(c) of th e L a w, that is when the woman's co n d i t ion causes her distress' and al l w  er e carried out before the

en d o f the twelfth week of

p re g n a ncy.

T h e ages of the women were as follows -

 3 .  Article 9 of the Termination of

P r e gnancy (Jersey) Law 1997 requires t h e Medical Officer of Health to lay

b e f ore the States, every calendar year, a r e port on the operation of the Law in t h e preceding calendar year.' The

M  e dical Officer of Health shall

t h er efore lay before this House a

r e p ort in 1998 in respect of the

c a le ndar year 1997.

T h e Article permits, but does not

r e q uire, the Committee to prescribe the i n fo rmation that the report should

c o n tain and my Committee does not

b e li eve it to be necessary to make an O  rd er at present.''

Composition of the Sea Fisheries Advisory Panel - questions and answers (Tape No. 397)

Deputy Philip Rondel of St. John asked questions of Deputy Jeremy Laurence Dorey, President of the Agriculture and Fisheries Committee, the following question -

  Would the President inform the Assembly

o f the composition of the Sea Fisheries

 A dvisory Panel, including the organisations  t he members represent, how the members are  s elected and the term of office for the

 n on-States members?''

The President of the Agriculture and Fisheries Committee replied as follows -

  The Sea Fisheries Advisory Panel has been  i n place since 1976 and includes both

p olitical members and members actively

i nvolved in fishing. Industry membership is

d ecided by the Agriculture and Fisheries

C ommittee on the basis of recommendations

f rom the Chairman of the Panel. The

C hairman is a member of my Committee and he i s joined by a member of the Harbours and

A irport Committee. These political

p ositions are reviewed every three years.

R epresentatives from the north and south

c oast with a special interest in low water

f ishing attend, together with the Chairman

o f the Jersey Federation of Sea Anglers and a representative of the fish farming

i ndustry. The President of the Jersey

F ishermen's Association also attends with e ither two active fishermen or the

s ecretary of his Association and one active f isherman. All these non-political posts

a re reviewed annually and at the end of

e ach three year Committee session. Also in a ttendance at meetings are the Sea

F isheries Adviser, the Senior Fisheries

I nspector and a representative of the

H arbour Office.''

Applications under the Island Planning (Jersey) Law 1964 - questions and answers (Tape No. 397)

Deputy Graeme Ernest Rabet of St. Helier asked Senator Nigel Lewis Quérée, President of the Planning and Environment Committee, the following questions -

re c e iv e d approval?

 2 .  Would the President advise members how m  an y of the applications received are

c o n nected with the tourism industry?''

The President of the Planning and Environment Committee replied as follows -

1.  M y Committee took office on 16th D e c e m ber 1996 and up to 24th June 1 9 9 7 , when the questions were

ap p l i ca tions to be considered

u n d er the Island Planning (Jersey)

L a w 1 964, as amended, and/or the

P u b li c Health (Control of

B u il d i ng) (Jersey) Law 1956, as

am  e n d ed, and the Building Bye-Laws (J e r se y ) 1960 and 1997. 666 of

th e s e a pplications were submitted

u n d er the Planning Law only, 28

w e r e f or Building Bye-Laws only,

3 0 1 w  ere for planning and building w o r k s combined and 779 for small

w o r k s which mostly required

p la n n i ng permission but on some

o cc a s i ons bye-law permission only. A s t h e Deputy will see, the

m a j o ri ty of applications were for

si g n if i cant works under the

P la n n i ng Law.

O  f the total of 1,774 applications, all

h av e been processed or are in the

p r o cess of determination; 1,409 have

b e e n determined, that is, a decision

m  ad e and the applicant informed. This r e p resents very nearly 80 per cent of

t h e total. Of those 1,308 have been

a p p roved, representing over 92 per cent

o f t he applications determined.

 2 .  The applications are not classified in a c c ordance with an industry code.

H  o wever, I can inform the Deputy that d u r ing the period only 85 of the 1,774 t o ta l applications were submitted in

r e sp ect of hotels and guest houses in

t h e Island.''

Land above the high water datum - question and answer (Tape No. 397)

Senator Stuart Syvret asked Senator Nigel Lewis Quérée, President of the Planning and Environment Committee, the following question -

  Would the President of the Planning and

E n v ironment Committee inform members of t h e area of land above high water datum

t hat has been designated to the

f o ll owing land use categories -

1 . Agricultural - crops and fallow; grass a n d rough grazing; other agricultural.

2 .  Dune.

3 .  Gorseland.

4 .  Uncultivated meadow and marsh. 5 .  Forest and woodland.

 6 .  Urban and suburban land, and land not e l se where specified.

Would the President also provide members with an annual breakdown showing the area of each of the first five above categories that has been

granted development approval since 1991?''

The President of the Planning and Environment Committee replied as follows -

  Apart from the information contained in

C h a pter 2, Volume 1 of the Island Plan,

t h e Planning and Environment Committee  d oes not have the detailed and up to date

 i nformation available which the Senator

 r equests.

 1 .  The area of land currently worked by t h e agricultural' industry and the

c h a nges in cropping patterns are only

k n o wn to the Agriculture and Fisheries C o m mittee.

 2 .  The areas of land in the Senator's

c a te gories dune, gorseland,

u n c ultivated meadow and marsh, forest

a n d woodland', are currently under

s tu d y as part of my Committee's work on t h e Island's biodiversity strategy.

 3 .  The area of urban land' will be re- a s s essed as part of the Island Plan

r e v iew when it is in progress.

 4 .  The land not specified elsewhere' by

t h e Senator would presumably include

o f fs hore reefs which are also subject

o f v ery detailed survey work which will

b e c arried out as part of preparation

o f S SIs and Ramsar designation.

 5 .  No only do we not have up to date

i n fo rmation but it would be

u n r ealistically expensive to provide an

a n n ual breakdown of the changes in this i n fo rmation. However during the

p r e paration for the replacement of the p l an ning applications system, which is s c h eduled for the autumn, we will

c o n sider whether it would be possible t o p roduce such information in the

f u tu re and assess whether the potential b e n efits will justify the costs.

 6 .  The term high water datum is an

i n co rrect one which I can discuss with t h e Senator outside question time.''

Senator Stuart Syvret asked Senator Frank Harris on Walker , President of the Finance and Economics Committee, the following questions -

1.  W ould the President of the Finance

R e g u la tion of Undertakings and

D e v e lo pment (Jersey) Law 1973, as

am  e n d ed, in 1995, 1996 and in 1997

to d a te ?

 2 .  Would he also inform members how many n e w jobs were created by the granting

o f t hese licences, and in which

i n d ustries these new jobs were created?

3 . Finally, would the President advise m em bers what measures have the

C o m mittee put into effect to ensure t h at the overall level of commercial a c ti vity is regulated in such a way as t o a chieve the States' policy of

l im  iting the Island's population to a c e il ing of 85,000 people?''

The President of the Finance and Economics Committee replied as follows -

1.  7 48 new undertakings were licensed

in 1 9 9 5, and 635 in 1996. At the

en d o f June, 1997 309 new

u n d er t akings had been approved.

 2 .  The Finance and Economics Committee has f o r many years recognised that no

m  ea ningful statistics can be produced

m  er ely by analysing the licences

g r a nted under the Regulation of

U  n dertakings and Development Law. This i s b ecause the Committee has no

k n o wledge of how many licences are

a c tu ally proceeded with, almost all of

t h e licences being granted to local

p e o ple planning to establish

u n d ertaking on their own account.

P r e sently, there is also no need for a

l ic e nce application to take on

a d d itional local staff, and the

C o m mittee has no information on the

n umber of undertakings that are being

d i sc ontinued.

T h e refore, the Committee is of the

o p i nion that the analysis of manpower r e tu rns provides the vital data that is

n e e ded to assess the relative condition

o f t he labour market. This information i s p resently published on a six monthly b a s is.

G  iv en the shortage of resources within t h e Office of the Chief Adviser and the s h o rt timescale available to research

th i s matter, I am unable to provide the j o b figures for the full years

r e q uested. However, the Office of the C h i ef Adviser has examined the

a p p lication forms for the first six

m o nths of each year and the following f ig u res emerge -

2 6 1 full time, and 153 part-time jobs w e r e created in 1995; and

5 1 6 full time, and 149 part-time jobs w e r e created in 1996;

F o r the first six months of 1997, the f ig u res are 288 full time and 169

p ar t time.

T h e above figures have been analysed

a c c ording to job category and in order

n o t to take up the time of the States

u n d uly by my reading out a long list,

t h e answer is provided in the paper

w  h ich has been placed on Members desks t h is morning. However, I would suggest

f o r the reasons I have given that the

f ig u res should be treated with extreme

F i n ance and Economics Committee is set

o u t in the Policy Statement included as

a n A ppendix to the 1996 Strategic

P o l icy Review and Action Plan.

A  t the present time, when considering

i n d ividual licence applications against

t h e background of evidence of a

t ig h tening of the labour market, the

C o m mittee is adopting a selective

a p p roach which takes the population

p o l icy fully into account. The Finance

a n d Economics Committee however is also m  in dful of other States policy

o b j ectives, which include maintaining a

s u c cessful economy and achieving a

b a la nced budget.

T he Finance and Economics Committee is a w a re that the Policy and Resources

C o m mittee is focusing on the States

p o p ulation policy in this year's

S t ra tegic Policy Review and Action Plan r e p ort, and that with this in mind,

t h at Committee is currently considering w  h at action is required both in the

s h o rt and medium term to sustain that

p o l icy. In doing so, it is proposing to

c o n sult fully with the Finance and

E c o nomics Committee and other

i n te rested parties. I welcome this and

m  y Committee believes that it should

a v o id any short-term changes, which

c o u ld be premature and counter-

p r o ductive, until this exercise is

c o m plete.

THE STATES commenced consideration of a proposition of the Defence Committee regarding the relocation of the Fire Service Headquarters. After discussion, the President of the Defence Committee agreed to accept the reference back proposed by Senator Leonard Norman.

THE STATES, adopting a proposition of the Planning and Environment Committee, decided to support the Planning and Environment Committee's intention to grant planning permission for the construction of a farm dwelling and agricultural storage building on land at Orillande, La Rue du Mont Capel, St. Ouen, (as shown on drawing No. 564/1) the land being situated within an area designated as Green Zone on the Island Map, as amended 1-87.
