THE STATES assembled on Thursday, 11th July 2002 at 9.30 a.m. under

the Presidency of the Greffier of the States Miss Catherine Mary Newcombe.

All members were present with the exception of -

Prayers

Island Plan as amended - P.69/2002

THE STATES resumed consideration of a proposition of Deputy Harry Hall ewell Baudains of St. Clement that the Island Plan (P.69/2002) as amended be referred back to the Planning and Environment Committee.

After discussion, the States granted leave to Deputy Baudains to withdraw the proposition.

THE STATES adopted a proposition of the Planning and Environment Committee, as amended, and

appr oved the revised draft Island Plan as a Development Plan under Article 3 of the Island Planning

(Jersey) Law 1964, as amended, except that for Section 11 of the draft Plan (Tourism and Recreation) there should be substituted the revised Section 11 set out in Appendix 1 to the report of the Planning and Environment Committee dated 20th June 2002 and in particular -

 (a ) t he key principles outlined in Section 3.6 of the Plan;

 (b ) P olicy G2 - General Development Considerations subject to the following amendment -

a f ter the words "of the Airport" the words "by virtue of the height of structures, lighting and

electro-magnetic fields" be deleted;

(c ) P olicy G9 - Designing Out Crime subject to the following amendment - a f ter t he w ords "property will not" the word "normally" be deleted;

(d) Policy BE11 - Shoreline Zone, subject to the following amendment -

at t he end o f t he Policy after the words favourably considered' the following paragraph be

inserted -

P ropos al s f or t he construction of a land reclamation scheme adjacent to St. Aubin's harbour, including public car parking, to restore St. Aubin's village its unique character, as approved by the States on 23rd July 1996, will be favourably considered';

 (e ) P olicy H1 - Provision of Homes subject to the following amendments -

af ter the words "opportunities to meet" the words "as far as possible" be deleted and after the

words "years to 2006." at the end of the paragraph a new paragraph be inserted as follows -

" D ev elopers of sites designated in the Plan specifically for the construction of Category A

housing in Policy H2, will be required by the Planning and Environment Committee to provide first-time

buyer homes and social rented homes in the respective proportions of 55% and 45% of the total number of dwellings provided on each site, in order to ensure that the identified needs for housing are met.";

(f ) the zoning of land for Category A housing listed in Policy H2 of the Plan, to be developed in

accordance with development briefs to be prepared under Policy H6 of the Plan;

(g ) P olicy H3 of the Plan listing the sites for further consideration for Category A Housing subject to

the addition of the following sites -

1 2. F i el d 633, La Verte Rue, St. Peter (approximately 1 vergée);

1 3. F i el d 1341A, Le Mont de la Trinité, St. Helier (approximately 11 vergées);

1 4. L an d t o the east of Field 729 (vacant plot), Le Fonds de Longueville, Grouville ;

15 . F ie ld 423, Le Mont de la Mare Ste. Catherine, St. Martin, (known as La Chasse')

(approximately 3½ vergées);

1 6. F i el d s 1551 and 1552 Westmount Road, St. Helier measuring 7 vergées 32 perch. (h ) P olicy H5 - Meeting Housing Need subject to the following amendment -

af ter the words "agreement with landowners" there be deleted "and" and the words "/planning

obligations and/or" be inserted;

(i ) the zoning for development and the safeguarding of sites listed Nos. 1-14 in Policy H4 for future

Category A housing;

  1. Policy TT3 Island Route Networks subject to the following amendment -

i n the S ec tion Pedestrian Routes' after the words development of the' the word rural' be

deleted;

  1. Policy TT5 - Primary Route Traffic Studies, subject to the addition of the following sub-section -

4. N ew road construction to facilitate the flow of traffic and improve access at Mount Bingham.';

(l ) the Island Proposals Map, 1/02, to take the place of Island Map, as amended 1/87, approved by

the States on 3rd November 1987 except that there should be included on the said Map the land reclamation scheme adjacent to St. Aubin's harbour, including public parking, as agreed by the States on 23rd July 1996 and except that Field 126, St. Clement, should be zoned in the Countryside Zone and not in the Built Up Area as shown on the said map;

(m ) the Town Proposals Map, 2/02 except that the road improvement line in Burrard Street (south

side) between Halkett Place and Cattle Street should be deleted to take the place of Town Map, as amended 2/87, approved by the States on 10th November 1987;

(n) all other individual policies included within Sections 4 to 14 of the Plan, as listed in the Summary of Policies.

Change in Presidency

The Bailiff assumed the Presidency in place of the Greffier of the States during the morning's consideration of the Island Plan.

Arrangement of public business for the next meeting on 16th July 2002

THE STATES confirmed that if necessary they would meet on 17th July 2002 in order to conclude consideration of public business set down for 16th July 2002.
