THE STATES resumed consideration of a proposition of the Deputy of Grouville concerning the exemption or zero-rating for foodstuffs and domestic energy from Goods and Services Tax and rejected paragraph (a)(i) of the proposition that the States –
(a ) re f er to their Act dated 13th May 2005 in which they approved the introduction of a broad-based
Goods and Services Tax (GST) at a rate of 3% fixed for 3 years and to their Act dated 18th April 2007 in which they approved the Draft Goods and Services Tax (Jersey) Law 200-, and agree to vary those decisions in order to exempt or zero rate the following items –

THE STATES, in accordance with the provisions of Article 16(2) of the States of Jersey Law 2005, noted that, as the votes were equally divided, the matter was determined in the negative.
THE STATES rejected paragraph (a)(ii) of the proposition to refer to their Act dated 13th May 2005 in which they approved the introduction of a broad-based Goods and Services Tax (GST) at a rate of 3% fixed for 3 years and to their Act dated 18th April 2007 in which they approved the Draft Goods and Services Tax (Jersey) Law 200-, and to agree to vary those decisions in order to exempt or zero rate the following item –

THE STATES rejected a proposition of Deputy Shona Pitman of St. Helier requesting them to –
(a ) re f er to their Act dated 13th May 2005 in which they approved the introduction of a broad-based
Goods and Services Tax (GST) at a rate of 3% fixed for 3 years and to their Act dated 18th April 2007 in which they approved the Draft Goods and Services Tax (Jersey) Law 200-, and to vary those decisions in order to exempt from GST all fruit, vegetables and milk (but not related dairy products), in support of wider government initiatives encouraging a healthy lifestyle and diet; and
( b ) r e quest the Minister for Treasury and Resources to bring forward for approval the necessary
legislation to give effect to the decision.

THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, commenced consideration of Regulation 1 to 3 and adopted the following amendments to the Regulations –

For paragraph (c), the following paragraph should be substituted–

- a ftersub-paragraph (a)(iv) thereshallbe inserted the following clause –

service that falls within Article 2(3) and (4) of the Financial Services (Jersey) Law 1998 by a person registered under that Law to carry on trust company business;';
- a ftersub-paragraph (c) there shall beinsertedthefollowing sub-paragraphs –
(ca) excluding special purpose investment business carried on in accordance with the
exemption set out in the Financial Services (Investment Business (Special Purpose Investment Business – Exemption)) (Jersey) Order 2001 by a person who –
- is acting as a functionary within the meaning of that Order, and
- is provided with any service that falls within Article 2(3) and(4)of the Financial Services (Jersey)Law1998by a person registered under that Lawto carry on trust company business or is provided with any service within fund services business (within the meaningof that Law)by a personwho is registered under that Law to carry on fund services business;
(cb) excluding restricted investment business carried on in accordance with the exemption
set out in the Financial Services (Investment Business (Restricted Investment Business – Exemption)) (Jersey) Order 2001 by a person who –
- is acting as a functionary within the meaning of that Order, and
- is provided with any service that falls within Article 2(3) and(4)of the Financial Services (Jersey)Law1998by a person registered under that Lawto carry on trust company business or is provided with any service within fund services business (within the meaningof that Law)by a personwho is registered under that Law to carry on fund services business;';
(iv) for sub-paragraph (f) there shall be substituted the following sub-paragraph –
(f) excluding trust company business carried on by a person specified in any of the
paragraphs of the Schedule to the Financial Services (Trust Company Business (Exemptions No. 3)) (Jersey) Order 2001 specified below where that business is carried on in the circumstances described in that paragraph –
- p aragraph 1 (private protector company),
- p aragraph 2 (general partner),
- p aragraph 4 (investment company subsidiary);';
(v) a fter sub-paragraph (g) there shall be inserted the following sub-paragraphs –
;
- e xcluding trustcompanybusinesscarriedoninaccordance with theexemption set out in the FinancialServices(TrustCompanyBusiness(ExemptionsNo. 5))(Jersey)Order 2001 by a personwho –
- is specified in the Scheduleto that Order, and
- is provided with any service that falls within Article 2(3) and(4)of the Financial Services (Jersey)Law1998by a person registered under that Lawto carry on trust companybusiness;
- e xcluding money service business specified in Article 3 of the Financial Services (Money Service Business) (Exemptions) (Jersey)Order2007.'.".

After paragraph (d), the following paragraphs should be inserted–
"(e) in paragraph 7, for the wordsThe business of providing any of the following services to third
parties not otherwise included in this Schedule – ' there shall be substituted the words (1) The business of providing any of the following services to third parties, where the business is not otherwise included in this Schedule –';
(f) at the end of paragraph 7 there shall be added the following sub-paragraphs –
(2) A reference in this paragraph to providing services to third parties shall not include a
company's providing a service to a connected company.
- F or the purposes of this paragraph, a companyisconnected with another company if –
- t hecompaniesareinthesamegroup;
- o ne is entitled, eitheraloneor with any othercompany in the samegroup, to exercise or control the exercise of a majority of the voting rights (other than as nominee shareholder) which are attributable to the share capital and are exercisable in all circumstances at any general meeting of the other companyor of its holdingcompany;or
- t hefirst-mentionedcompanyholds,or a companyin the samegroup as thefirst- mentionedcompanyholds,aninterest in the equity share capital of the other company carrying rights to vote in all circumstances at general meetingsforthe purpose of securing a contribution to the activities of the first-mentioned company or the company in the samegroupas that company respectively by the exercise of control or influence arising from that interest.
- I n this paragraph, group' and holding company' have thesamemeaningsas in the Financial Services (Jersey)Law1998.'.".
