THE STATES resumed consideration of a proposition of the Deputy of Grouville concerning the exemption or zero rating of food from GST and rejected paragraph (a)(i) of the proposition to refer to their Act dated 13th May 2005 in which they approved the introduction of a broad-based Goods and Services Tax (GST) at a rate of 3% fixed for 3 years, and to their Act dated 18th April 2007 in which they approved the Draft Goods and Services Tax (Jersey) Law 200-, and to agree to vary those decisions in order to exempt or zero-rate foodstuffs in line with United Kingdom Value Added Tax arrangements as set out in the Appendix;

THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, adopted Articles 1 to 4.
THE STATES commenced consideration of Article 5 and, adopting an amendment of Deputy Geoffrey Peter Southern of St. Helier agreed that in Article 5, in the inserted Article 60F –
(a) for paragraph (1) there should be substituted the following paragraph –
"(1) Where an employer is proposing to dismiss as redundant at one establishment within a
period of 90 days or less –
- 2 or more employees of a description in respect of which a trade union is registered under the Employment Relations (Jersey) Law 2007 and recognized in accordance with a code of practice approved under Article 25 of that Law; or
- 6 or more employees of a description in respect of which there is no trade union as described in sub-paragraph (a),
the employer shall consult about the dismissals all the persons who are the appropriate representatives of the affected employees;"
(b) for paragraph (3)(a) there should be substituted the following sub-paragraph –
"(a) if the employees fall within the description in paragraph (1)(a), representatives
of the trade union; or".
And in Article 5, in the inserted Article 60N(1) for the number "21" there should be substituted the number "6".
