THE STATES rejected a proposition of Deputy Trevor Mark Pitman of St. Helier , that the current restrictions on releasing the names of young offenders from the age of 12 who were convicted of a serious assault, murder, manslaughter, rape or robbery should be amended to permit the naming by the media and others of such offenders provided that the courts should retain a discretion to order that the offender should not be named if

  1. an individual had been identified as having learning difficulties impacting upon their actions; or
  2. the Court was satisfied that there would be a serious risk of physical or mental harm to the individual if he or she was named or satisfied that there were other wholly exceptional circumstances that were sufficient tojustify overturning the normal presumption in favour of naming;

and  that  the  Minister  for  Home  Affairs  be  requested  to  bring  forward  for  approval the necessary legislation to give effect to the decision.

Arrangement of Business for the present meeting

THE STATES, adopting a proposition of Deputy Judith Ann Martin of St. Helier , agreed that the present meeting would be extended until 6.30 p.m. in order to consider all of the outstanding items of public business on the Order Paper.

THE STATES rejected a proposition of the Deputy of St. Mary that P.195/2009 (Jersey New Waterworks Company Limited: report of Jersey Competition Regulatory Authority on outsourcing') should be considered earlier in the meeting.

Changes in Presidency

Mr. Michael Nelson de la Haye, Greffier of the States, retired from the Chamber during consideration of the proposition of Deputy Trevor Mark Pitman concerning the naming of Young Offenders by the media (P.148/2009) and the meeting continued under the Presidency of the Deputy Bailiff .

Planning and Building Bye-laws: provision of disabled toilets/changing rooms P.168/2009 (re-issued)

THE STATES commenced consideration of a proposition of Deputy Andrew Kenneth Francis Green of St. Helier and adopting an amendment of the Minister for Planning and Environment, agreed that the word "commercial" should be deleted and for the words "or new" there should be substituted the words "with a ground floor of at least 700 square metres and all new".

THE STATES, adopting the proposition of Deputy Andrew Kenneth Francis Green of St. Helier , as amended, agreed to request the Minister for Planning and Environment to amend the Building Bye-laws and Planning policies as appropriate to prepare: planning guidance and regulations to ensure all new large or significant renovation projects of public buildings with a ground floor of at least 700 square metres and all new public toilets include a "Changing Places" disabled toilet facility.

H1N1 Influenza Pandemic Funding: expenditure approval P.174/2009

THE STATES commenced consideration of a proposition of the Minister for Treasury and Resources and adopting an amendment of the Minister for Treasury and Resources to paragraph (a), agreed that for the amount "£1,347,000", there should be substituted "£1,725,000" and for the amount "£4,200,000", there should be substituted "£3,822,000".

THE STATES, adopting an amendment of the Public Accounts Committee, agreed that after paragraph (b), there should be inserted the following new paragraph –

"(c) to request the Minister for Treasury and Resources to forward a detailed and

comprehensive breakdown to the Public Accounts Committee (PAC) as soon as practicable detailing exactly how the funds were spent in order to confirm that funds were used only for pandemic-specific costs, and to provide written confirmation to the PAC that the States Treasurer will monitor and verify all spending;

THE STATES, in accordance with Articles 16(3) and 11(8) of the Public Finances (Jersey) Law 2005, agreed to amend the expenditure approval for 2009 approved by the States on 23rd September 2008 in respect of the Treasury and Resources Department –

  1. to permit the withdrawal of up to an additional £1,725,000, from the consolidated fund in accordance with Article 16(3), to be reallocated for the net revenue expenditure of a number of departments in order to fund costs associated with preparation and containment of a H1N1 influenza pandemic and that the funding should only be made available to departments from the allocation to the Treasury and Resources Department by public Ministerial Decision of the Minister for Treasury and Resources based on evidence of the need to incur these additional costs in order to prepare for, and contain H1N1 influenza;
  2. to permit the withdrawal of up to an additional £3,822,000 from the consolidated fund in accordance with Article 11(8), to be reallocated for the net revenue expenditure of a number of departments in order to fund costs associated with managing the consequences of a wave of illness caused by H1N1 influenza and that the funding should only be made available to departments from the allocation to the Treasury and Resources Department by public Ministerial Decision of the Minister for Treasury and Resources based on evidence of the need to incur these costs to manage the consequences of an H1N1 pandemic influenza.
