Draft Annual Business Plan 2010 P.117/2009

THE STATES, having resumed consideration of the Draft Annual Business Plan 2010 (P.117/2009), commenced consideration of paragraph (f) to approve indicative total net revenue expenditure for the States funded bodies, as set out in Part Three of the report Summary Table C, page 96, for the period 2011 to 2014 and the proposed programme of capital projects for the States funded bodies for 2011 to 2014 as set out in Part Three of the report Summary Tables F to I, pages 99–102; and to request the Chief Minister to present Annual Business Plans to the States within these indicative total amounts, with any additional growth in the total net revenue expenditure of a States funded body being offset by compensatory savings elsewhere within the total amounts.

THE STATES, adopting an amendment of Senator Ben Edward Shenton, agreed that in paragraph (f) of the Draft Annual Business Plan 2010, after the words "Summary Table C, page 96, for the period 2011 to 2014", there should be inserted the words –

"except  that  total  indicative  net  revenue  expenditure  of  the  Health  and  Social  Services Department shall be increased by £487,000 in 2011 and by £499,000 in 2012 and by a similar sum (increased in accordance with the appropriate non-staff inflation figure) for 2013 and 2014 to provide funding for adult respite care".

THE STATES, adopting a proposition of the Chief Minister, agreed, in accordance with the provisions of paragraph (4) of Article 11(5) of the Public Finances (Jersey) Law 2005, to reduce the minimum lodging period in respect of his amendment to paragraph (f) of the Draft Annual Business Plan 2010.

THE STATES, adopting an amendment of the Chief Minister, agreed that in paragraph (f) of the Draft Annual Business Plan 2010, after the words "Summary Table C, page 96, for the period 2011 to 2014", there should be inserted the words –

"except  that  total  indicative  net  revenue  expenditure  of  the  Health  and  Social  Services Department shall be increased by £1,127,500 in 2011 and by £1,155,700 in 2012 and by a similar sum (increased in accordance with the appropriate non-staff inflation figure) for 2013 and 2014.".

Following the withdrawal of paragraph (6) of the amendment of the Deputy of St. Mary to paragraph (b) of the Draft Annual Business Plan 2010, the Bailiff informed the Assembly that paragraph (8) of the amendment was also deemed to have been withdrawn.

THE STATES rejected an amendment of the Deputy of St. Mary that in that in paragraph (f) of the Draft Annual Business Plan 2010, after the words "Summary Table C, page 96, for the period 2011 to 2014" there should be inserted the words –

"except that a sum of £400,000 (increased in accordance with the appropriate non-staff inflation figure) shall be allocated in each of the years 2011 – 2014 to the proposed programme of capital projects for the funding of the rolling Urban Renewal Fund".

The Bailiff retired from the Chamber during consideration of the amendment of the Deputy of St. Mary to paragraph (f) of the Draft Annual Business Plan 2010, and the meeting continued under the presidency of Mrs. Anne Helen Harris , Deputy Greffier of the States.

THE STATES commenced consideration of paragraph (g) of the Draft Annual Business Plan 2010 to approve the sale of the properties as detailed in the schedule for disposal in Part Three of the report Summary Table J, pages 103 to 104 of the report, which had been recommended by Jersey Property Holdings to the Minister for Treasury and Resources and accepted by the Minister for disposal in 2010 and thereafter.

THE STATES rejected an amendment of Senator Alan Breckon that in paragraph (g) of the Draft Annual Business Plan 2010, after the words "accepted by the Minister for disposal in 2010 and thereafter", there should be inserted the words –

", except that for the under-mentioned sites, a condition of sale should be included that developers will be required to provide social rented, first-time buyer homes and/or lifetime homes at no cost to the public purse in return for a reduced price for the sites –

  2. Pine Ridge, West Hill, St. Helier ;

THE STATES, adopting an amendment of the Minister for Education, Sport and Culture, agreed that in paragraph (g) of the Draft Annual Business Plan 2010, after the words "accepted by the Minister for disposal in 2010 and thereafter", there should be inserted the words –

"except that the property "D'Hautrée Site, St. Saviour 's Hill, St. Saviour " shall be removed from the schedule of disposal set out in the said Table J".

THE STATES, having noted that an area of land in the schedule of disposal set out in Table J had been incorrectly named as 108/109 Clos des Sables, agreed, in accordance with Standing Order 26(8), to adopt an amendment of the Chief Minister that the schedule be altered to 107/108 Clos des Sables.

THE STATES, rejected an amendment of Deputy Montfort Tadier of St. Brelade that in paragraph (g) of the Draft Annual Business Plan 2010, after the words "accepted by the Minister for disposal in 2010 and thereafter", there should be inserted the words –

"except that the property Land adjoining 107/108 Clos des Sables, St. Brelade ' shall be removed from the schedule of disposal set out in the said Table J".

THE STATES commenced consideration of paragraph (h) of the Draft Annual Business Plan 2010 to approve the Legislation Programme for 2010, as set out in Part Three of the report Summary Table K, pages 105 to 108 of the report.

THE STATES, adopting an amendment of Senator Alan Breckon, agreed that in paragraph (h) of the Draft Annual Business Plan 2010, after the words "pages 105 to 108 of the report" there should be inserted the words –

"except that for the following item described in Section 1.1.2 Economic Development Department – a new Plant Varieties (Jersey) Law 200-, to protect rights in newly developed plant varieties' there should be substituted the following item – a new Financial Services Ombudsman Law'."

Changes in Presidency

The Bailiff briefly retired from the Chamber during consideration of the amendment of Senator Alan Breckon to paragraph (h) of the Draft Annual Business Plan 2010 and the meeting continued under the presidency of Mrs. Anne Helen Harris , Deputy Greffier of the States, until his return.

Arrangement of Business for future meetings

THE STATES, adopting a proposition of Senator Philip Francis Cyril Ozouf , agreed that P.135/2009 (Millennium Town Park: funding from the Stabilisation Fund' lodged au Greffe' on 24th August 2009 by Deputy Geoffrey Peter Southern of St. Helier ) should be considered as the first item of public business at the next meeting scheduled to commence on Tuesday 6th October 2009.

Connétable John Martin Réfault of St. Peter , in accordance with Standing Order 16(3), made a personal statement regarding the recent furze fire at Val de la Mare reservoir, St. Peter .
