Following the lunchtime adjournment the Presiding Officer, in accordance with Standing Order 56(2), directed that elected members be summoned as the Assembly was inquorate. In accordance with Standing Order 56(2), having allowed such time as he considered reasonable for elected members to return to the Chamber, the Presiding Officer asked the Assistant Greffier to call the roll, as he believed that the States remained inquorate. The States re-assembled after the lunch adjournment under the Presidency of Mr. Michael Nelson De La Haye, Greffier of the States, but he retired from the Chair during consideration of the proposition of Deputy Trevor Mark Pitman of St. Helier concerning the use of Blackberries in the Chamber (P.186/2010 lodged "au Greffe" on 29th October 2009) and the meeting continued under the Presidency of the Bailiff .

Fort Regent: establishment of a working group (P.188/2009) P.188/2009

THE STATES commenced consideration of a proposition of the Education and Home Affairs Scrutiny Panel concerning the establishment of a working group and, adopting an amendment of the Minister for Education, Sport and Culture, agreed that in paragraph (a) for the words "working group" there should be substituted the words "political steering group"; the words "Jersey Heritage Trust," should be deleted; and for the words "and the Planning and Environment Department, in order to ensure collaboration between these key parties," there should be substituted the words ", the Planning and Environment Department and the Parish of St. Helier , who will consult with other interested parties including the Jersey Heritage Trust and the Fort Users Association"; and that in paragraph (b) for the words "working group" there should be substituted the words "political steering group".

THE STATES, adopting the proposition of the Education and Home Affairs Scrutiny Panel, as amended, agreed to request the Minister for Education, Sport and Culture –

  1. to establish and lead a political steering group, consisting of representatives from the Education, Sport and Culture Department, Jersey Property Holdings, the Economic Development Department, the Planning and Environment Department, the Parish of St. Helier and at least one States Deputy of St. Helier No. 1 District, who would consult with other interested parties including the Jersey Heritage Trust and the Fort Users Association, with the aim of producing a cohesive and realistic plan for the future development of Fort Regent; and
  2. to take the necessary steps to form the political steering group immediately and to provide quarterly updates to all States members of its progress regarding the formulation of a development plan for Fort Regent.

Draft Supply of Goods and Services (Jersey) Regulations 200- P.190/2009

THE STATES commenced consideration of the Draft Supply of Goods and Services (Jersey) Regulations 200- and adopted the principles.

THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, adopted Regulations 1 to 10.

THE STATES, in pursuance of in pursuance of Article 94 of the Supply of Goods and Services (Jersey) Law 2009, made Regulations entitled Supply of Goods and Services (Jersey) Law 2010.

User Pays' Charges: Immigration fees P.193/2009

THE STATES, adopting a proposition of the Minister for Home Affairs, agreed to refer to their Act dated 24th June 2003 in which they agreed that no new User Pays' charges should be introduced without the prior  approval  of  the  States;  and  that  a  new  User  Pays'  charge  should  be  introduced  as  soon  as practicable to be levied by the States of Jersey Customs and Immigration Service for providing services to overseas nationals who were subject to Immigration control in respect of the grant of leave to remain in the Bailiwick of Jersey, or the variation of that leave after the entry of such persons.

States of Jersey Law: Quorum in the States P.194/2009

THE STATES commenced consideration of a proposition of Deputy Trevor Mark Pitman of St. Helier concerning increasing the quorum for the Assembly and, adopting a proposition of Deputy Judith Ann Martin  of   St. Helier ,  agreed  that  the  meeting  should  continue  until  6.00 p.m.  in  order  to  conclude consideration of this matter.

THE STATES rejected a proposition of Deputy Trevor Mark Pitman of St. Helier to increase the number of Members present necessary for the States to be quorate under Article 15 of the States of Jersey Law 2005 from 27 to 35 and to request the Privileges and Procedures Committee to bring forward the necessary amendment to the above Law.
