Income Tax: introduction of higher rate P.23/2011

THE STATES resumed consideration of a proposition of Deputy Geoffrey Peter Southern of St. Helier concerning  the  introduction  of  a  higher  rate  of  income  tax  and  rejected  paragraph (a)(i)  of  the proposition to support the principle of progressive taxation through the introduction of higher rates of personal income tax for those individuals with higher incomes and, in order to achieve this objective, to request the Minister for Treasury and Resources to bring forward for approval the necessary legislation as part of the Budget 2012 proposals –

(i)  to ensure that personal income tax assessments apply to individual earnings so that married couples were not discriminated against in the application of higher rates;

Committee of Inquiry: States owned or controlled utilities P.31/2011

THE STATES rejected a proposition of Senator Alan Breckon to agree –

  1. that a Committee of Inquiry should be established in accordance with Standing Order 146 to inquire into a definite matter of public importance, namely the nature of the relationship between the States of Jersey and the 4 utility companies that were owned or controlled by the States and the governance arrangements in place for the 4 companies, namely –
  1. Jersey Post,
  2. Jersey Telecom,
  3. Jersey Electricity Company,
  4. Jersey Water;
  1. and that the terms of reference of the Committee of Inquiry should be to investigate –
  1. the nature of the relationship between the Minister for Treasury and Resources as representative of the shareholder and Jersey Post, Jersey Telecom, the Jersey Electricity Company and Jersey Water ("the 4 utility companies");
  2. the nature of the relationship between the Minister for Economic Development and the 4 utility companies and the interaction between the respective roles of the Minister and the Jersey Competition Regulatory Authority (JCRA) in relation to the companies;
  3. the reporting, accounting and governance structure of the 4 utility companies;
  4. the trading practices and relationships of the 4 utility companies with each other and their subsidiaries;
  5. the levels of remuneration, benefits, bonuses, consultancy fees or severance and pension payments that have been paid to, or agreed with –
  1. senior executives and staff of the 4 utility companies,
  2. Board members of the companies;
  1. whether any overlap of responsibilities or any personal relationships existed between Directors, Officers and advisers of the 4 utility companies and their subsidiaries or Companies in which any of the 4 companies have invested, or with the Board Members and Officers of the JCRA, and, if so, to determine and report upon the nature of these relationships and whether any of them may have caused a conflict of interest or improperly influenced or prejudiced any investment, management or investigatory decisions;
  2. the regulation of the 4 utility companies undertaken by the Jersey Competition Regulatory Authority with particular reference to the cost and effectiveness of the regulation, the appropriateness of the charges on the 4 companies and the measurable evidence of any consumer benefit;
  1. to request the Chief Minister to take the necessary steps to select a suitable Chairman and members to undertake the Inquiry and to bring forward to the States for approval the necessary proposition relating to their appointment.

States Members' training P.34/2011

THE STATES commenced consideration of a proposition of Deputy Montfort Tadier of St. Brelade requesting the Privileges and Procedures Committee to establish a training programme which would be available to all States Members, with at least one session per year, to provide ongoing skills training in relation to delivering speeches, general debating skill and any other areas that the Committee deemed might be of benefit to local parliamentarians, that were not already covered elsewhere.

THE STATES acceded to a request of Deputy Montfort Tadier of St. Brelade that the proposition be withdrawn.

Public Elections: extension of pre-poll voting arrangements P.42/2011

THE STATES, adopting a proposition of Deputy Jeremy Martin Maçon of St. Saviour , agreed to refer to their Act dated 17th March 2011 in which they approved amendments to the Public Elections (Jersey) Law 2002, and –

  1. agreed that the new arrangements that would permit the Judicial Greffier to take such measures as he or she considered appropriate for taking pre-poll votes from electors who were ill, disabled or illiterate should be extended to allow the Judicial Greffier to take similar measures in relation to any spouse or carer of such persons provided that the spouse or carer was at the same premises as the elector who was ill, disabled or illiterate and that the voting arrangements could be undertaken at the same time; and
  2. requested the Privileges and Procedures Committee to take the necessary steps to bring forward for approval an amendment to the Public Elections (Jersey) Law 2002 to give effect to the decision.

Royal Wedding – message

The Bailiff , having noted that this was the last meeting of the Assembly before the occasion of the Royal Wedding on 29th April 2011, advised members that a message was to be sent to H.R.H. Prince William and Miss Catherine Middleton in the following terms –

"The Lieutenant Governor, Bailiff , States and people of Jersey join together to send their warmest congratulations and good wishes to Your Royal Highness and Miss Catherine Middleton on the occasion of your marriage on 29th April 2011. The people of Jersey rejoice and celebrate on this very special occasion and take this opportunity to offer their most loyal affection. They pray that you will enjoy together long years of good health and happiness and that the Island may one day be honoured by a visit from you both."
