Economic Affairs Scrutiny Panel – appointment of member

In  accordance  with  Standing  Order  125(7)  the  Chairman  of  the  Economic  Affairs  Scrutiny  Panel indicated that he wished to increase the membership of his Panel to 4 members, including the Chairman, and nominated the Connétable of Grouville as an additional member of the Panel.

There being no other nominations, the Bailiff declared that the Connétable of Grouville had been duly appointed as a member of the Economic Affairs Scrutiny Panel.

THE  STATES  commenced  consideration  of  the  Draft  Public  Employees  (Contributory  Retirement Scheme) (Commutation of Small Pensions – Amendments) (Jersey) Regulations 201- and adopted the principles.

THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, adopted Regulations 1 to 11.

THE STATES, in pursuance of Article 2 of the Public Employees (Retirement) (Jersey) Law 1967, made Regulations entitled the Draft Public Employees (Contributory Retirement Scheme) (Commutation of Small Pensions – Amendments) (Jersey) Regulations 2013.

Cold Weather Bonus: variation of conditions P.115/2013

THE STATES commenced consideration of a proposition of Deputy Geoffrey Peter Southern of St. Helier regarding the variation of conditions for the payment of the Cold Weather Bonus and adopted an amendment of the Minister for Social Security that in paragraph (a) the word "currently" should be deleted after the words "2012 that" and the word instead inserted before the words "contained in" and after the words "Jersey Old Age Pension" there should be inserted the words "in the case of an individual who has been resident in Jersey for the previous 10 years"; and in paragraph (b) for the words "to bring forward for approval the necessary amendment to give effect to the proposal" there should be substituted the words ", when bringing forward for approval legislation to replace the Cold Weather Bonus (Jersey) Regulations 2012, to include this revised condition".

THE STATES, having resumed consideration of the proposition of Deputy Geoffrey Peter Southern of St. Helier , as amended, adopted the proposition and agreed that the condition currently contained in Regulation 3(4) of the Cold Weather Bonus (Jersey) Regulations 2012 that provided that, to receive a bonus, a person must be aged 65 years or over and also receiving a Jersey Old Age Pension should be amended by deleting the requirement to be in receipt of a Jersey Old Age Pension in the case of an individual who had been resident in Jersey for the previous 10 years and requested the Minister for Social Security, when bringing forward for approval legislation to replace the Cold Weather Bonus (Jersey) Regulations 2012, to include this revised condition.

Jersey Financial Services Commission: re-appointment of Commissioner P.112/2013

THE  STATES  commenced  consideration  of  a  proposition  of  the  Chief  Minister  regarding  the re-appointment of a Commissioner of the Jersey Financial Services Commission.

THE STATES noted that, in accordance with Article 3 of the Financial Services Commission (Jersey) Law 1998, the discussion of this matter had to take place in camera. The Bailiff , in accordance with the provisions of Standing Order 82, ordered all strangers to withdraw from the precincts of the States and the doors of the Chamber to be closed.

THE STATES, having concluded the debate in camera, proceeded to vote in public assembly and, in pursuance of Article 3 of the Financial Services Commission (Jersey) Law 1998, appointed Advocate Deborah Jane Prosser, née Nance, as a Commissioner of the Jersey Financial Services Commission with effect from 30th November 2013 for a further period of 5 years.

THE STATES, adopting a proposition of Senator Sir Philip Bailhache , Assistant Chief Minister, agreed that, in accordance with Standing Order 26(7), the minimum lodging period should be reduced in respect of the proposition of the Chief Minister which had been lodged au Greffe' earlier that day entitled Draft  Taxation  (Exchange  of  Information  with  Third  Countries)  (Amendment  No. 7)  (Jersey) Regulations 201-' (P.132/2013), to enable it to be considered by the Assembly on 5th November 2013, as it related to a matter of such urgency and importance that it would be prejudicial to Jersey to delay its debate.
