THE STATES resumed consideration of Article 3 of the Draft States of Jersey (Amendment No. 8) Law 201- (P.33/2014) and rejected paragraph (1) of an amendment of the Connétable of St. Mary to Article 3 that it should be substituted with the following Article –

"3  Article 19 amended

In Article 19 –

(a)  for paragraphs (3) to (5) there shall be substituted the following paragraphs –

(3)  The  Chief  Minister  designate  shall  decide  and,  in  accordance  with  the

prescribed procedures and within the prescribed periods, announce his or her decision as to

  1. the elected members to be appointed as Ministers; and
  2. the Ministerial office to which each of them isto be assigned.

Before making a decision and announcement under paragraph (3), the Chief Minister  designate  may, in accordance with the prescribed procedures and within  the  prescribed  periods,  propose  the  establishment  or  abolition  of Ministerial offices.

A proposal under paragraph (4) –

  1. must describe the functions of any new Ministerial office; and
  2. must  indicate  the  Minister  to whom  the  functions  of  any  abolished Ministerial office would be transferred.

(5A)  The  States  may  not  amend  a  Chief  Minister  designate's  proposal  under

paragraph (4).';

(b)  for paragraph (7) there shall be substituted the following paragraph –

(7)  The  Chief  Minister  designate  and  the  persons  decided  by  him  or  her  for

appointment as Ministers are appointed to office upon the conclusion of his or her announcement of his or her decision under paragraph (3).'."

Following the rejection of paragraph (1), the Bailiff informed the Assembly that paragraphs (2) and (3) of the amendment of the Connétable of St. Mary were deemed to have been withdrawn.

THE STATES, adopting paragraph (2) of an amendment of Deputy John Alexander Nicholas Le Fondré of St. Lawrence to Article 3, agreed that in paragraph (a), in the substituted Article 19(5B) for the words "3 successive proposals" there should be substituted the words "the prescribed number of successive proposals".

THE STATES commenced consideration of paragraph (3) of an amendment of Deputy John Alexander Nicholas Le Fondré of St. Lawrence to Article 3 and rejected his amendment to that amendment that –

  1. In paragraph (1)(a), in the substituted words in the substituted Article 19(5B), for the words beginning "the Chief Minister designate shall," to the end of the substituted words there should be substituted the following words –

"the Chief Minister designate –

  1. shall, in accordance with the prescribed procedures and within the prescribed period, propose Ministerial offices and any changes in the functions assigned to Ministers; and
  1. after the States have decided to approve or reject his or her proposal under sub- paragraph (a), with or without amendments, shall, in accordance with the prescribed procedures and within the prescribed period –
  1. nominate one or more elected members for appointment as Ministers, and
  2. when making such a nomination, propose the Ministerial office to which the nominee would be assigned.".
  1. In paragraph (1)(b) for the substituted paragraph (5C) there should be substituted the following paragraphs and the remaining paragraphs and internal cross-references renumbered accordingly –

"(5C) A proposal under paragraph (5B)(a) –

  1. must –
  1. describe the functions of any new Ministerial office or the changes in the functions of an existing Ministerial office, and
  2. indicate the Minister to whom the functions of any abolished Ministerial office are to be transferred; and
  1. may be amended by the States.

(5D) A proposal under paragraph (5B)(a) or nominations under paragraph (5B)(b) by the

Chief Minister designate may be the same as one of his or her proposals under paragraph (3) that the States have rejected.".

THE STATES, having resumed consideration of paragraph (3) of an amendment of Deputy John Alexander Nicholas Le Fondré of St. Lawrence to Article 3, rejected the amendment that –

  1. In paragraph (a) –

(a)  in the substituted Article 19(5B) for the words "under paragraph (3)," to the end of the paragraph there should be substituted the words –

"under paragraph (3) the Chief Minister designate shall, in accordance with the prescribed procedures and within the prescribed period –

  1. decide the matters described in sub-paragraphs (a) and (c) of paragraph (3) and inform the States of his or her decision; and
  2. nominate one or more elected members for appointment as Ministers, and, when making such a nomination, propose the Ministerial office to which the nominee would be assigned.";

(b)  for the substituted Article 19(5C) there should be substituted the following paragraphs –

"(5C) The  Chief  Minister  designate's  decision  under  paragraph (5B)(a)  as  to  the

matters described in sub-paragraphs (a) and (c) of paragraph (3) may be the same as one of his proposals under paragraph (3) that the States have rejected.

(5D) Following nominations by the Chief Minister designate under

paragraph (5B)(b) –

  1. an elected member may, within the prescribed period and in accordance with the prescribed procedures, nominate one or more elected members for appointment as Ministers and, when making such a nomination, shall propose the Ministerial office to which the nominee would be assigned; and
  2. the States shall then, in accordance with the prescribed procedures, select, for each Ministerial office, from the persons nominated and proposed for assignment to that office, an elected member for appointment as a Minister and assignment to that office.";
  1. In paragraph (b), for the substituted Article 19(7)(b) there should be substituted the following sub-paragraph –

"(b) the States making the last selection under paragraph (5D)(b) required to

complete the constitution of the Council of Ministers,".

International Criminal Court Act 2001: extension to Jersey P.34/2014

THE STATES, adopting a proposition of the Chief Minister, signified, pursuant to Article 31 of the States of Jersey Law 2005, that they agreed that a request be made to the Privy Council for the making of an Order in Council that would extend to Jersey, with appropriate modifications and adaptations, certain provisions of the International Criminal Court Act 2001 as summarised in the report of the Chief Minister dated 11th March 2014.

THE STATES commenced consideration of the Draft International Criminal Court (Jersey) Law 201- and adopted the principles.

THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, adopted Articles 1 to 59 and the Schedules.

THE STATES, subject to the sanction of Her Most Excellent Majesty in Council, adopted a Law entitled the International Criminal Court (Jersey) Law 201-.

THE  STATES  resumed  consideration  of  the  Draft  States of Jersey (Amendment No. 8) Law 201- (P.33/2014) following the lunch-time adjournment and noted that, following the rejection of Article 3, as amended, Articles 6, 11, 13 and 15 would not be proposed by the Chief Minister.

THE STATES adopted Article 5.

THE STATES commenced consideration of Article 7 and rejected paragraph (1) of an amendment of Deputy John Hilary Young of St. Brelade that –

  1. For paragraph (a) there should be substituted the following paragraph –

"(a) for paragraphs (1) and (2) there shall be substituted the following paragraphs –

(1) The Chief Minister may –

  1. appoint  one  or  more elected members as his or her Assistant Ministers;
  2. appoint, in relation to any other Minister, one or more elected members as the Assistant Ministers to that Minister; and
  3. dismiss any Assistant Minister.
  1. The Chief Minister may only appoint or dismiss an Assistant Minister to another Minister with that Minister's prior consent.';".

(2)  After paragraph (b) the following paragraph should be inserted and the remaining paragraph renumbered accordingly –

"(c) in paragraph (4) for the words "the Minister that he or she assists." there shall

be substituted the words "the Chief Minister.".

(2)  Before appointing an Assistant Minister –

  1. the Chief Minister must obtain the States' approval of the appointment;
  2. a  Minister  must  first  obtain  the  Chief  Minister's  consent  to the appointment and then the States' approval of the appointment.

(2A)  Before dismissing an Assistant Minister, a Minister must obtain the Chief

Minister's consent.'.".

THE STATES adopted Article 8.

THE STATES commenced consideration of paragraph (2) of an amendment of Deputy John Hilary Young of St. Brelade that after Article 8 there should be inserted the following Article and the remaining Articles renumbered accordingly –

"9 Article 26A inserted

After Article 26 there shall be inserted the following Article –

26A Regulations: advisory panels

  1. The States shall, by Regulations, provide for the establishment of panels to advise Ministers (advisory panels').
  2. Regulations under paragraph (1) shall, in particular, provide for –
    1. the constitution of advisory panels;
    2. the appointment and dismissal of members of advisory panels;
    3. the functions of advisory panels;
    4. the provision of resources to advisory panels; and
    5. the  duties  of  a  Minister  in relation  to any  material  produced  by an advisory panel in the discharge of its functions.
  3. Regulations under paragraph (1) may also provide for the establishment of advisory panels to advise Assistant Ministers and, in particular, provide for the duties of an Assistant Minister in relation to any material produced by an advisory panel in the discharge of its functions.'.".
