THE STATES, having been informed that the relevant scrutiny panel had already scrutinised the draft legislation, adopted Article 1.

THE STATES commenced consideration of Article 2 and, adopting an amendment of the Minister for Economic Development, agreed that in Article 2 after paragraph (1)(o) there should be inserted the following sub-paragraph and the following sub-paragraphs be renumbered accordingly –

"(p)  for requiring an application for a licence or permit to be accompanied by such information

as  may  be  specified  by  the  person  to  whom  the  application  is  made  relating  to the environmental impact of any activity for which the licence or permit is required, such person, in making any requirement for such information, having regard to the scale of such activity and any similar activities carried on (or proposed to be carried on) by any person;".

THE STATES adopted Article 2, as amended. THE STATES adopted Articles 3 to 21.

THE STATES commenced consideration of Article 22 and, adopting an amendment of the Minister for Economic Development, agreed that in Article 22, for the words "7 days after it is registered" there should be substituted the words "on such day or days as the States may by Act appoint".

Draft Proceeds of Crime and Terrorism (Miscellaneous Provisions) (Jersey) Law 201- P.163/2013

THE STATES commenced consideration of the Draft Proceeds of Crime and Terrorism (Miscellaneous Provisions) (Jersey) Law 201- and adopted the principles.

THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, adopted Articles 1 to 7.

THE STATES commenced consideration of Article 8 and, adopting an amendment of the Chief Minister to Article 8, agreed that in paragraph (2) –

  1. in the substituted Article 19(1)(a), the word "(B')" should be omitted;
  2. in the substituted Article 19(1)(b), for the words "a trade," there should be substituted the words "A's trade,";
  3. for the substituted Article 19(3), there should be substituted the following paragraph –

"(3) Where this Article applies, A must disclose, in accordance with the conditions set out

in paragraph (4) –

  1. the belief or suspicion mentioned in paragraph (1)(a); and
  2. the information on which that belief or suspicion is based,

and if A does not make such a disclosure, A commits an offence."; and

(d)  in the substituted Article 19(4)(c), the word "reasonably" should be omitted;

and in paragraph (3) for sub-paragraphs (a) and (b) there should be substituted –

"(a) for paragraphs (1) to (4) there shall be substituted the following paragraphs –

(1) This Article applies where the conditions in both paragraph (2) and

paragraph (3) are fulfilled.

  1. The first condition is that a person ("A") knows, suspects or has reasonable grounds for suspecting that –
  1. another person has committed an offence under Article 15 or 16; or
  2. any property is or may be terrorist property.
  1. The second condition is that the information or other matter on which A's knowledge or suspicion is based, or which gives reasonable grounds for such suspicion, came to A in the course of business of a financial institution.
  2. Where this Article applies, A must disclose, in accordance with the conditions set out in paragraph (4A) –
  1. the knowledge, suspicion or grounds for suspicion mentioned in paragraph (2); and
  2. the information or other matter mentioned in paragraph (3),

and if A does not make such a disclosure, A commits an offence.

(4A) The conditions mentioned in paragraph (4) are that the disclosure is made –

  1. to a designated police officer, a designated customs officer or a nominated officer;
  2. in good faith; and
  3. as soon as is practicable after the information or other matter comes to A.' "; and

(b)  sub-paragraphs (c) and (d) should be renumbered accordingly as sub-paragraphs (b) and (c).

THE STATES adopted Articles 9 to 30.

THE STATES commenced consideration of Article 31 and, adopting an amendment of the Chief Minister to Article 31, agreed that for the text of Article 31, there should be substituted –

"In Article 34A of the 1999 Law –

(a)  for paragraph (1) of Article 34A of the 1999 Law there shall be substituted the following paragraphs –

(1) This Article applies where –

  1. a person ("A") knows or suspects that another person is engaged in money laundering; and
  1. the information or other matter on which that knowledge or suspicion is based comes to A's attention in the course of A's trade, profession, business or employment.

(1A) Where this Article applies, A must disclose, in accordance with the conditions

set out in paragraph (1B) –

  1. the knowledge or suspicion mentioned in paragraph (1)(a); and
  2. the information or other matter mentioned in paragraph (1)(b),

and if A does not make such a disclosure, A commits an offence.

(1B) The conditions mentioned in paragraph (1A) are that the disclosure is made –

  1. to a police officer;
  2. in good faith; and
  3. as soon as is practicable after the information or other matter came to A's attention.';

(b)  in paragraph (3), after the words Where a person discloses to a police officer" there shall be inserted the words in good faith'.".

THE STATES adopted Article 31, as amended.

THE STATES commenced consideration of Article 32 and, adopting an amendment of the Chief Minister to Article 32, agreed that for the text of Article 32, there should be substituted –

"In Article 34D of the 1999 Law –

(a)  for paragraphs (1) to (4) there shall be substituted the following paragraphs –

(1) This Article applies where the conditions in both paragraph (2) and

paragraph (3) are fulfilled.

  1. The first condition is that a person ("A") knows, suspects or has reasonable grounds for suspecting that –
  1. another person is engaged in money laundering; or
  2. any property constitutes or represents proceeds of criminal conduct.
  1. The second condition is that the information or other matter on which A's knowledge or suspicion is based, or which gives reasonable grounds for such suspicion, came to A in the course of the carrying on of a financial services business.
  2. Where this Article applies, A must disclose, in accordance with the conditions set out in paragraph (4A) –
  1. the  knowledge,  suspicion  or  grounds  for  suspicion  mentioned  in paragraph (2); and
  2. the information or other matter mentioned in paragraph (3),

and if A does not make such a disclosure, A commits an offence.

(4A)  The conditions mentioned in paragraph (4) are that the disclosure is made –

  1. to a  designated  police  officer,  a  designated  customs  officer  or  a nominated officer;
  2. in good faith; and
  3. as soon as is practicable after the information or other matter comes to A.';

(b)  in paragraph (9), after the word discloses' there shall be inserted the words in good faith'.".

THE  STATES  noted  that,  in  accordance  with  the  provisions  of  Standing  Order  106(1)(b),  the Connétable of St. John declared an interest and withdrew from the Chamber for the duration of the debate. Senator Bryan Ian Le Marquand, Deputy Judith Ann Martin of St. Helier and Deputy John Hilary Young of St. Brelade declared an interest but remained in the Chamber for the duration of the debate.
