Residential rental property: minimum standards and a register of landlords P.42/2014

THE STATES, having resumed consideration of a proposition of Deputy Montfort Tadier of St. Brelade , as amended, agreed to

  1. request the Minister for Health and Social Services, in consultation with the Minister for Housing, to bring forward for approval no later than 31st December 2014, proposals to establish minimum standards for all categories of residential rental properties and a framework for the inspection and regulation of such properties;
  2. request the Minister for Housing to investigate the –
  1. creation of a register of landlords, for all individuals/companies wishing to rent out residential properties in the island; and,
  2. the introduction of rent control to set maximum levels of rents and fees that may be charged to tenants.

Snow Hill car park: parking for States members, Jurats and Law Officers P.43/2014

THE STATES commenced consideration of a proposition of Deputy Edward James Noel of St. Lawrence concerning the cessation of free parking provision for States Members, Jurats and Law Officers and rejected a proposition of Deputy Michael Roderick Higgins of St. Helier that, in accordance with Standing Order 85, the Assembly move to the consideration of the next item on the Order Paper.

THE STATES noted that, in accordance with Standing Order 85(4), the proposal was not adopted as less than 20 elected members had voted in favour of it.

THE STATES, resumed consideration of the proposition of Deputy Edward James Noel of St. Lawrence and, adopting the proposal, requested the Minister for Transport and Technical Services to take the necessary steps to cease the provision of free car parking for States Members, Jurats and Law Officers at Snow Hill car park with immediate effect so that, upon completion of the Transport and Technical Services North of St. Helier Flood alleviation scheme in the car park, the 11 spaces currently reserved for States Members, Jurats and Law Officers could be amalgamated with the 84 public spaces currently provided at Snow Hill subject to the continued provision of adequate parking for Jurats at an alternative location as required.

Energy Plan for Jersey: Pathway 2050' P.38/2014

THE STATES, adopting paragraph (a)(1) of a proposition of the Minister for Planning and Environment, agreed to receive the Summary of the Energy Plan for Jersey Pathway 2050' as set out in the Appendix and approved the following policy to deliver the Plan –

  1. Policy 1 – Demand Management

The  Minister  for  Planning  and  Environment,  working  with  other  relevant Ministers and the Energy Partnership, will develop and implement the actions and  work-streams  that  will  reduce  energy  demand  through  a  series  of interventions across all emissions sectors according to identified targets.

THE STATES, adopting paragraphs (a)(2) to (4) and (b) of a proposition of the Minister for Planning and Environment, agreed to receive the Summary of the Energy Plan for Jersey Pathway 2050' as set out in the Appendix and approved the following policies to deliver the Plan –

  1. Policy 2 – Energy Security and Resilience

The  Minister  for  Planning  and  Environment,  working  with  other  relevant Ministers,  will  develop  and  implement  actions  and  work-streams,  including examination of the options for utility scale renewable energy generation, to ensure a diverse, safe and resilient supply of energy to meet the needs of the Island.

  1. Policy 3 – Fuel Poverty and Affordability of Energy

The Minister for Planning and Environment, working with other relevant Ministers will develop and implement the actions and work streams to investigate the scale of fuel poverty and the affordability of energy in a Jersey context. This will assist the development of specific policies that will ensure that energy is affordable to all members of the community.

  1. Delivery Framework – Energy Partnership

The Minister for Planning and Environment will establish an Energy Partnership to oversee and review ongoing development and implementation of the policies.

The Partnership will comprise 2 parts –

  1. a Ministerial Energy Executive, which will include representation from the Departments of the Environment, Economic Development, Transport and Technical Services and Social Security, and which will be responsible for the ongoing monitoring of the work-streams as outlined in the action statements, and which will also review the Plan and develop or commission either new policy interventions or work- streams, as appropriate. The Executive will present the 5 year review to the States Assembly and will provide an annual progress update to the Environment Scrutiny Panel;
  2. a multi-stakeholder Energy Forum, which will be chaired by a person elected on an annual basis by the members of the Forum, which will include representatives from the energy industry, businesses and the third sector, and which will provide an opportunity for key stakeholders to input on the progress of the Energy Plan and raise areas of concern and identify changing or future priorities; and,

(b)  requested the Minister for Planning and Environment to bring forward for approval by the Assembly, as appropriate, future policy proposals that were developed from the implementation of the Energy Plan.

Public Employees Contributory Retirement Scheme: appointment of Chairman P.48/2014

THE STATES, adopting a proposition of the Minister for Treasury and Resources, in accordance with Regulation 3 of the Public Employees (Contributory Retirement Scheme) (General) (Jersey) Regulations 1989, appointed Mr. Gordon Pollock as Chairman of the Public Employees Contributory Retirement Scheme, with effect from 1st July 2014 to 30th June 2019, that date being 5 years from the date of his initial appointment as Chairman as agreed by the members of the PECRS Committee of Management.

Draft Amendment (No. 23) of the Standing Orders of the States of Jersey P.49/2014

THE STATES commenced consideration of amendments to the Standing Orders of the States of Jersey and adopted the first amendment.

THE STATES, adopting a second amendment to the Standing Orders of the States of Jersey, agreed that after Standing Order 19 there should be inserted the following Standing Order –

"19A  Prohibition on lodging before ordinary election

A proposition may not be lodged during any period of 21 days ending with an ordinary election unless, in the opinion of the Bailiff , the proposition relates to a matter of such urgency and public importance that its lodging should not be delayed.".

THE STATES commenced consideration of the fourth amendment to the Standing Orders of the States of Jersey and, adopting an amendment of Deputy Gerard Clifford Lemmens Baudains of St. Clement , agreed that in the heading to the inserted Standing Order 21B the words "and restriction upon" should be deleted and in the inserted Standing Order 21B the paragraph number "(1)" and paragraph (2) should be deleted.

THE STATES resumed consideration of the fourth amendment to the Standing Orders of the States of Jersey, as amended, and agreed that after Standing Order 21A there should be inserted the following Standing Order –

"21B Additional requirement for and proposition for the censure of any person or body

A proposition that the States censure any person or body of persons cannot be lodged unless it is

  1. signed by at least 3 members of the States, in addition to the proposer; and
  2. accompanied by a report setting out why the proposer considers that is should be adopted.

THE STATES, adopting a fifth amendment to the Standing Orders of the States of Jersey, agreed that in Standing Order 26(3) after sub-paragraph (d) there should be added the following sub-paragraphs –

"(e) a proposition for the annulment of an Order;

(f)  a proposition opposing a land transaction to which standing order 168(3) applies.";

and for Standing Order 26(7) there should be substituted the following paragraph –

"(7) The States may reduce a minimum lodging period for a proposition if they are of the

opinion that it is in the public interest to do so.".

THE STATES rejected a sixth amendment to the Standing Orders of the States of Jersey, that in Standing Order 63 –

  1. after paragraph (1) there should be inserted the following paragraph –

"(1A) A member of the States may propose without notice that the time allowed for such

questions during a meeting is extended.";

  1. in paragraph (9) after the words "2 hours" there should be inserted the words "or such extended period as the States have".

THE STATES noted that, as there was an equality of votes, the matter had been determined in the negative in accordance with Article 16(2) of the States of Jersey Law 2005.

  1. in paragraph (3)  for  the  words  "10 minutes"  there  should  be  substituted  the  words "15 minutes";

"(3A) A  member  of  the  States  may  propose  without  notice  that  the  time  allowed  for

questions regarding the contents of the statement is extended by up to 15 minutes.".

THE STATES, adopting an eighth amendment to the Standing Orders of the States of Jersey, agreed that after Standing Order 80A there should be inserted the following Standing Order –

"80B Act under the Public Holidays and Bank Holidays (Jersey) Law 1951

Notwithstanding standing order 26, a Minister may propose, without notice, that the States make an Act under Article 2 of the Public Holidays and Bank Holidays (Jersey) Law 1951 where –

  1. the Act would be for the appointment of a day of a year and not for the appointment of the same day in each year; and
  2. the day to be appointed is so imminent that it would not be possible for the States to make the Act before the day, if standing order 26 applied.".

THE STATES, adopting a ninth amendment to the Standing Orders of the States of Jersey, agreed that in Standing Order 168 –

  1. in paragraph (1), for sub-paragraphs (a) to (c) of paragraph (1) there should be substituted the following sub-paragraphs –

"(a)  the acquisition, disposal letting or rental of land on behalf of the public of

Jersey (other than the agreement of altered boundaries);

  1. the agreement of boundaries, or of altered boundaries, on behalf of the public of Jersey;
  2. the acquisition, grant, variation or cancellation of rights or servitudes over land on behalf of the public of Jersey;

(ca)  the renewal, extension, variation or cancellation of any lease of land on behalf

of the public of Jersey;

(cb)  the provision of consent, on behalf of the public of Jersey, to a land transaction

that is not included in sub-paragraph (a) to (ca);";

  1. in paragraph (3) for the words "the disposal, acquisition, letting or rental of land on behalf of the public of Jersey" there should be substituted the words "an action described in paragraph (1)(a)";
  1. in paragraph (4), for the words "or variation" there should be substituted the words ", variation or cancellation";
  2. after paragraph (5) there should be added the following paragraph –

"(6)  In paragraphs (1)(ca) and (4), the references to the renewal of a lease or tenancy

includes a reference to the grant of a lease or tenancy of land to a person, where the term of the lease or tenancy commences on the expiry of the term of an earlier lease or tenancy and the earlier lease or tenancy was of the same land and to the same person.".
