Terrorist bombings and shootings in Paris

The Bailiff advised the Assembly that he had written to the President of the French Republic on behalf of all States members and the people of Jersey to express sympathy following the terrorist bombings and shootings in Paris on Friday 13th November 2015.

A vigil had been held in the Royal Square on Monday 16th November 2015, and the Bailiff thanked the Chief Minister, Senator Ian Joseph Gorst , and Senator Philip Francis Cyril Ozouf for assisting with the necessary arrangements. The Bailiff also extended his thanks to the Dean for the service which had been conducted in the Town Church thereafter, and to the Honorary French Consul, Mr. David Myatt, and Dr. Saffraz Jarmali, who had represented the Island's Muslim community.

THE STATES commenced consideration of the Draft Public Employees (Pension Scheme) (Membership and Benefits) (Jersey) Regulations 201- and adopted the principles.

THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, adopted Regulations 1 to 51 and Schedules 1 and 2.

THE STATES, in pursuance of Articles 2, 4, 5, and 9 of, and Schedule 1 to the Public Employees (Pensions) (Jersey) Law 2014 and Articles 2 and 4 of the Public Employees (Retirement) (Jersey) Law 1967 made Regulations entitled the Public Employees (Pension Scheme) (Membership and Benefits) (Jersey) Regulations 2015.

Draft Public Employees (Pension Scheme) (Transitional Provisions, Savings and Consequential Amendments) (Jersey) Regulations 201- P.99/2015

THE STATES commenced consideration of the Draft Public Employees (Pension Scheme) (Transitional Provisions, Savings and Consequential Amendments) (Jersey) Regulations 201- and adopted the principles.

THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, adopted Regulations 1 to 6.

THE STATES commenced consideration of Regulation 7 and, adopting an amendment of the States Employment Board, agreed that, after Regulation 7(11) there should be added the following paragraph –

"(12) Unless an election as required under Regulation 15 of the Existing Members

Regulations or Regulation 15 of the New Members Regulations, as the case may be, has been made before the transition date, the calculation of 1967 Scheme retirement benefits referred to in paragraphs (2)(a), (4)(a), (6)(a), (8)(a), (9)(a), (10)(a) or (11)(a), shall not include an adjustment under Regulation 15 of those respective Regulations, as the case may be.".

THE STATES adopted Regulation 7, as amended. THE STATES adopted Regulations 8 to 18.

THE STATES commenced consideration of Regulations 19 and 20 and Schedules 1 and 2 and, adopting an amendment of the States Employment Board to Schedule 1, agreed that –

In paragraph 1 –

  1. sub-paragraph (11) should be deleted;
  2. for sub-paragraph (12), there should be substituted the following sub-paragraph –

"(11) In Regulation 11(2)(b), for the words as increased under Regulation 11 of the

General Regulations', there are substituted the words as increased under Regulation 8 or 12(2)(a) of, and paragraph 2 of Schedule 1 to, the Funding and Valuation Regulations'.";

  1. sub-paragraphs (13) and (14) should be re-numbered as sub-paragraphs "(12)" and "(13)" respectively;
  2. for sub-paragraph (15) there should be substituted the following sub-paragraph –

"(14) In  Regulation 15(2)(a),  (c)  and (d), for the words Regulation 11 of the General

Regulations', there are substituted the words Regulation 8 or 12(2)(a) of, and paragraph 2 of Schedule 1 to, the Funding and Valuation Regulations'.";

  1. sub-paragraph (16) should be re-numbered as sub-paragraph "(15)" and the remaining sub- paragraphs should be re-numbered accordingly.

In paragraph 5 –

  1. sub-paragraph (12) should be deleted;
  2. for sub-paragraph (13), there should be substituted the following sub-paragraph –

"(12) In Regulation 11(2)(b), for the words as increased under Regulation 11 of the

General Regulations', there are substituted the words as increased under Regulation 8 or 12(2)(a) of, and paragraph 2 of Schedule 1 to, the Funding and Valuation Regulations'.";

  1. sub-paragraphs (14) and (15) should be re-numbered as sub-paragraphs "(13)" and "(14)" respectively;
  2. for sub-paragraph (16) there should be substituted the following sub-paragraph –

"(15) In  Regulation 15(2)(a),  (c)  and (d), for the words Regulation 11 of the General

Regulations', there are substituted the words Regulation 8 or 12(2)(a) of, and paragraph 2 of Schedule 1 to, the Funding and Valuation Regulations'.";

  1. sub-paragraph (17) should be re-numbered as sub-paragraph "(16)" and the remaining sub- paragraphs should be re-numbered accordingly.

THE STATES, adopting an amendment of the States Employment Board to Schedule 2, agreed that –

After paragraph 1(3) there should be added the following sub-paragraph –

"(4) In Regulation 15(1) and (2)(b) and (e), the words or deferred pensioner' are

deleted.".

After paragraph 4(3) there should be added the following sub-paragraph –

"(4) In Regulation 15(1) and (2)(b) and (e), the words or deferred pensioner' are

deleted.".

THE STATES, in pursuance of Articles 2, 10 and 11 of the Public Employees (Pensions) (Jersey) Law 2014 and Article 2 of the Public Employees (Retirement) (Jersey) Law 1967, made Regulations entitled the Public Employees (Pension Scheme) (Transitional Provisions, Savings and Consequential Amendments) (Jersey) Regulations 2015.

THE STATES, adopting a proposition of the Minister for Economic Development, and in pursuance of Regulation 3(2) of the Gambling (Channel Islands Lottery) (Jersey) Regulations 1975, agreed to appoint the following as members of the Public Lotteries Board, namely –

Jersey Financial Services Commission: appointment of Commissioner P.126/2015

THE STATES commenced consideration of a proposition of the Chief Minister concerning the appointment of a Commissioner of the Jersey Financial Services Commission.

THE STATES noted that, in accordance with Article 3(2) of the Financial Services Commission (Jersey) Law 1998, the discussion of this matter had to take place in camera. The Bailiff , in accordance with Standing Order 82, ordered all strangers to withdraw from the precincts of the States and the doors of the Chamber to be closed.

THE STATES, having concluded the debate  in camera,  proceeded to vote in public assembly and agreed, in pursuance of Article 3 of the Financial Services Commission (Jersey) Law 1998, to appoint Mr. Michael Nelson de la Haye, O.B.E. as a Commissioner of the Jersey Financial Services Commission with effect from 1st January 2016 for a period of 5 years.
