"'Following the announcement that UBS has signed an agreement with the States of Jersey Development Company to move into the proposed Esplanade Quarter, would the Minister inform members exactly when this agreement was signed and explain exactly what incentives or inducements (such as free rent periods) if any, were offered to UBS?".
Deputy J.A.N. Le Fondré of St. Lawrence asked the following urgent question of the Minister for Treasury and Resources which the Bailiff had allowed in accordance with Standing Order 15 relating to urgent oral questions –
"Further to the press release issued on Friday 29th May in relation to the signing up of UBS as the first tenant of the Jersey International Finance Centre (JIFC) would the Minister –
- confirm the total number of legally binding pre-lets that had been signed in relation to the first building on the JIFC as of the date and time of the press release and state the total amount of square footage this represents;
- indicate what measures, if any, he has taken to ensure that the financial estimates produced by SOJDC to justify their position that building can now commence are robust;
- give an undertaking to instruct the States of Jersey Development Company not to take any further steps to progress the development until the results of his financial assessment have been presented either to members or, if the data is confidential, to the Corporate Services scrutiny panel?".

THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, adopted Articles 1 to 6.

THE STATES commenced consideration of Articles 30 to 41 and rejected an amendment of Deputy Geoffrey Peter Southern of St. Helier to Article 38 that –
"(1) In paragraph (1), at the beginning of sub-paragraph (b) there should be inserted the words
"subject to paragraph (4),".
(2) At the end, the following paragraphs should be added –
"(4) Nothing in this Article shall be taken to derogate from or to terminate any right to
redeployment (however described and whether created expressly by a contract of employment, or implied by any operation of law) enjoyed by a person immediately before the transfer date, and such a right –
- shall not be changed; and
- for the avoidance of doubt, may be exercised by the person at any time, within the period of 3 years beginning with the transfer date.
(5) In this Article –
- for the purposes of paragraphs (2) and (4), "contract of employment" has the meaning given by Article 1 of the Employment of States of Jersey Employees (Jersey) Law 2005;
- for the purposes of paragraph (4), "redeployment" refers to re-employment within any administration of the States as a States' employee;
and in sub-paragraph (b), "administration of the States" and "States' employee" have the meanings given by Articles 1 and 2 of that Law respectively.".

THE STATES acceded to a request by Deputy Geoffrey Peter Southern of St. Helier , in accordance with Standing Order 69(4), that his amendment to Article 41 be withdrawn.
THE STATES adopted an amendment of the Chief Minister to Article 41 that, in paragraph (1), for the words "an employee of" there should be substituted the words "employed by".

THE STATES commenced consideration of Articles 42 to 55 and the Schedule and, adopting an amendment of the Chief Minister to paragraph 6 of the Schedule, agreed that, in draft Article 2(7)(b) to be substituted in the Harbours (Administration) (Jersey) Law 1961, for the word "delegate" there should be substituted the word "entrust".

THE STATES, adopting an amendment of Deputy Louise Mary Catherine Doublet of St. Saviour as amended, agreed that, immediately before the paragraphs added to Article 6, there should be inserted –
"(3) In relation to the protected characteristic of sex, for the purposes of Part 5, direct
discrimination includes treating a woman less favourably because she is breast feeding a child.",
and the subsequent inserted paragraphs should be renumbered. THE STATES adopted Regulation 3, as amended.
