The Bailiff informed the Assembly that, subsequent to the establishment by the Bosdet Foundation of a new initiative called Volunteer.je, the aim of which was to match volunteers to charities and community groups seeking help, he had received a scroll containing wishes expressed by such volunteers as to what should happen in the Island and that the scroll would be exhibited for members to see.

Future Hospital: approval of preferred scheme and funding P.107/2017

THE STATES, resuming consideration of the proposition of the Minister for Treasury and Resources entitled Future Hospital: approval of preferred scheme and funding' (P.107/2017), as amended, and referring to their Act dated 23rd October 2012, which requested the Council of Ministers to bring forward proposals for a new Hospital, and their Act dated 1st December 2016, which approved in principle the site location for the new General Hospital –

  1. approved the Preferred Scheme contained within the Future Hospital Outline Business Case with a capital expenditure budget of up to £396 million with a contingency of £70 million, giving a total of £466 million, subject to paragraph (h);
  2. approved, in accordance with the provisions of Article 3(3)(a) of the Public Finances (Jersey) Law 2005 ("the Law"), the establishment of a Special Fund to be known as the "Hospital Construction Fund" and approved the Fund's purpose, as set out in Appendix A to the report accompanying the proposition;
  1. authorised, in accordance with Article 21(1) of the Law, the Minister for Treasury and Resources to borrow up to £275 million towards the construction of the Preferred Scheme, and directed that the amount borrowed be paid into the Strategic Reserve Fund;
  2. requested the Minister for Treasury and Resources –
  1. to undertake a review of the feasibility and costs of undertaking any borrowing on the basis that the capital amount borrowed was repaid in tranches over the intended life of the new General Hospital rather than in a single lump sum on final maturity; and
  2. to report the outcome of such review to the Assembly no later than 28th February 2018;
  1. agreed that the Strategic Reserve Fund policy be amended so as to authorise the transfer from the Strategic Reserve Fund to the Hospital Construction Fund, drawn down as required, the sum representing the balance of up to £466 million after deducting the £23.6 million already allocated in connection with this project in previous Budgets;
  2. agreed that the contingency of up to £70 million would only be released on a case-by-case basis, subject to the requirements set out in financial directions issued by the Treasurer of the States under Article 34 of the Public Finances (Jersey) Law 2005;
  3. agreed that the Strategic Reserve Fund policy be further amended so as to authorise –
  1. that the costs of borrowing and ongoing finance and administration costs related to the borrowing be borne by the Strategic Reserve Fund;
  2. the repayment from the Strategic Reserve Fund of the amount borrowed in accordance with paragraph (c) above; and
  3. that on the final account of the Preferred Scheme being presented, any unspent monies should be returned to the Strategic Reserve Fund;
  1. agreed that if the forecast spend arising from the effects of any recommendations made by the Planning Inspector considering the planning application for the new Hospital resulted in the project's capital expenditure budget exceeding £466 million, the project would be placed on hold, and the Council of Ministers should be required to bring a proposition and report to the States in order for the project to be resumed; and
  2. requested the Minister for Treasury and Resources to bring legislation to the Assembly to place the Treasury Advisory Panel ("TAP") on a statutory basis on a similar basis to the Fiscal Policy Panel.

Roll Call

Following the lunchtime adjournment and prior to the resumption of consideration of the proposition of the Minister for Treasury and Resources entitled Future Hospital: approval of preferred scheme and funding' (P.107/2017), as amended, the Bailiff , in accordance with Standing Order 56(2), directed that elected members be summoned as the Assembly was inquorate. In accordance with Standing Order 56(2), having allowed such time as he considered reasonable for elected members to return to the Chamber, the Presiding Officer asked the Greffier to call the roll, as he believed that the States remained inquorate. THE STATES, resuming consideration of the Draft Public Health and Safety (Rented Dwellings) (Jersey) Law 201-, the principles having been adopted on 31st October 2017, adopted an amendment of the Minister for the Environment (P.66/2017 Amd.) that –

in Article 2(2)(ii), the words "including a zero-hours contract," should be deleted; in Article 6(3) –

  1. in the opening words for the words "occupier or," there should be substituted the words "occupier and,";
  2. in sub-paragraphs (b) and (c), for the words "or person having control of the dwelling" in each place, there should be substituted the words "or, in the absence of the occupier, the person having control of the dwelling"; and

in Article 10(2)(a), the words "or any other published guidelines" should be deleted.

THE STATES, adopting the request of the Minister for Infrastructure, agreed, in accordance with Standing Order 26(7), to reduce the minimum lodging period in respect of his amendment (P.105/2017 Amd.Amd.) to the amendment of Deputy John Alexander Nicholas Le Fondré of St. Lawrence (P.105/2017 Amd.) to the Draft Howard Davis Farm (Arrangements for further Abrogation of Covenant) (Jersey) Law 201- in order that it might be debated at the present meeting.

THE STATES commenced consideration of the Draft Howard Davis Farm (Arrangements for further Abrogation of Covenant) (Jersey) Law 201-.

THE STATES commenced consideration of an amendment of Deputy John Alexander Nicholas Le Fondré of St. Lawrence (P.105/2017 Amd.) and, adopting an amendment of the Minister for Infrastructure (P.105/2017 Amd.Amd.) to that amendment, agreed that –

in paragraph 2 of the amendment, for inserted paragraphs (2) and (3), there should be substituted the following –

"(2) Where the proposed change of use mentioned in paragraph (1) involves the payment of a rent

(within the meaning of paragraph 1 of the Schedule) for the use of Howard David Farm, or any part of it, for a sum that exceeds £50,000 a year, the trustees of the Trust must, before agreeing to the change of use, obtain the agreement of the Minister for Infrastructure.

(3)  Where the Minister for Infrastructure agrees to the change of use the Minister must present to the States a report setting out the details of the proposed change of use and the reasons why the Minister and the trustees of the Trust wish to allow it."; and

in inserted paragraph (4), for the words "the third meeting of the States", there should be substituted the words "15 working days".

THE STATES, resuming consideration of the amendment of Deputy John Alexander Nicholas Le Fondré of St. Lawrence (P.105/2017 Amd.), as amended, adopted the amendment and agreed that –

in paragraph (1) of Article 2, after the word "Trust", there should be inserted the words "and in accordance with paragraphs (2) to (5)";

after paragraph (1) of Article 2, there should be inserted the following paragraphs, with paragraph 2 renumbered accordingly –

"(2) Where the proposed change of use mentioned in paragraph (1) involves the payment of a rent

(within the meaning of paragraph 1 of the Schedule) for the use of Howard David Farm, or any part of it, for a sum that exceeds £50,000 a year, the trustees of the Trust must, before agreeing to the change of use, obtain the agreement of the Minister for Infrastructure.

  1. Where the Minister for Infrastructure agrees to the change of use the Minister must present to the States a report setting out the details of the proposed change of use and the reasons why the Minister and the trustees of the Trust wish to allow it.
  2. A member of the States may lodge a proposition, no later than 15 working days following the presentation of the report mentioned in paragraph (3), inviting the States to direct the trustees of the Trust not to agree to the change of use, and if the States approve the proposition, any agreement of the trustees of the Trust under paragraph (1) that relates to that change of use is void.
  3. If –
  1. no proposition is lodged under paragraph (4), the trustees of the Trust are treated as having agreed to the proposed change of use on the first day of the meeting of the States referred to in paragraph (4); or
  1. a proposition is lodged under paragraph (4) but is withdrawn by the member or rejected by the States, the trustees of the Trust are treated as having agreed to the proposed change of use on the day of the withdrawal or rejection as the case may be.".
