THE STATES, in accordance with Standing Order 133(2), accepted the resignation of Deputy Andrew David Lewis of St. Helier as chairman of the Public Accounts Committee.

In accordance with Standing Order 120(1) the Bailiff gave notice that there was a vacancy in the office of Chairman of the Public Accounts Committee.

In accordance with the provisions of Standing Order 119(1), Deputy John Alexander Nicholas Le Fondré of St. Lawrence nominated Connétable Christopher Hugh Taylor of St. John as the Chairman of the Public Accounts Committee.

THE STATES, subject to the sanction of Her Most Excellent Majesty in Council, adopted a Law entitled the Education (Amendment No. 3) (Jersey) Law 201-.

United Nations Convention on the Rights of the Child: compliance of draft Laws and training of States of Jersey employees (P.63/2017)

THE STATES commenced consideration of the proposition of Deputy Louise Mary Catherine Doublet of St. Saviour entitled United Nations Convention on the Rights of the Child: compliance of draft Laws and training of States of Jersey employees' and, adopting an amendment of Deputy Louise Mary Catherine Doublet of St. Saviour (P.63/2017 Amd.), agreed that –

  1. in paragraph (a), after the words "legislative changes" there should be inserted the words ", in conjunction with the Children's Commissioner,";
  2. paragraph (b) should be re-designated as paragraph (a) and paragraph (a) as paragraph (b); that after the words "to consider" there should be inserted the words ", in conjunction with the Children's Commissioner,", and for the words "31st December 2017" there should be substituted the words "10th April 2018"; and
  3. in paragraph (c), after the words "to ensure" there should be inserted the words "in conjunction with the Children's Commissioner".

THE STATES, adopting the proposition, as amended, agreed to request the Chief Minister –

  1. to consider, in conjunction with the Children's Commissioner, the desirability of giving the UNCRC a similar status to the European Convention on Human Rights in Jersey by incorporating it into legislation, and to report back to the States Assembly on the outcome of that consideration by 10th April 2018;
  2. to bring forward the necessary legislative changes, in conjunction with the Children's Commissioner, to ensure that a Minister who lodged a draft Law –
  1. considered whether it would impact upon children's rights as specified in the United Nations Convention on the Rights of the Child ("UNCRC");
  2. made and published a statement confirming that this consideration had been given and whether the draft Law did or did not have an impact on children's rights;
  3. if relevant, made and published a statement as to the compatibility of that draft Law with the UNCRC;
  1. to ensure in conjunction with the Children's Commissioner that every States of Jersey employee received a copy of the UNCRC and, where relevant, received training on the UNCRC and how it applied to their role.

Draft Act annulling the Motor Traffic (Cabs – Fares and Charges) (Jersey) Order 2017 P.64/2017

THE STATES rejected a proposition of Senator Sarah Craig Ferguson entitled Draft Act annulling the Motor Traffic (Cabs – Fares and Charges) (Jersey) Order 2017' (P.64/2017) to adopt an Act as set out in Appendix 1 to the proposition, annulling the Motor Traffic (Cabs – Fares and Charges) (Jersey) Order 2017, and requesting the Minister for Infrastructure to enter into discussions with the Taxi Drivers' Association under the supervision of a mediator.

Jersey Financial Services Commission: appointment of Commissioner P.70/2017

THE STATES commenced consideration of a proposition of the Chief Minister entitled Jersey Financial Services Commission: appointment of Commissioner' (P.70/2017) and the Deputy Bailiff , in accordance with the provisions of Standing Order 82, ordered all strangers to withdraw from the precincts of the States and the doors of the Chamber to be closed.

THE STATES, having concluded the debate in camera, proceeded to vote in public assembly and, adopting the proposition of the Chief Minister, agreed, in pursuance of Article 3 of the Financial Services Commission (Jersey) Law 1998, to appoint Mrs. Annamaria Koerling as a Commissioner of the Jersey Financial Services Commission with effect from the day of the States' debate for a period of 5 years.

THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, adopted Regulations 1 and 2.

THE STATES, in pursuance of Article 3 of the Statutory Nuisances (Jersey) Law 1999, made Regulations entitled the Statutory Nuisances (Jersey) Regulations 2017.

States Assembly: selection and appointment of Ministers, Committees and Panels – return to secret ballots P.73/2017

THE STATES commenced consideration of a proposition of Deputy Russell Labey of St. Helier entitled States Assembly: selection and appointment of Ministers, Committees and Panels – return to secret ballots' (P.73/2017)

  1. to agree that the election of the following by States Members should be undertaken by way of a secret ballot and no longer by an open ballot –
  1. the Chief Minister;
  2. Ministers;
  3. Scrutiny Panel Chairmen;
  4. the Chairman of the Privileges and Procedures Committee;
  5. the Chairman of the Public Accounts Committee;
  6. the Chairman of the Planning Committee;
  1. to agree that the Minister(s) subject to review by a corresponding Scrutiny Panel should be excluded from voting for the Chair of that particular Panel;
  1. to agree that a nomination of an elected member as a candidate for the office of Chief Minister could be made by just 2 elected members, both of whom being restricted to the nomination of one candidate only;
  2. to charge the Privileges and Procedures Committee to bring forward for approval the necessary legislative amendments to give effect to the above proposals for implementation before the elections in May 2018.
