Draft Budget Statement 2018 P.90/2017

THE STATES, resuming consideration of the proposition of the Minister for Treasury and Resources entitled Draft Budget Statement 2018' (P.90/2017), as amended, adopted an amendment of Senator Philip Francis Cyril Ozouf (P.90/2017 Amd.(8)) and agreed that after paragraph (d) there should be inserted the following new paragraph –

"(e) to request the Chief Minister to: (i) request the Channel Islands Competition and Regulatory

Authority (CICRA) to undertake an inquiry under Article 6(4) of the Competition Regulatory Authority (Jersey) Law 2001 into the Island's liquor trade, focusing in particular on the effect on competitiveness of including liquor trade on-licences in the retail tax extension, including the retails margins shown in Figure 20, and (ii) agree terms of reference for the inquiry with CICRA, drawing on the draft terms of reference in the accompanying report.".

THE STATES, resuming consideration of the proposition of the Minister for Treasury and Resources, as amended –

  1. approved, in accordance with the provisions of Article 10(3)(a) of the Public Finances (Jersey) Law 2005, the estimate of income from taxation during 2018 of £689,146,000 as set out in Summary Table A of the Budget Statement, with the sum to be raised through existing taxation measures and the proposed changes to income tax, impôts duty, goods and services tax, stamp duty, land transactions tax and vehicle emissions duty for 2018, as set out in the Budget Statement except that, in relation to vehicle emissions duty, rates should be increased by 5% and except that the estimate of income  from taxation during 2018 should  be increased  by £2,100,000 by amending the band limits which apply to the application of vehicle emissions duty in relation to the manufacturer's CO2 emission specifications in line with the table below –

  1. approved, in accordance with the provisions of Articles 10(3)(c) and 11(3) of the Public Finances (Jersey) Law 2005, the appropriation of £10,424,000 in 2018 and the full year effect amounting to £9,400,000 in 2019 from the amount appropriated to growth in the Medium Term Financial Plan Addition for 2017 – 2019 (P.68/2016) to the revenue heads of expenditure of those States funded bodies as set out in the recommended allocation of growth expenditure in Summary Table B except that the Council of Ministers and the Minister for Treasury and Resources were requested  either  (a) to  allocate  the  required  sum  of  £1,894,000  to  the  Department  for Infrastructure from Contingency in 2018, or (b) to prioritise the provision of that sum to the Department for Infrastructure from available underspends at the end of 2017, and carried forward to 2018, in order to provide for the payment of Rates on States' properties to the Parishes, as agreed in the current Strategic Plan and the Medium Term Financial Plan, and that the allocation for the payment of Rates by the States as part of the Central Growth proposals in the 2019 Budget and beyond be reinstated;
  2. approved, in accordance with the provisions of Article 10(3)(d) of the Public Finances (Jersey) Law 2005, a capital head of expenditure for each of the capital projects for States funded bodies to be started or continued in 2018 (other than States trading operations), as set out in the recommended programme of capital projects in Summary Table D, totalling £43,233,000;
  3. approved, in accordance with the provisions of Article 10(3)(e) of the Public Finances (Jersey) Law  2005,  each  of  the  capital  projects  that  were  scheduled  to  start  during  2018  in  the recommended programme of capital projects for each States trading operation, as set out in Summary Table E, that required funds to be drawn from the trading funds in 2018;
  4. requested the Minister for Treasury and Resources: (i) to undertake a programme of engagement and awareness-raising with UK firms that charged Value Added Tax (VAT) on goods delivered to Jersey to encourage them to levy the correct sales tax; (ii) to explore with those businesses the opportunities for those businesses to collect any GST due from the consumer and remit that GST directly to the Taxes Office in order to expedite the delivery of the goods; (iii) to report on progress with this work by 10th April 2018; and (iv) to make available from the Contingency budget the resources required to ensure that this work was undertaken without affecting progress with other work-streams;
  5. requested the Minister for Treasury and Resources: (i) to undertake a review into the feasibility of extending the scope of GST to include the supply of digital services into Jersey by businesses with no establishment in Jersey; (ii) if it was feasible, to bring legislation to the Assembly no later than the 2020 Budget which sought to extend the scope of GST to include the supply of digital services into Jersey by businesses with no establishment in Jersey; (iii) to undertake a programme of engagement and awareness-raising with UK or EU digital service suppliers to ensure that they levied the correct sales taxes; and (iv) to make available from the Contingency budget the resources required to ensure that this work was undertaken without affecting progress with other work-streams;
  1. requested the Minister for Treasury and Resources to review the principle that income tax was not expected to be due on profits arising from mutuals or similar organisations which competed with other traders who were or would be subject to Corporation Tax on their trading profits; and
  2. requested the Chief Minister to: (i) request the Channel Islands Competition and Regulatory Authority (CICRA) to undertake an inquiry under Article 6(4) of the Competition Regulatory Authority (Jersey) Law 2001 into the Island's liquor trade, focusing in particular on the effect on competitiveness of including liquor trade on-licences in the retail tax extension, including the retails margins shown in Figure 20, and (ii) agree terms of reference for the inquiry with CICRA, drawing on the draft terms of reference in the accompanying report.

THE STATES noted that, in accordance with the provisions of Standing Order 70(1A), as the Connétable of St. Helier had been excused attendance from the States, the Connétable of St. Clement had been requested by the Connétable of St. Helier to propose his amendment to the Draft Finance (2018 Budget) (Jersey) Law 201- that Part 5 of the Draft Law be renumbered Part 6 and that a new Part 5 be inserted.

THE STATES, commencing consideration of the amendment of the Connétable of St. Helier (P.98/2017 Amd.), and adopting an amendment of the Comité des Connétable s to that amendment (P.98/2017 Amd.Amd.), agreed that, in the proposed Part 5 to be inserted into the Draft Finance (2018 Budget) (Jersey) Law 201-, the Article numbered 4 which proposed to amend Article 19 of the Rates (Jersey) Law 2005 should be deleted.

THE STATES, resuming consideration of the amendment of the Connétable of St. Helier (P.98/2017 Amd.), as amended, agreed that Part 6 of the Draft Finance (2018 Budget) (Jersey) Law 201- should be renumbered as Part 6 and that, before the renumbered Part 6, there should be inserted the following Part –

"PART 5

RATES (JERSEY) LAW 2005 AMENDED

1 Interpretation

In this Part a reference to an Article by number and without more is a reference to the Article of the same number in the Rates (Jersey) Law 2005.

2 Article 17 amended

  1. In Article 17(2) at the beginning of each of sub-paragraphs (f) and (g) there shall be inserted the words "subject to paragraph (3),".
  2. After Article 17(2) there shall be added the following paragraph –

"(3) The exemptions from the foncier rate under paragraph (2)(f) and (g) do not apply

in relation to –

  1. houses and other buildings, with any premises appertaining thereto, owned by the States and regardless of the purpose for which they are used; and
  1. land (other than land described in sub-paragraph (a)) owned by the States and used predominantly for the purpose of parking vehicles, regardless of any other purpose for which such land is used.".

3 Article 18 amended

  1. In Article 18(2), at the beginning of sub-paragraph (c) there shall be inserted the words "subject to paragraph (2A),".
  2. After Article 18(2) there shall be inserted the following paragraph –

"(2A) The exemption from the occupier's rate under paragraph (2)(c) does not apply in

relation to –

  1. houses and other buildings, with any premises appertaining thereto, occupied by the States; and
  2. land (other than land described in sub-paragraph (a)) occupied by the States and used predominantly for the purpose of parking vehicles.".".

THE STATES commenced consideration of a proposition of Deputy Samuel Yves Mézec of St. Helier entitled Minimum Wage: revocation of Social Security Order (R&O.109/2017) and amendment of States Act dated 21st April 2010' (P.109/2017) and rejected paragraph (a) of the proposition to request the Minister for Social Security to revoke the Employment (Minimum Wage) (Amendment No. 11) (Jersey) Order 2017, scheduled to come into force on 1st April 2018, and to take such steps as were necessary to make a new Order fixing the minimum wage at £7.88 per hour from 1st April 2018.

THE STATES rejected paragraph (b) of the proposition to amend their Act dated 21st April 2010 on setting the minimum wage level as a percentage of average earnings by substituting for the words "the minimum wage should be set at 45% of average earnings, to be achieved over a period of not less than 5 years and not greater than 15 years from April 2011" the words "the minimum wage should be set at 60% of median weekly earnings by 2020".
