The Connétable of St. Peter asked the following question (UOQ.1/2018) of the Minister for the Environment which the Bailiff had allowed in accordance with Standing Order 15 relating to urgent oral questions –

"Following the refusal of the application for 65 First Time Buyer homes in St. Peter , would the Minister advise how many homes have been approved under Policy H5 since 2014, and, if none, will he undertake to review this Policy to ensure that it enables the future delivery of Parish led developments which provide homes which seek to maintain the vitality and viability of those Parishes?"

THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, commenced consideration of Articles 1 to 24 and adopted an amendment of the Minister for Health and Social Services (P.57/2018 Amd.) that –

In paragraph (2) of Article 9, for the words "Article 19(2)(a)" there should be substituted the words "Article 18(2)(a)";

Article 14 should be deleted and the subsequent Articles renumbered; and

In Article 19 (renumbered Article 18) –

  1. paragraphs (1) and (2) should be renumbered as paragraphs (2) and (3) respectively;
  2. before renumbered paragraph (2), there should be inserted the following paragraph –

"(1) The States shall by Regulations make provision for the registration of express consent,

or a decision not to consent, to a specified activity."; and

  1. in renumbered paragraph (3) –
  1. sub-paragraph (d) should be deleted, and
  2. sub-paragraph (e) should be renumbered as sub-paragraph (d).

THE STATES, having resumed consideration of the proposition of Senator Philip Francis Cyril Ozouf , rejected the proposition –

  1. to refer to their Act of 30th November 2017, in which they adopted the Draft Budget Statement 2018, and their Act of 28th November 2017, in which they rejected an amendment to the Draft Budget Statement 2018 which sought to provide that the new Income Tax levied on large retailers be levied at the rate of 10% rather than 20%, to rescind that part of the Budget Statement 2018 which enabled that new Income Tax to be levied at 20%, and to agree in principle that the new Income Tax levied on large retailers be levied at the rate of 10%; and
  2. to request the Minister for Treasury and Resources to bring forward the legislation necessary to implement this decision.

Changes in Presidency

The Deputy Bailiff retired from the Chamber during consideration of the proposition of Senator Philip Francis Cyril Ozouf entitled Retail tax: rescindment of States' decision' (P.62/2018) and the meeting continued under the Presidency of Dr. Mark Egan, Greffier of the States. The Deputy Bailiff returned to the Chamber during consideration of the same proposition and the meeting continued under his Presidency.
