Questions submitted by Ministers and Assistant Ministers – ruling by the Bailiff
The Deputy Bailiff advised the Assembly of the following ruling which had been made by the Bailiff in respect of questions submitted by Ministers and Assistant Ministers –
"Although there may have been exceptions in the past, a convention has arisen in which Ministers do not ask questions of other Ministers in Written or Oral Questions, nor do Assistant Ministers ask questions of their own Minister. There are good reasons for such a convention which include:
- The purpose of formal questions in the Assembly in Standing Orders is to seek information or seek official action. Both of these purposes are directly achievable by Ministers by direct interaction with Ministerial colleagues or in the Council of Ministers and by Assistant Ministers by direct interaction with their Minister; furthermore, Assistant Ministers are able to obtain information directly from civil servants in their department;
- Question time is also an important parliamentary tool in holding Ministers – and thus Assistant Ministers – to account. If Ministers are permitted to ask questions of Ministers that practice will reduce the time available to members who are not Ministers (or Assistant Ministers as the case may be) to hold Ministers specifically and the Government in general to account;
- Indeed, it would theoretically be possible to load the time available for oral questions with questions posed by Ministers which would prejudice the ordinary scrutiny of the Government and Ministers by non-executive members.
It is also to be noted that the recent changes to the States of Jersey Law, albeit not yet in force would also suggest that such questions are inappropriate. Under the new legislation, Ministers are part of a single Government of the island and presumably as members of the corporation aggregate either have the information already or are able to obtain information directly from Ministerial colleagues.
The Bailiff believes the matter should receive consideration by PPC in consultation with the Chief Minister but in the interim proposes to act in and conduct approval of questions and question time in accordance with the established convention.
Accordingly the ruling of the Bailiff is that until such time as Standing Orders are amended explicitly to permit them to do so, Ministers may not ask questions of other Ministers and Assistant Ministers may not ask questions of their own Ministers."

THE STATES, adopting a proposition of the Minister for Education entitled Fields 85, 84 and 80, La Rue Carrée, St. Brelade : acquisition of land by the Public' (P.78/2018) –
- approved the acquisition by the Public of the land being Field No. 85, the majority of Field No. 84 and the majority of Field No. 80, La Rue Carrée, St. Brelade , measuring approximately
12.94 vergées, as shown cross-hatched on the Drawing attached at the Appendix, at a fair and proper price, together with the payment of the owner's reasonable legal expenses, to be agreed by the Minister for Infrastructure;
- agreed that in the event of it not being possible to agree a fair and proper price with the owner of the said interest referred to in sub-paragraph (a), the Minister for Education should be empowered, in exercise of the powers conferred by Article 63 of the Education (Jersey) Law 1999, to acquire the land by compulsory purchase on behalf of the Public, in accordance with the provisions of the Compulsory Purchase of Land (Procedure) (Jersey) Law 1961;
- authorised the payment or discharge of the expenses incurred in connection with the acquisition of the interest in land and any other interests therein referred to in sub-paragraphs (a) and (b), and of the payment of all legal expenses, from the Capital Head of Expenditure Les Quennevais School' (Business Unit FXA071); and
- authorised H.M. Attorney General and the Greffier of the States to pass, on behalf of the Public, any contract which it might be found necessary to pass in connection with the acquisition of the said land and any interests therein.

THE STATES, adopting a proposition of the Minister for Treasury and Resources entitled States of Jersey Development Company Limited: re-appointment of Non-Executive Directors' (P.72/2018) –
- re-appointed Mr. Paul Masterton as a Non-Executive Director of the States of Jersey Development Company Limited, in accordance with the Memorandum and Articles of Association, for a further period of 3 years, to take effect from the delivery to the company of the notice referred to in paragraph (b) below; and
- authorised the Greffier of the States, for and on behalf of the States, to deliver a notice to the States of Jersey Development Company Limited, in accordance with Article 21(b) of the Memorandum and Articles of Association, to give effect to such appointments.

Draft Proceeds of Crime (Amendment No. 3) (Jersey) Law 201- P.75/2018
THE STATES resumed consideration of the Third Reading of the Draft Proceeds of Crime (Amendment No. 3) (Jersey) Law 201- following the adoption, on 26th June 2018, of a proposition to move to the next item and noted that the Presiding Officer, in accordance with Standing Order 75(4), had granted permission for a clerical error within the draft to be amended, namely that Article 2(b) and (c) of the Draft Law be deleted.
THE STATES, subject to the sanction of Her Most Excellent Majesty in Council, adopted a Law entitled the Proceeds of Crime (Amendment No. 3) (Jersey) Law 201-.
Changes in Presidency
The Deputy Bailiff retired from the Chamber prior to consideration of the Draft Proceeds of Crime (Amendment No. 3) (Jersey) Law 201- and the meeting continued under the presidency of Dr. Mark Egan, Greffier of the States.
Draft Referendum (Presidency of States Assembly) (Jersey) Act 201- P.76/2018
THE STATES commenced consideration of the Draft Referendum (Presidency of States Assembly) (Jersey) Act 201- and, adopting an amendment of the Comité des Connétable s (P.76/2018 Amd.), agreed that –
in Article 3, for the words "Saturday, 20th October 2018" there should be substituted the words "Wednesday, 17th October 2018";
in Article 8(3)(a), for the words "Saturday, 13th October 2018" there should be substituted the words "Wednesday, 10th October 2018";
in Article 9(2), for the words "Friday, 14th September 2018" there should be substituted the words "Wednesday, 12th September 2018"; and
in Article 9 paragraph (4) should be omitted.
