Letters of appreciation – Nepal

The Deputy Bailiff advised the Assembly that the Bailiff , on behalf of the States and people of Jersey, had received letters from the Dandakharka Community in the District of Nuwakot in Nepal, presented by members of the Jersey Overseas Aid Commission Community Work Project Team and the Gurkha Welfare Trust – Jersey Branch, to express the appreciation of the people of Nepal for work undertaken in the District following the earthquake there in April 2015.

Draft Damages (Jersey) Law 201- P.131/2018

THE STATES commenced consideration of the Draft Damages (Jersey) Law 201- and adopted the principles.

THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, adopted Article 1.

THE STATES, commencing consideration of Article 2, adopted an amendment of the Chief Minister that, for paragraphs (5)(d) and (e), there should be substituted the following paragraphs –

"(d) circumstances, of whatever nature, to be taken into account in determining the discount rate,

including circumstances relating to such matters as economic sustainability, affordability, and inflation, including wage inflation;

  1. different circumstances to be taken into account in different types of case;
  2. the making of rules of Court.".

THE STATES, commencing consideration of Article 4, adopted an amendment of the Chief Minister that paragraph (10) should be renumbered as paragraph (11) and that, after paragraph (9), there should be inserted the following paragraph –

"(10) For the purposes of paragraph (8), the States may, by Regulations, make provision for

determining when there has been a material change of circumstances and when an application can be made under that paragraph, including, without prejudice to the generality of the foregoing, provision for –

  1. factors to be taken into account in determining whether there has been a material change of circumstances;
  2. any period of time that must elapse before an application or subsequent application is made, with reference to such factors as may be specified in the Regulations, including the nature of any change of circumstances or otherwise;
  3. when the leave of the Royal Court is required to make an application, whether in all circumstances or in such circumstances as may be specified in the Regulations;
  4. when the provisions of a periodical payment order may or must limit the circumstances in which an application under paragraph (8) may be made.".

THE STATES, adopting a proposition of the Deputy of St. Martin entitled Andium Homes: authorisation of loan to develop the Ann Court site' (P.146/2018) requested the Minister for Treasury and Resources to sign a Ministerial Decision to release the entire loan funding requested by Andium Homes to develop the Ann Court site in accordance with Planning Permit P/2017/0730.

THE STATES, adopting a proposition of the Minister for International Development entitled Jersey Overseas  Aid  Commission:  appointment  of  non-States  Commissioner'  (P.147/2018),  appointed Ms. Therese Morel as a non-States Commissioner of the Jersey Overseas Aid Commission for a period of 3 years, commencing 6th March 2019, in accordance with clause 7.4 of the Constitution of the Jersey Overseas Aid Commission as set out in Schedule 1 to the Jersey Overseas Aid Commission (Jersey) Law 2005.

THE STATES, adopting a proposition of the Minister for Treasury and Resources under Article 21(b) of the States of Jersey Development Company Limited's Memorandum and Articles of Association –

  1. re-appointed Nicola Palios as Chairman of the States of Jersey Development Company Limited for  a  further  period  from  2nd February  2019 to 19th June  2020, in accordance  with the Memorandum and Articles of Association, to take effect from the delivery to the company of the notice referred to in paragraph (b) below; and
  2. authorised the Greffier of the States, for and on behalf of the States, to deliver a notice to the States  of  Jersey  Development  Company  Limited  in  accordance  with  Article 21(b)  of  the Memorandum and Articles of Association, to give effect to such appointment.
