Government Plan 2020–2023 P.71/2019

THE STATES, resuming consideration of a proposition of the Council of Ministers entitled Government Plan 2020–2023' (P.71/2019), as amended, rejected an amendment of Senator Samuel Yves Mézec (P.71/2019 Amd.(21)) that, in paragraph (h)(ii), after the words "from the Funds" there should be inserted the words ", except that the proposed increase in the Long-Term Care (LTC') Charge shall not be implemented and the cap on LTC contributions shall be abolished, so it is applied at 1% across the board for all taxpayers, reducing the estimated closing balance on the Long-Term Care Fund in 2020, as shown in Summary Table 8(iii), by £19.7 million".

THE STATES noted that, in accordance with Standing Order 34(1), the Council of Ministers had informed the Greffier of the States that its amendment (P.71/2019 Amd.(8)Amd.) to an amendment of Deputy Michael Roderick Higgins of St. Helier (P.71/2019 Amd.(8)) to the proposition of the Council of Ministers entitled Government Plan 2020–2023' (P.71/2019) had been withdrawn.

THE STATES resumed consideration of a proposition of the Council of Ministers entitled Government Plan 2020–2023' (P.71/2019), as amended, and, adopting an amendment of Deputy Michael Roderick Higgins of St. Helier (P.71/2019 Amd.(8)), agreed that, after paragraph (h), the following new paragraph (i) should be inserted and the remaining paragraph re-lettered accordingly –

"(i) to agree that the Justice and Home Affairs Department should increase the annual funding for

the Island's 4 cadet force organisations to £20,000 each for the years 2020 to 2023; and".

THE STATES noted that, in accordance with the provisions of Standing Order 106(1)(c), Senator Sarah Craig Ferguson and the Connétable of St. John declared an interest which was not financial, and remained in the Chamber for the duration of the debate on the amendment of Deputy Michael Roderick Higgins of St. Helier (P.71/2019 Amd.(8)).

THE STATES resumed consideration of a proposition of the Council of Ministers entitled Government Plan 2020–2023' (P.71/2019), as amended, and, commencing consideration of an amendment of Deputy Russell Labey of St. Helier (P.71/2019 Amd.(2)), rejected an amendment of the Council of Ministers that, in the words to be inserted by P.71/2019 Amd.(2) in Appendix 4 to P.71/2019, for the word "any" there should be substituted the word "the"; and that after "(R.130/2019))" there should be inserted the words ", but the proposed extension to 6.00 p.m. shall be maintained, and the standard retail cost per hour for public parking shall be increased by 5p per hour".

THE STATES, adopting the amendment of Deputy Russell Labey of St. Helier (P.71/2019 Amd.(2)), agreed that, in paragraph (i), after the words "Appendix 4 to the Report" there should be inserted the words –

"except that, on page 111 of Appendix 4, after the words "prior to the debate of the Government Plan." there should be inserted the following words –

"Implementation of the Efficiencies Plan for 2020–23 will not, however, include any extension of standard car-parking charging hours from the current 8.00 a.m. to 5.00 p.m. to 7.00 a.m. to 6.00 p.m. (as was initially proposed in Efficiencies Plan 2020–23' (R.130/2019)).".".

THE STATES, adopting a proposition of the Chair of the Privileges and Procedures Committee, agreed that it would meet until 6.30 p.m.

THE STATES noted that Deputy Montfort Tadier of St. Brelade had informed the Greffier, in accordance with Standing Order 30(2), that his proposition entitled Guidelines for Busking in Jersey: proposed changes' (P.113/2017) would be deferred from the present meeting to 10th December 2019.

Government Plan 2020–2023 P.71/2019

THE STATES resumed consideration of the proposition of the Council of Ministers, as amended, and, adopting the proposition, received the Government Plan 2020–2023 specified in Article 9(1) of the Public Finances (Jersey) Law 2019 ("the Law") and, specifically –

  1. approved the estimate of total States income to be paid into the Consolidated Fund in 2020 as set out in Appendix 2 – Summary Table 1 to the Report, which was inclusive of the proposed taxation and impôts duties changes outlined in the Government Plan, in line with Article 9(2)(a) of the Law, except that the Minister for Treasury and  Resource  was requested to publish an estimate of the effect on General Tax Revenue of decreasing the rate of GST levied on –
  1. solar panels;
  2. electric space heating replacement of oil heating;
  3. electric cars, motorbikes, scooters and vans;
  4. electric bikes and cargo bikes;
  5. loft and cavity wall insulation;
  6. double glazing; and
  7. installation of air and ground source heating to 0%, so that the Assembly could consider the financial effects of zero-rating those items in the Government Plan 2021; and
  1. approved each major project that was to be started or continued in 2020 and the total cost of each such project, in line with Article 9(2)(d), (e) and (f) of the Law and as set out in Appendix 2 – Summary Table 2 to the Report; and
  2. approved the proposed amount to be appropriated from the Consolidated Fund for 2020, for each head of expenditure, being gross expenditure less estimated income (if any), in line with Articles 9(2)(g), 10(1) and 10(2) of the Law and set out in Appendix 2 – Summary Tables 3(i) and (ii) of the Report, except that –
  1. in Summary Table 3(i) the Head of Expenditure for Reserve for centrally held items should be decreased by £1,400,000, with other affected lines in Summary Table 3(i) to be amended accordingly;
  2. to allow for greater investment in minor capital replacements within the Sport Division, £125,000 would be allocated to the division from within existing resources available to the Minister for Economic Development, Tourism, Sport and Culture, within Growth, Housing and Environment;
  1. in Summary Table 3(i) the  Head  of Expenditure  for Children,  Young People, Education and Skills should include an allocation of £106,000 to allow for the Youth Service to run a pilot scheme to engage with young people from communities with English as a second language, with, in the first instance, a focus on the Portuguese, Polish and Romanian communities; and requested the Minister for Treasury and Resources to investigate whether the additional spending could be funded from the Criminal Offences Confiscation Fund or other similar Fund if possible and, if not, then from existing resources;
  2. in Summary Table 3(i), the Expenditure and Head of Expenditure for Customer and Local Services should be increased by £41,374 by increasing the amount of the Food Costs Bonus to £258.25, with other affected lines in Summary Table 3(i) to be updated accordingly; and
  1. approved the estimated income, being estimated gross income less expenditure, that each States trading operation would pay into its trading fund in 2020 in line with Article 9(2)(h) of the Law and set out in Appendix 2 – Summary Table 4 to the Report; and
  2. approved the proposed amount to be appropriated from each States trading operation's trading fund for 2020 for each head of expenditure in line with Article 9(2)(i) of the Law and set out in Appendix 2 – Summary Table 5 to the Report; and
  3. approved –
  1. the establishment of a "Climate Emergency Fund", in accordance with the provisions of Article 6 of the Law, as set out at Appendix 3 to the Report; and
  2. the estimated income and expenditure proposals for the Climate Emergency Fund for 2020 as set out in Appendix 2 – Summary Table 6 to the Report; and
  1. approved the amounts to be transferred from one States fund to another for 2020 in line with Article 9(2)(b) as set out in Appendix 2 – Summary Table 7 to the Report, except that, in Summary Table 7, the transfer from Consolidated Fund to Stabilisation Fund should be amended to £28,000,000, with other affected lines in Summary Table 7 to be amended accordingly; and
  2. approved the estimated income and expenditure of the Social Security, Health Insurance and Long-Term Care Funds for 2020 set out in Appendix 2 – Summary Tables 8(i), (ii) and (iii) to the Report, except that, in Summary Table 8(iii), the income in the line entitled "Proposed changes to Long-Term Care Charge" should be reduced by £11,500,000 by reducing the proposed increase in contributions to the Long-Term Care Charge to 0.5%, with other affected lines in Summary Table 8(iii) to be updated accordingly; with –
    1. the estimated income to be raised from existing social security contributions defined in the Social Security Law and the proposed changes to contribution liability; and
    2. the estimated expenditure to be paid to support the existing benefits and functions defined in the Social Security Law, the Health Insurance Law and the Long-Term Care Funds and new benefits, if any, to be paid from the Funds; and
  1. agreed that the Justice and Home Affairs Department should increase the annual funding for the Island's 4 cadet force organisations to £20,000 each for the years 2020 to 2023; and
  2. approved, in accordance with Article 9(1) of the Law, the Government Plan 2020–2023, as set out at Appendix 4 to the Report except that, on page 111 of Appendix 4, after the words "prior to the debate of the Government Plan." there should be inserted the following words –

Draft Social Security (Amendment of Law No. 11) (Jersey) Regulations 201- P.110/2019

THE STATES commenced consideration of the Draft Social Security (Amendment of Law No. 11) (Jersey) Regulations 201- and adopted the principles.

THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, adopted Regulations 1 to 4.

THE STATES commenced consideration of Regulation 5 and, adopting an amendment of the Corporate Services Scrutiny Panel (P.110/2019 Amd.), agreed that, in the substituted paragraph 3(6)(b), for "for 2020 and ensuing years, 2%" there should be substituted the words "for 2020 and ensuing years, 1.5%".

THE STATES adopted Regulations 6 and 7.

THE STATES made Regulations entitled the Social Security (Amendment of Law No. 11) (Jersey) Regulations 2019 under Article 50 of the Social Security (Jersey) Law 1974.

Draft Finance (2020 Budget) (Jersey) Law 201- P.109/2019

THE STATES commenced consideration of the Draft Finance (2020 Budget) (Jersey) Law 201- and adopted the principles.

THE STATES, noting that in accordance with Standing Order 72(10) the draft Law could not be referred to any scrutiny panel, adopted Articles 1 to 11.

The Minister for Treasury and Resources did not propose Article 12, which dealt with the assessment of income.

THE STATES adopted Articles 13 and 14.

The Minister for Treasury and Resources did not propose Article 15, which dealt with appeals.

THE STATES commenced consideration of Articles 16 to 25 and, adopting part 1 of an amendment of the Minister for Treasury and Resources (P.109/2019 Amd.), agreed that, in Article 16, after Article 16(3) there should be inserted –

"(4) In Article 41I (late payment surcharge) –

(a)  for paragraph (1) there is substituted –

"(1) In this Article, "specified time" means, in relation to the year of assessment 2019

and ensuing years –

  1. midnight on 30th November of the year immediately following the year of assessment, except in a case such as specified in sub-paragraph (b);
  2. in the case of a large company within the meaning of Article 41AA(7), midnight on 30th September of the year immediately following the year of assessment.";
  1. for paragraph (2) preceding the proviso, there should be substituted –

"(2) If a person in relation to whom this Article applies does not pay in full, before

the specified time, the tax chargeable for a year of assessment on that person, the person shall be liable, whether or not an assessment has been served on the person, to pay an additional amount (the "surcharge") equal to 10% of such tax as remains unpaid at the specified time.";

  1. at the end there should be inserted –

"(10) This Article does not apply in relation to an individual person who is excepted

from the application of Article 41A, under paragraph (12)(a) of that Article."."; and

the existing paragraph (4) of Article 16 should be renumbered as (5).

THE STATES adopted Articles 16 to 25, as amended.

THE STATES commenced consideration of Articles 32 to 43 and, adopting part 2 of an amendment of the Minister for Treasury and Resources (P.109/2019 Amd.), agreed that, in Article 43(4) for "Article 41" there should be substituted "Article 39".

THE STATES adopted Articles 32 to 43, as amended.

THE STATES noted that the Bailiff , in accordance with Standing Order 75(4), had granted permission for a clerical error within the draft to be amended, namely the deletion of Article 43(3) and the renumbering of subsequent Articles accordingly, arising from the fact that Articles 27 to 30 had not been proposed.

THE STATES, subject to the sanction of Her Most Excellent Majesty in Council, adopted a Law entitled the Finance (2020 Budget) (Jersey) Law 201-.

THE STATES, in accordance with the provisions of Standing Order 80A, and in pursuance of Article 12 of the Public Finances (Jersey) Law 2019, declared that the Draft Law entitled the Finance (2020 Budget) (Jersey) Law 201- should immediately have effect as if it were a Law sanctioned by Her Majesty in Council.
