THE STATES, adopting a proposition of Senator Ian Joseph Gorst , in accordance with Standing Order 80, agreed to suspend Standing Order 32 in order that the amendment of the Minister for Health and Social Services (P.88/2020 Amd.) to the proposition of Deputy Kevin Glyn Pamplin of St. Saviour entitled Enhanced Covid-19 Exit Strategy Communication' (P.88/2020) and that the amendment of the Minister  for  Infrastructure  (P.89/2020  Amd.)  to  the  proposition  of   Deputy  John  Hilary  Young  of St. Brelade entitled Open Borders arrangements' (P.89/2020) might be listed for consideration at the present meeting; and further agreed in accordance with Standing Order 26(7), to reduce the minimum lodging period in respect of these two amendments and of the following propositions in order that they might all be debated at the present meeting –

Enhanced Covid-19 Exit Strategy Communication P.88/2020

THE STATES commenced consideration of a proposition of Deputy Kevin Glyn Pamplin of St. Saviour entitled Enhanced Covid-19 Exit Strategy Communication' (P.88/2020) and, adopting an amendment of the Minister for Health and Social Services (P.88/2020 Amd.), agreed that –

in paragraph (c), after the words "that the only" the words "Ministers or" should be deleted; after the words "responsibility for scientific," there should be inserted the word "technical,"; and after the words "or medical matters" there should be inserted the words ", or people invited by the Chair to assist with a specific matter"; and

in paragraph (e), after the words "weekly press conference" there should be inserted the words ", briefing or engagement" and after the words "should be held" there should be inserted the word ", including".

THE STATES resumed consideration of the proposition of Deputy Kevin Glyn Pamplin of St. Saviour , as amended, and, adopting the proposition –

  1. agreed that a dedicated page on gov.je should be established and maintained for the Scientific and Technical Advisory Cell for the publication of the Cell's membership, its minutes, the evidence considered by the Cell at its meetings and the data and recommendations produced by the Cell for the Government of Jersey;
  2. agreed that the minutes of the meetings of the Scientific and Technical Advisory Cell, its membership and appointment processes, the evidence considered by the Cell and the data and recommendations which it produced, should regularly be provided to the relevant Scrutiny Panels;
  3. agreed that the only Government officials authorised to attend meetings of the Scientific and Technical Advisory Cell should be those with responsibility for scientific, technical, health or medical matters, or people invited by the Chair to assist with a specific matter;
  4. agreed that the results of the Test, Track and Trace' undertaken by the Government of Jersey should be published and updated on a weekly basis on a dedicated page on gov.je, alongside any recommended isolation periods that applied in the event of a positive test for Covid-19 and any threshold applied by the Government for introducing a self-isolation measure for all new arrivals on the basis of turnaround times for test results;
  1. agreed that a weekly press conference, briefing or engagement should be held, including by the Chief Minister, and other Ministers, Government officials and technical experts (as required) to update Islanders on the implementation of the Covid-19 Strategy and the Safer Travel Policy; and
  2. requested the Chief Minister to take the necessary steps to ensure these measures were in place by 1st August 2020.

Open Borders arrangements P.89/2020

THE STATES commenced consideration of a proposition of Deputy John Hilary Young of St. Helier and, adopting an amendment of the Chief Minister (P.89/2020 Amd.), agreed that –

in paragraph 1(a), after the words "all persons" there should be inserted the words "who opt-in to the border testing programme" and, after the words "untested persons should", the words "be held in isolation" should be substituted for the word "isolate";

in paragraph 1(b), after the words "that persons entering our borders" there should be inserted the words "from amber or red category countries, as defined in the safer travel policy guidance,"; after the words "travel pre-registration" for the word "until" there should be substituted the words "for the timeframe stipulated in the guidance including if"; after the words "they have received" there should be inserted the word "earlier"; and after the words "negative PCR test result" there should be inserted the words ", and confirm in their declaration how they will be travelling directly to that accommodation";

after paragraph 1(c), there should be inserted the following new paragraph –

"(d) that persons arriving in Jersey should not visit any hospital, residential care home,

nursing home, domiciliary care setting or the prison, or visit anyone at high risk of Covid-19, until they have completed their required period of self-isolation and/or received a negative PCR test result;";

in paragraph 2, after the words "to request the Minister for" for the words "Infrastructure to arrange with" there should be substituted the words "Health and Social Services to issue guidance to"; after the words "and other private" there should be inserted the word "transport"; after the words "operators to" for the words "make available appropriate transport" there should be substituted the words "enable safe"; and after the words "to limit infection risks" there should be inserted the words ", including the wearing of facemasks"; and

in paragraph 4, after the words "the Minister may introduce additional" there should be inserted the words "or alternative".

THE STATES resumed consideration of the proposition of Deputy John Hilary Young of St. Brelade , as amended, and, adopting the proposition –

  1. requested the Ministers for Home Affairs and Health and Social Services to ensure that the arrangements and processes now in operation to open the Island's borders to persons from outside the Bailiwick of Jersey were made as safe and effective as possible in protecting the Island's community from the importation of the Covid-19 infection, and, in order to achieve this aim, requested that the following additional measures were introduced with immediate effect –
  1. all persons who opted in to the border testing programme should receive a PCR test on entry to the Island's borders and in the event of the capacity of the testing facility being exceeded by the number of persons arriving at any one-time, untested persons should isolate until tested;
  2. that persons entering the Island's borders from amber or red category countries, as defined in the safer travel policy guidance, should be required to self-isolate in the accommodation which they declared in their travel pre- registration for the timeframe stipulated in the guidance including if they had received earlier notification of a negative PCR test result, and confirm in their declaration how they would be travelling directly to that accommodation;
  1. during the period of self-isolation required under paragraph (b) –
  1. persons should be required to travel directly to their accommodation and not break their journey, and
  2. persons should be advised to travel to their accommodation by private vehicle if possible or otherwise travel by public transport;
  1. that persons arriving in Jersey should not visit any hospital, residential care home, nursing home, domiciliary care setting or the prison, or visit anyone at high risk of Covid-19, until they had completed their required period of self-isolation and/or received a negative PCR test result;
  1. requested the Minister for Health and Social Services to issue guidance to the bus and other private transport operators to enable safe arrangements for persons requiring to self-isolate, when arriving at the airport or harbour, to limit infection risks, including the wearing of facemasks;
  2. requested the Minister for Health and Social Services to issue guidance to operators of registered tourist accommodation to manage the accommodation provided for those persons required to self-isolate to limit the risk of the infection entering the community; and
  3. agreed that these arrangements should remain in place for a minimum of 6 weeks and, after that point, could be renewed by a decision of the Minister for Health and Social Services; and  the  Minister  could introduce additional or alternative  measures  at any  point if he considered that the risk of infection require it.

States of Jersey Development Company-Amendments to the Board of Directors and Articles of Association P.70/2020

THE STATES commenced consideration of a proposition of the Minister for Treasury and Resources entitled States of Jersey Development Company-Amendments to the Board of Directors and Articles of Association' (P.70/2020) and, adopting the proposition –

  1. approved the following appointments and extensions under Article 21(b) of The States of Jersey Development Company Limited's Memorandum and Articles of Association –
  1. Paul Masterton as Chairman of the Company with effect from approval by the States Assembly, in accordance with the Memorandum and Articles of Association, to take effect from the delivery to the Company of the notice referred to in paragraph (e) below;
  2. an extension to the term of office of Paul Masterton as a non-executive director until 20th December 2023 in accordance with the Memorandum and Articles of Association, to take effect from the delivery to the Company of the notice referred to in paragraph (e) below;
  3. an extension to the term of office of Ann Santry as a non-executive director until 20th December 2022 in accordance with the Memorandum and Articles of Association, to take effect from the delivery to the Company of the notice referred to in paragraph (e) below;
  4. Nick Winsor as a non-executive director of the Company with effect from approval by the States Assembly, in accordance with the Memorandum and Articles of Association, to take effect from the delivery to the Company of the notice referred to in paragraph (e) below; and

authorised the Greffier of the States for and on behalf of the States of Jersey to deliver a notice to The States of Jersey Development Company Limited in accordance with Article 21(b) of the Memorandum and Articles of Association to give effect to such appointments and extensions; and

  1. approved the passing of a Special Resolution of the Company to amend Articles 23 and 29 of the Articles of Association of the Company to provide that directors might serve for a period up to 3 years and that the number of directors should be a minimum of 3 States Appointees and a maximum of 5 States Appointees and authorised the Greffier of the States for and on behalf of the States to deliver a notice to The States of Jersey Development Company Limited in accordance with Article 21(b) of the Memorandum and Articles of Association to give effect to such Special Resolution.
