In accordance with the provisions of Standing Order 117(2), the Chief Minister nominated Deputy Jeremy Martin Maçon of St. Saviour as Minister for Children and Housing.

In accordance with Standing Order 117(5), the candidate made a speech and was questioned. Once the period of questions had concluded, there being no other nominations, the Bailiff declared that Deputy Jeremy Martin Maçon of St. Saviour had been duly elected as Minister for Children and Housing.

THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, commenced consideration of Regulations 1 to 6 and, adopting an amendment of the Minister for Social Security (P.124/2020 Amd.), agreed that, after Regulation 3(7)(b), there should be inserted following sub-paragraph –

"(c) for sub-paragraph (2)(b) there is substituted –

"(b) the expression "relevant quarter" means the previous quarter but one before the quarter in which it is expected that the relevant person's child will be born or adopted." ".

Our Hospital Site Selection: Overdale P.123/2020

THE STATES commenced consideration of a proposition of the Council of Ministers entitled Our Hospital Site Selection: Overdale' (P.123/2020) and, adopting an amendment of the Connétable of St. Helier (P.123/2020 Amd.(2)), agreed that, at the beginning of the proposition, there should be inserted the following paragraph –

"(a) to request the Council of Ministers, prior to its acquisition of land or properties required to

facilitate access to the preferred site for Jersey's new hospital, to present to the States Assembly for approval a report on alternative access strategies designed to maximize sustainable modes of travel to and from the new hospital, and to minimize the impact on homes, leisure facilities and the surrounding environment of the access interventions currently proposed;"

and that the existing paragraph should be re-designated as paragraph (b).

THE STATES, resuming consideration of the proposition of the Council of Ministers, as amended, commenced consideration of an amendment of the Future Hospital Review Panel (P.123/2020 Amd.), and rejected an amendment of the Council of Ministers (P.123/2020 Amd.Amd.) that in paragraph (b), for the words  "Outline Business Case" there should be substituted the words  "financing strategy"; that in paragraph (b)(ii), after the words "a statement" for the words "by clinical specialty that senior clinical representatives have agreed and signed off their respective departments" there should be substituted the words "that the Associate Medical Directors for Scheduled Care, Unscheduled Care, Mental Health and Primary Care have agreed and signed off operational areas for Our Hospital that fall under their respective care groups".

THE STATES resumed consideration of the proposition of the Council of Ministers, as amended, and, adopting the amendment of the Future Hospital Review Panel, agreed that the existing paragraph should be designated as paragraph (a) and that the following paragraph should be inserted –

"(b) to request the Council of Ministers to present a report to the States prior to lodging any

proposition seeking the Assembly's approval of the Outline Business Case for the new Hospital, to contain the following –

  1. the performance detail from the demand-modelling with all key demand and capacity assumptions linked to the sizing of the new hospital and how this links to the role and function of health facilities as set out in the Jersey Care Model;
  2. a statement by clinical specialty that senior clinical representatives have agreed and signed off their respective departments, both room areas via the Schedule of accommodation, and drawings that match the latest hospital plans;
  3. the proposed hospital total area including all main hospital street communication corridors, department circulation and non-roof plant, in order to provide a total inclusive Schedule of Accommodation;
  4. the calculations for all project cost including non-works costs, equipment costs, non- medical costs (including the whole life transport solution), inflation, optimism bias, a clear split of all project contingencies, the premium costs for materials and confirmation that all "current exclusion" are subject to at least the latest provisional sums;
  5. an analysis that the aligned programme has taken account of both the programme impact, Covid-19 and Brexit;
  6. a full breakdown of the assumptions and amounts for recurring savings supporting the overall affordability of the project for both capital and clinical/support revenue; and
  7. forecast Cost at Completion, broken down into components identified in Paragraph 6 of the report accompanying this proposition."

Our Hospital Project: acquisition of land for the new hospital at Overdale P.129/2020

THE STATES resumed consideration of a proposition of the Council of Ministers entitled Our Hospital Project: acquisition of land for the new hospital at Overdale' (P.129/2020) and, adopting the proposition –

  1. approved  the  acquisition by the  Public  of the  land and  properties required  to deliver the Our Hospital project at Overdale Hospital, including, where appropriate land or property to accommodate the hospital buildings and their reasonable curtilage and any other properties to facilitate access to the site as identified in the relevant drawing for the adopted site in Appendix 1;
  2. agreed to negotiate with the owners for the purchase of the said land and properties at a fair and proper price to be agreed by the Minister for Infrastructure;
  3. agreed, in principle, that the Minister for Environment should be empowered, in exercise of the powers conferred by Article 119 of the Planning and Building (Jersey) Law 2002 and subject only to the approval of requisite funding, to acquire the land and any interest therein by compulsory purchase on behalf of the Public in accordance with the provisions of the Compulsory Purchase of Land (Procedure) (Jersey) Law 1961; and
  1. authorised the Attorney General and the Greffier of the States on behalf of the Public to pass any necessary contracts in connection with the acquisition and subsequent sale of the site and adjoining land.
