THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, commenced consideration of Regulations 1 to 9 and, adopting an amendment of the Economic and International Affairs Scrutiny Panel, agreed that, in Regulation 7 –
after the inserted Regulation 35A(8) there should be inserted –
"(9) Paragraph (10) applies to any information (including any document or answer) that –
- is obtained by the Board under this Regulation;
- is not also obtained under Regulation 16, or held for the purpose of paying compensation or verifying a claim for compensation; and
- consists of or includes personal data, within the meaning of the Data Protection (Jersey) Law 2018, relating to a person as a depositor of a bank other than a bank in default.
- The Board must –
- as soon as is practicable after obtaining the information, encrypt it if it is not already encrypted; and
- ensure that it is encrypted at all times at which it –
- is held by or on behalf of the Board, and
- is not in use for a purpose that requires it to be temporarily decrypted.
- For the purposes of the Data Protection (Jersey) Law 2018 and the Data Protection Authority (Jersey) Law 2018, a contravention of paragraph (10) is to be treated as also being a contravention of Articles 8(1) and 21(1) of the Data Protection (Jersey) Law 2018.
- Paragraphs (10) and (11) are in addition to, and are not to be read as derogating from, any duty imposed on the Board by or under the Data Protection (Jersey) Law 2018 (and
in particular by Article 8(1)(f), or Article 21(1) as read with Article 21(2)(a), of that Law) or by any other law."; and
for the inserted Regulation 35B(2)(b) there should be substituted –
"(b) to the Minister, if the information –
- concerns the administration or operation of the scheme, and
- does not consist of or include personal data, within the meaning of the Data Protection (Jersey) Law 2018, relating to a person as a depositor;".

Draft Rehabilitation of Offenders (Exceptions) (Amendment No. 2) (Jersey) Regulations 201- P.104/2019
THE STATES resumed consideration of the Draft Rehabilitation of Offenders (Exceptions) (Amendment No. 2) (Jersey) Regulations 201-, the principles having been adopted on 12th November 2019, and adopted Regulations 1 and 2.
THE STATES made Regulations entitled the Rehabilitation of Offenders (Exceptions) (Amendment No. 2) (Jersey) Regulations 2020 under Articles 8(5) and 10(3) of the Rehabilitation of Offenders (Jersey) Law 2001.
Public Elections: declaration of donations exceeding the current threshold for declaration in law P.120/2019
THE STATES commenced consideration of a proposition of the Connétable of St. Martin entitled Public Elections: declaration of donations exceeding the current threshold for declaration in law' (P.120/2019) and, adopting an amendment of the Privileges and Procedures Committee, agreed that, at the beginning of both paragraphs (a) and (b) there should be inserted the words "subject to public consultation"; and that, in paragraph (c) after the word "Committee" there should be inserted the words "to incorporate these matters in its forthcoming consultation on election expenditure and, subject to the outcome of the consultation,".

THE STATES, adopting the proposition of the Connétable of St. Martin , as amended, agreed –
- subject to public consultation, to make it a legal requirement for donations received by election candidates and third parties in elections which exceeded the current threshold for declaration in the law (£120) to be declared and made publicly available (including online) within 2 days of receipt;
- subject to public consultation in relation to donations to political parties of, or worth, £120 and above –
- that the name of the donor and the value of such donations should be declared to the Judicial Greffier within one week of receipt;
- that the Greffier should maintain a register, published online and available otherwise for public inspection, showing all of the information declared in respect of each donation to each party; and
- that anonymous donations should be treated in the same way as anonymous donations were currently treated under the Public Elections (Expenditure and Donations) (Jersey) Law 2014; and
- to request the Privileges and Procedures Committee to incorporate these matters in its forthcoming consultation on election expenditure and, subject to the outcome of the consultation, to bring forward for approval the changes to legislation necessary to give effect to this proposition.

THE STATES commenced consideration of the Draft Employment (Minimum Wage) (Amendment No. 16) (Jersey) Regulations 201- and adopted the principles.
THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, adopted Regulations 1 and 2.
THE STATES, having consulted with the Employment Forum, made Regulations entitled the Employment (Minimum Wage) (Amendment No. 16) (Jersey) Regulations 2020 under Articles 17 and 104 of the Employment (Jersey) Law 2003.
