Tribute to the late Mr. Malcolm Pollard, former member of the States

The Minister for Economic Development, Tourism, Sport and Culture answered questions without notice from members.

The Minister for the Environment answered questions without notice from members.

A period of questions without notice was held, during which questions were permitted to any Minister on any subject within the official responsibility of the Government of Jersey.

Changes in Presidency

The Bailiff retired from the Chamber during the period of questions without notice to any Minister on any subject within the official responsibility of the Government of Jersey and the meeting continued under the Presidency of Dr. Mark Egan, Greffier of the States. The Bailiff returned to the Chamber during the same period of questions without notice and the meeting continued under his Presidency.

Arrangement of public business for the present meeting

THE STATES noted that the Minister for Economic Development, Tourism, Sport and Culture had informed the Greffier, in accordance with Standing Order 30(2), that the Draft Shops (Regulation of Opening) (Amendment General Practitioner Surgeries  and Pharmacies) (Jersey) Regulations 202- would be deferred from the present meeting to the meeting of 6th October 2020.

Senators and Deputies: removal of citizenship requirement P.75/2020

THE STATES commenced consideration of a proposition of Deputy Montfort Tadier of St. Brelade entitled Senators and Deputies: removal of citizenship requirement' (P.75/2020) and, adopting an amendment of Deputy Montfort Tadier of St. Brelade (P.75/2020 Amd.), agreed that –

in paragraph (a), for the words "Senators and Deputies" there should be substituted the words "Senators, Connétable s and Deputies";

after  paragraph (a), there should be  inserted the following new paragraph and  the  subsequent paragraph re-designated accordingly –

"(b) that a person should have a continuous period of residence of 5 years, and be "entitled for

work" under Regulation 4(2)(a) of the Control of Housing and Work (Residential and Employment Status) (Jersey) Regulations 2013, to be eligible to stand for election as a Senator, Connétable or Deputy ;"; and

in paragraph (b), after the words "States of Jersey Law 2005" there should be inserted the words "and the Connétable s (Jersey) Law 2008; and".

THE STATES, resuming consideration of the proposition of Deputy Montfort Tadier of St. Brelade , as amended, commenced consideration of an amendment of Senator Ian Joseph Gorst (P.75/2020 Amd.(3)) and, adopting part 1 of the amendment, agreed that for paragraph (a), there should be substituted the following paragraph –

"(a) that the requirement that Senators, Connétable s and Deputies must be British citizens should

be replaced by a requirement that they must be British or Irish citizens, or qualifying citizens of a Commonwealth or European Union country;".

THE STATES noted that, following the adoption of the amendment of Deputy Montfort Tadier of St. Brelade (P.75/2020 Amd.), part 2 of the amendment of Senator Ian Joseph Gorst (P.75/2020 Amd.(3)) was deemed to have been withdrawn.

THE STATES resumed consideration of the proposition of Deputy Montfort Tadier of St. Brelade , as amended, and, adopting an amendment of Deputy Michael Roderick Higgins of St. Helier (P.75/2020 Amd.(2)), agreed that, before paragraph (b), re-designated as paragraph (c), there should be inserted the following new paragraph and the subsequent paragraph re-designated accordingly –

"(c) that, for a person who is Jersey-born, there should be no requirement to have been ordinarily

resident in Jersey for a set period of time prior to election day to be eligible for election to the States;".

THE STATES resumed consideration of the proposition of Deputy Montfort Tadier of St. Brelade , as amended.

THE STATES adjourned, having agreed to reconvene on Wednesday 23rd September 2020 to continue consideration of the proposition of Deputy Montfort Tadier of St. Brelade entitled Senators and Deputies: removal of citizenship requirement' (P.75/2020), as amended, and the other outstanding items of public business listed for the meeting.
