THE STATES made Regulations entitled the Taxation (Implementation) (International Tax Compliance) (Mandatory Disclosure Rules for CRS Avoidance Arrangements and Opaque Offshore Structures) (Jersey) Regulations 2020 under Article 2 of the Taxation (Implementation) (Jersey) Law 2004, and following the decision of the States, taken on the day these Regulations are made, to adopt P.129/2019.

Changes in Presidency

Dr. Mark Egan, Greffier of the States, retired from the Chair prior to consideration of the Draft Taxation (Implementation) (International Tax Compliance) (Mandatory Disclosure  Rules for CRS Avoidance Arrangements and Opaque Offshore Structures) (Jersey) Regulations 202- and the meeting continued under the Presidency of the Bailiff .

First Tower Park: protection from States' development P.92/2020

THE STATES noted that, in accordance with Standing Order 34(1), the Connétable of St. Helier had informed the Greffier of the States that his proposition entitled First Tower Park: protection from States' development' (P.92/2020) had been withdrawn.

Les Ecréhous and Les Minquiers: prohibition of the landing of domestic animals P.94/2020

THE STATES commenced consideration of a proposition of the Connétable of St. Martin entitled Les Ecréhous and Les Minquiers: prohibition of the landing of domestic animals' (P.94/2020) and, commencing consideration of an amendment of the Connétable of Grouville (P.94/2020 Amd.), adopted an amendment of the Deputy of St. Martin (P.94/2020 Amd.Amd.) that, in paragraph (a)(ii), after the word "power" there should be inserted the words ", after consultation with the relevant Scrutiny panel,". THE STATES, adopting the amendment of the Connétable of Grouville , as amended, agreed that –

the existing paragraph should be designated as paragraph (a); after the words "to bring forward" there should be inserted the word "primary"; and for the words "to prohibit the landing of dogs or other domestic animals at any time on Les Ecréhous and Les Minquiers" there should be substituted the words "to provide –

  1. a framework for the restriction of certain activities on Les Ecréhous and Les Minquiers to include, but not be limited to, prohibiting the landing of dogs and other domestic animals, as well as anything else which the Minister for the Environment considers might cause disturbance to wildlife; and
  2. the Minister for the Environment with the power, after consultation with the relevant Scrutiny panel, to implement specific restrictions by Order."; and

after the newly-designated paragraph (a), there should be inserted the following new paragraph –

"(b) to request the Minister for the Environment to make an Order without delay (once the

primary legislation is in force) to prohibit the landing of dogs and other domestic animals on Les Ecréhous at any time."

THE STATES adopting the proposition of the Connétable of St. Martin , as amended –

  1. requested the Minister for the Environment to bring forward primary legislation to provide –
  1. a framework for the restriction of certain activities on Les Ecréhous and Les Minquiers to include, but not be limited to, prohibiting the landing of dogs and other domestic animals, as well as anything else which the Minister for the Environment considered might cause disturbance to wildlife; and
  2. the Minister for the Environment with the power, after consultation with the relevant Scrutiny panel, to implement specific restrictions by Order.
  1. requested the Minister for the Environment to make an Order without delay (once the primary legislation was in force) to prohibit the landing of dogs and other domestic animals on Les Ecréhous at any time.

THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, commenced consideration of Regulations 1 to 7 and, adopting an amendment of the Minister for Social Security (P.96/2020 Amd.), agreed that –

after Regulation 5, there should be inserted –

"6 Non-application to calculation of a deduction from income for the purposes of the Income

Support (General Provisions) (Jersey) Order 2008

Regulations 2, 3, 4 and 5 are to be treated as not applying to Class 1 and 2 contributions when construing the reference to the Social Security (Jersey) Law 1974 in paragraph 4(1)(c)(i) of Schedule 2 to the Income Support (General Provisions) (Jersey) Order 2008 for the purpose of calculating a deduction from income under that paragraph.";

Regulation 6 should be renumbered as Regulation 7; and

Regulation 7 should be renumbered as Regulation 8.
