THE STATES, with reference to their Act dated 14th September 2021, in which they had agreed that, notwithstanding Standing Order 55A(1), members who did not wish to attend in the States Chamber might continue to take part in States meetings using Microsoft Teams (until the States had considered and voted upon a proposition to re-apply Standing Order 55A(1) or to repeal or vary the terms of the Standing Order), assembled in accordance with Standing Order 55A with members able to participate remotely using Microsoft Teams.

THE STATES, resuming consideration of a proposition of the Minister for the Environment entitled Island Plan 2022-25: Approval' (P.36/2021), as amended, resumed consideration of an amendment of the Minister for the Environment (P.36/2021 Amd.(91)), as amended, and, adopting paragraph (a), agreed that, after the words "the draft Island Plan 2022-25", there should be inserted the words "except that –

  1. the following should be removed from the list of sites to be zoned for affordable homes in Policy H5 – Provision of affordable homes –

THE STATES, adopting paragraphs (b), (c) and (d) of the amendment of the Minister for the Environment, as amended, agreed that, after the words "the draft Island Plan 2022-25", there should be inserted the words "except that –

  6. P558 La Verte Rue, St. Peter , to be brought forward as part of a comprehensive scheme with P559 and P632
  7. P559 La Route du Manoir, St. Peter , to be brought forward as part of a comprehensive scheme with P558 and P632
  1. in Appendix 1 – Affordable housing site assessments, from page 325 of the Draft Bridging Island Plan –
  1. the assessments for those sites listed in paragraph (a) should be removed.; and
  2. initial assessments, as set out in Appendix 1 to the amendment of the Minister for the Environment, for those sites listed in paragraph (b) should be added; and
  1. the Draft Bridging Island Plan Proposals Map Part A – Planning Zones should be amended to reflect the adoption of paragraph (a) and (b).".

THE STATES noted that, in accordance with the provisions of Standing Order 106, Deputy Russell Labey of St. Helier declared an interest in the subject of the amendment of the Minister for the Environment (P.26/2021 Amd.(91)) to the proposition of the Minister for the Environment, in that Field 558, between Rue des Sapins and La Verte Rue in St. Peter , was farmed by a relative and he did not vote on the amendment.

THE STATES noted that, in accordance with the provisions of Standing Order 106, Senator John Alexander Nicholas Le Fondré declared an interest in the subject of the amendment of the Minister for the Environment (P.36/2021 Amd.(91)) to the proposition of the Minister for the Environment, in that Field MY563 in La Rue de la Rosière and La Rue de la Vallée, St. Mary , belonged to an organisation of which he was a trustee and he did not vote on the amendment.

"1. Field G392A Grouville (0.75 hectares/4.2 vergées)";

  1. the draft Island Plan 2022-25 should be further amended in such respects as may be necessary consequent upon the adoption of paragraph (a); and
  2. the Draft Bridging Island Plan Proposals Map Part A – Planning Zones should be amended to reflect the adoption of paragraph (a)."

Relationship between twelfth and seventy-eighth amendments to Island Plan 2022-25: Approval' (P.36/2021) – ruling by the Deputy Bailiff

The Deputy Bailiff made the following ruling regarding the relationship between the amendment of the Connétable of St. Helier (P.36/2021 Amd.(12)) and the amendment of Deputy Stephen Morrison Ahier of St. Helier (P.36/2021 Amd.(78)) to the proposition of the Minister for the Environment entitled Island Plan 2022-25: Approval' (P.36/2021) –

"Members will recall, prior to the adjournment I indicated I was going to give a ruling in relation to the effect of the debate on the 12th amendment on the next amendment listed for debate, namely the 78th amendment. If amendment 12 is adopted, the effect will be that the field in question is no longer zoned for affordable housing. In those circumstances, my ruling is that amendment 78 may be debated but only as to parts (b), (c) and (d) of the proposition as (a) will have just been adopted by the Assembly. If amendment 12 is rejected, and the effect of which is that the field remains zoned for affordable housing, then amendment 78 may also be debated but must be voted on as a whole as it would offend Standing Order 20 to vote on part (a) separately. So, whatever the outcome of this debate, Members will be able to debate amendment 78."

  1. within  Policy  H6,  after  the  first  paragraph  there  should  be  inserted  the  following  new paragraph – "The following site should be specifically zoned for the provision of purpose-built fully-accessible homes for people with disabilities, and its development for any other use will not be supported:

Field H1219, La Grande Route de Mont a L'Abbé, St. Helier (1.20 hectares/6.6 vergées)";

  1. the draft Island Plan 2022-25 should be further amended in such respects as may be necessary consequent upon the adoption of (b); and
  2. the Draft Bridging Island Plan Proposals Map Part A – Planning Zones should be amended to reflect the adoption of (b)."
