THE STATES, with reference to their Act dated 14th September 2021, in which they had agreed that, notwithstanding Standing Order 55A(1), members who did not wish to attend in the States Chamber might continue to take part in States meetings using Microsoft Teams (until the States had considered and voted upon a proposition to re-apply Standing Order 55A(1) or to repeal or vary the terms of the Standing Order), assembled in accordance with Standing Order 55A with members able to participate remotely using Microsoft Teams.

THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, commenced consideration of Articles 1 to 21 and, adopting an amendment of  the  Minister  for  External  Relations  and  Financial  Services  (P.53/2022  Amd.),  agreed  that,  in Article 5(d),  in  the  inserted  paragraph  (7)(b),  for  "designated  under"  there  should  be  substituted "designated (whether by name, description or otherwise, and under whatever procedure) under".

Havre des Pas Lido P.61/2022

THE STATES commenced consideration of a proposition of the Connétable of St. Helier entitled Havre des Pas Lido' (P.61/2022) and, adopting an amendment of the Minister for Infrastructure (P.61/2022 Amd.), agreed that, in paragraph (a), after the words "Property Holdings Department," there should be inserted ", in consultation with the steering groupestablished in paragraph (b)," and the word "maintaining" should be replaced with "includingto make reasonable endeavours to maintain".

THE STATES, adopting the proposition of the Connétable of St. Helier , as amended, requested the Minister for Infrastructure –

  1. to ensure that the Property Holdings Department, in consultation with the steering groupestablished in paragraph (b),upheld its full obligations as landlord of the Lido at Havre des Pas with immediate effect, includingto make reasonable endeavours to maintain the facility as watertight in respect of rainwater penetration through the roof (barring extremes of weather)

and ensuring that the public toilets at the pool were available all year round;

  1. to establish a steering group to maximise the benefit of the Lido to the community and to resolve any issues arising in future, with the steering group to meet quarterly and its

membership to include political representation from the Parish of St. Helier ; and  

  1. to initiate negotiations with the current operator of the Lido facility for a new 9-year lease, with standard break clauses.

Accommodation for temporary workers P.62/2022

THE  STATES  commenced  consideration  of  a  proposition  of  the   Deputy  of  St.  Peter  entitled Accommodation for temporary workers' (P.62/2022) and, adopting an amendment of the Deputy of St. Peter , (P.62/2022 Amd.), agreed that, in paragraph (d), for "Minister for Housing and Communities" there should be substituted "Council of Ministers" and for "September 2022" there should be substituted "December 2022".

THE STATES rejected paragraphs (a) to (c) of the proposition of the Deputy of St. Peter , as amended –

  1. that appropriate sites in the Island should be identified and made available for the provision of temporary accommodation to house between 200 and 500 temporary workers;
  2. to  request  the  Minister  for  Economic  Development,  Tourism,  Sport  and  Culture  and  the Minister for Treasury and Resources to initiate discussions with Jersey businesses in order that potential  sources  of  private  funding  for  the  provision  of  such  accommodation  may  be identified;
  3. to request the Minister for the Environment to issue the necessary instructions, including any law-drafting instructions required, to ensure that planning permission may be granted to an application for the construction of such accommodation, provided that any such permission would be granted on the basis that the accommodation would be used for a maximum of 3 years; and

THE STATES noted that, in accordance with the provisions of Standing Order 106, Senator Lyndon John Farnham and the Connétable of St. Clement declared an interest in the subject of the proposition of the Deputy of St. Peter entitled Accommodation for temporary workers' (P.62/2022) in that they had a connection to the hospitality industry.

THE STATES rejected a proposition of Senator Sarah Craig Ferguson entitled Suspension of drive to Net Zero'' (P.70/2022) to refer to their Act dated 26th February 2020, in which they had adopted the defining principles for the Carbon Neutral Strategy, and, in view of the uncertainty surrounding fuel costs following the United Kingdom's decision to stop buying Russian oil and gas and the impact of any subsequent rise in costs of these supplies and the effects on lower-income families, middle earners and local businesses, to request the Government of Jersey to suspend the drive to Net Zero' until the war in Ukraine and the uncertainty were resolved.

The Chair of the Privileges and Procedures Committee referred to the impending departure from office of the Greffier of the States, Dr. Mark Egan, and thanked him on behalf of the States for his exemplary services to the Assembly.
