THE STATES, with reference to their Act dated 14th September 2021, in which they had agreed that, notwithstanding Standing Order 55A(1), members who did not wish to attend in the States Chamber might continue to take part in States meetings using Microsoft Teams (until the States had considered and voted upon a proposition to re-apply Standing Order 55A(1) or to repeal or vary the terms of the Standing Order), assembled in accordance with Standing Order 55A with members able to participate remotely using Microsoft Teams.

Senator Samuel Yves Mézec asked the following question of the Minister for Treasury and Resources which the Bailiff had allowed in accordance with Standing Order 15 relating to urgent oral questions –
"Given the Assembly adopted the first amendment to the Government Plan 2022-25, which agreed to reduce the social housing rental cap from 90% of the market rate to 80% from 1st January this year, why does the new Memorandum of Understanding (published in R.56/2022) state that the rent policy is still to charge 90% of the market rate?"
Channel Islands Lottery: Allocation of 2021 proceeds P.68/2022
THE STATES, adopting a proposition of the Minister for Economic Development, Tourism, Sport and Culture entitled Channel Islands Lottery: Allocation of 2021 proceeds' (P.68/2022) –
- agreed, in accordance with the provisions of Regulation 4(5) of the Gambling (Channel Islands Lottery) (Jersey) Regulations 1975, to allocate £977,709 to the Jersey Community Foundation and the Association of Jersey Charities, divided equally between them, for onward distribution in support of the Island community; and
- agreed that the proceeds allocated to the Association of Jersey Charities should be distributed solely to registered charities, and that the allocation to the Jersey Community Foundation should be distributed on the following basis –
- 40% of the allocation to arts, culture and heritage;
- 40% of the allocation to sports and active lifestyle; and
- 20% of the allocation to applied science or applied research in the fields of engineering, biology, ecology, physics, chemistry or mathematics, provided that the funds were either to be used locally or for the direct benefit of Jersey, including any education from which local residents might benefit.

Public Sector Employment Contracts P.71/2022
THE STATES commenced consideration of a proposition of Deputy Michael Roderick Higgins of St. Helier entitled Public Sector Employment Contracts' (P.71/2022) and, adopting an amendment of Deputy Michael Roderick Higgins of St. Helier (P.71/2022 Amd.), agreed that –
in paragraph (a), the words "1st July 2022" should be replaced with "1st September 2022"; and in paragraph (c), the words "30th June 2022" should be replaced with "31st August 2022".
THE STATES resumed consideration of the proposition of Deputy Michael Roderick Higgins of St. Helier , as amended, and rejected paragraph (a) of the proposition that contracts of employment for all States' employees from 1st September 2022 should explicitly prohibit the following and confirm, for the avoidance of doubt, that such acts constituted acts of gross misconduct –
- lying, obstructing, misleading or attempting to mislead a Minister, the States Assembly, any Scrutiny Panel or "Backbench" Member of the States of Jersey about any aspect of the employee's work for the States;
- covering up or concealing any failure (act or omission) on the employee's part alone, or together with others, or on the part of others that they have become aware of at any time, on any matter, that could financially damage or bring the States of Jersey and/or the Government of Jersey into disrepute; and
that such lying, obstructing, misleading and covering up should be punishable by termination of their employment without any compensation or compromise agreements, pension rights or bonuses depending upon the severity of the offence they have committed.

THE STATES rejected paragraph (c) of the proposition of Deputy Michael Roderick Higgins of St. Helier that an amnesty up to 31st August 2022 should be implemented during which period employees could own up to any past lies, obstructions, misleading statements, and cover-ups (unless of a criminal nature) and / or knowledge of acts or omissions of others, with the employees concerned to face no loss of employment, grade, position, pension rights, bonuses, compensation agreements unless they committed a future act of a similar nature or failed to fully declare any past transgressions that were being addressed by this proposition.

Carbon Neutral Roadmap P.74/2022
THE STATES commenced consideration of a proposition of the Minister for the Environment entitled Carbon Neutral Roadmap' (P.74/2022) and, adopting an amendment of Deputy Robert James Ward of St. Helier (P.74/2022 Amd.(2)), agreed that –
in Paragraph (a), after the words "report accompanying the proposition" there should be inserted the words ", except that, within the Carbon Neutral Roadmap as set out in the Appendix –
- on page 76, in the row relating to TR1, the figure "£6,255,000" should be replaced with the figure "£4,855,000"; and the words "1,600 electric vehicle incentives" replaced with "1,200 electric vehicle incentives";
- on page 77, in the row relating to TR10, the figure "£300,000" should be replaced with the figure "£1,700,000";
- on page 87, in the row relating to TR1, in the "deliverables" column, the figure "1,600" should be replaced with "1,200", and, in the 4-year budget column, the figure "£5,734,000" should be replaced with "£4,334,000"; and
- on page 88, in the row relating to TR10, in the "deliverables" column, the word "n/a" should be replaced with "provide strong start on the active travel items detailed in the Carbon Neutral Roadmap", and, in the 4-year budget column, the words "£300,000" should be replaced with "£1,700,000"; and
after paragraph (b), there should be inserted a new paragraph (c) as follows –
"(c) that the Carbon Neutral Roadmap should be further amended in such respects as may be
necessary consequent upon the adoption of paragraph (a)."
THE STATES, resuming consideration of the proposition of the Minister for the Environment, as amended, commenced consideration of an amendment of the Environment, Housing and Infrastructure Scrutiny Panel (P.74/2022 Amd.) and, adopting an amendment of the Minister for the Environment (P.74/2022 Amd.Amd.), agreed that –
in section (iii) of the proposed paragraph (c), for the words "an annual report" there should be substituted the words "a report at the end of every four-year delivery phase for the term of the Roadmap"; and
in paragraph 3 of section (v) of the proposed paragraph (c), after the word "policy" there should be inserted the words "where such information cannot be transposed from other peer reviewed scientific research or analysis".
THE STATES, adopting the amendment of the Environment, Housing and Infrastructure Scrutiny Panel, as amended, agreed that –
there should be inserted a new paragraph (c) as follows;
"(c) to request the Minister for the Environment (or if created following the successful adoption of
paragraph (b), the new Minister for Energy and Climate Change) to –
- establish an independent, scientific Climate Council for Jersey with a composition, scope and focus that is proportionate to Jersey's size, the full terms of reference and membership of which should be agreed by the States following a detailed proposal brought forward by the Minister before the end of 2022;
- bring forward a budget proposal for the Climate Council, to be agreed by the States before the end of 2022, and reviewed every 4 years to ensure that the Council is provided with appropriate funding;
- present to the States, on behalf of the Climate Council, a report at the end of every four- year delivery phase for the term of the Roadmap prepared autonomously by the council which reports on and evaluates the Government of Jersey's progress on reducing carbon emissions and the climate change policy initiatives being delivered by the Carbon Neutral Roadmap;
- ensure that the membership of the Climate Council shall not include members of the States and must include:
- an odd number of members.
- a Chair chosen by the membership.
- one member with expertise in the field of Energy.
- one member with expertise in the field of Economics.
- one member with expertise in the field of Climate Technology; and
- ensure that the focus of the Climate Council includes (but is not necessarily limited to):
- providing independent science-based advice on setting and meeting carbon budgets and preparing for climate change.
- monitoring progress in reducing emissions and achieving carbon budgets and targets and recommending actions to keep Jersey on track.
- conducting independent analysis into climate change science, economics and policy where such information cannot be transposed from other peer reviewed scientific research or analysis.
- engaging with a wide range of organisations and individuals to share evidence and analysis." and
there should be inserted a new paragraph (d) as follows –
"(d) the Carbon Neutral Roadmap should be further amended in such respects as may be necessary
consequent upon the adoption of paragraph (c)."
THE STATES, adopting the proposition of the Minister for the Environment, as amended –
- referred to their Act dated 2nd May 2019, in which they agreed that there existed a climate emergency likely to have profound effects in Jersey and, in order to respond to the climate emergency, approved the Carbon Neutral Roadmap for Jersey as set out in the Appendix to the report accompanying the proposition, except that, within the Carbon Neutral Roadmap as set out in the Appendix –
- on page 76, in the row relating to TR1, the figure "£6,255,000" should be replaced with the figure "£4,855,000"; and the words "1,600 electric vehicle incentives" replaced with "1,200 electric vehicle incentives";
- on page 77, in the row relating to TR10, the figure "£300,000" should be replaced with the figure "£1,700,000";
- on page 87, in the row relating to TR1, in the "deliverables" column, the figure "1,600" should be replaced with "1,200", and, in the 4-year budget column, the figure "£5,734,000" should be replaced with "£4,334,000"; and

- recommended that, at the start of the next Assembly, the Chief Minister consider creating a new ministerial portfolio for Energy and Climate Change;
- agreed that the Carbon Neutral Roadmap should be further amended in such respects as might be necessary consequent upon the adoption of paragraph (a);
- requested the Minister for the Environment (or if created following the successful adoption of paragraph (b), the new Minister for Energy and Climate Change) to –

Parishes' Green Waste P.73/2022
THE STATES commenced consideration of a proposition of the Connétable of St. Brelade entitled Parishes' green waste' (P.73/2022) and, adopting an amendment of the Minister for Infrastructure (P.73/2022 Amd.) agreed that, for the words "Parishes and their designated contractors", there should be substituted the words "Parishes' dedicated household kerbside collection scheme".
THE STATES, adopting the proposition of the Connétable of St. Brelade , as amended, requested the Minister for Infrastructure to initiate arrangements in order that green waste from the Parishes' dedicated household kerbside collection scheme might be received free of charge at the green waste facility at La Collette.

THE STATES noted that, in accordance with the provisions of Standing Order 106, the Connétable of Grouville declared an interest in the subject of the proposition of the Connétable of St. Brelade entitled Parishes' green waste' (P.73/2022), in that a family member maintained a business that, from time to time, collected green waste.
Arrangement of public business for the present meeting
THE STATES noted that, in accordance with Standing Order 34(1), Deputy Michael Roderick Higgins of St. Helier had informed the Greffier of the States that his proposition entitled Compromise and Non- Disclosure Agreements' (P.76/2022) had been withdrawn.
Technology Accelerator Fund P.75/2022
THE STATES, adopting a proposition of the Council of Ministers entitled Technology Accelerator Fund' (P.75/2022), and in order to support the Island's future economy, make faster progress on environmental and social goals, and strengthen the technology eco-system in Jersey, agreed to establish a States Fund to be known as the Technology Accelerator Fund ("the Fund"; known in the Government Plan 2022-25 as the Technology Fund) in accordance with Article 6 of the Public Finances (Jersey) Law 2019 and with terms of reference as set out in the Appendix to the Report.

The Presiding Officer referred to the impending elections and the retirement of those members who had decided not to seek re-election and read the following message from the Bailiff –
"This is the last sitting of the Assembly, with the exception of Liberation Day, before the general election. I am sorry that I am not able to be in the Assembly on this occasion to offer my very best wishes to those who are not standing again. It has been a privilege and pleasure to work with you and I wish you all the very best for the future. For those standing again, it may well be that we will see you here again. In any event, I hope that you have an enjoyable campaign at the very least."
