Economic Development (2014 Fees) (Jersey) Order 2013. Minister for Economic Development.

This Order increases fees under 3 regimes administered by the Minister for Economic Development.

Article 1 increases by approximately 2.5% the fee for an application for registration, or the renewal of registration, of premises as a place of refreshment under Article 4(1) of the Places of Refreshment (Jersey) Law 1967. That fee was last increased on 1st January 2013.

Article 2 increases by approximately 2.5%, or less, the fees for registration (or renewal) under Article 9(1) of the Tourism (Jersey) Law 1948. Those fees were last increased in October 2012, for applications in respect of 2013.

Article 3 increases by approximately 2.5%, or less, the fees for testing weighing or measuring equipment under Article 12 of the Weights and Measures (Jersey) Law 1967. There is a reduction, from £49.38 to £30.90, in the fee in respect of instruments for measuring liquid fuel or lubricants of multi-outlet types, for the first of 2 or more meters at a single site submitted on the same occasion. Those fees were last increased on 1st January 2013.

Article 4 gives the title of this Order and states when the provisions come into force. Articles 2 and 4 come into force 7 days after the making of this Order and Articles 1 and 3 come into force on 1st January 2014.

The Order was made on 3rd October 2013. Articles 2 and 4 came into force on 10th October 2013, and the remaining Articles come into force on 1st January 2014.

R&O.134/2013.

This Order amends the Income Support (General Provisions) (Jersey) Order 2008 consequentially upon the enactment of the Income Support (Miscellaneous Provisions) (Jersey) Regulations 2013 (P.101/2013) adopted by the States on 8th October 2013.

The amendments –

  1. provide for a determining officer to make any decision, under the provisions in the Regulations, that a person –
  • has ceased remunerative work without good cause,
  • is not actively seeking work, or
  • is in breach of a warning served on a person who is not actively seeking work;
  1. require the notice of the officer's decision to explain its effect, the duration of any warning or other period which arises from the decision and the consequences of not actively seeking work during the period; and
  2. provide that a person who wishes to exercise his or her right to have such a decision redetermined must do so within 7 days of receiving notice of the decision.

The Order was made on 11th October 2013 and came into force on the same day as the Income Support (Miscellaneous Provisions) (Jersey) Regulations 2013 – 15th October 2013.

R&O.135/2013.

This Order is made under section 32 of the Immigration, Asylum and Nationality Act 2006 (c. 13) (the "2006 Act") of the United Kingdom as extended by Order in Council to Jersey by the Immigration (Jersey) Order 2012.

Section 32 of the 2006 Act provides information acquisition powers for the police in respect of ships and aircraft arriving (or expected to arrive) in or leaving (or expected to leave) Jersey. A police officer of at least the rank of chief inspector may impose a requirement on the owner or agent of a ship or aircraft (the "carrier") to provide passenger or service information. The requirement may only be imposed if it is necessary for the prevention, detection, investigation or prosecution of criminal offences or safeguarding national security.

The effect of this Order is to specify, for the purposes of section 32(5) of the 2006 Act, the type of passenger crew and service information to be provided by the carrier.

Before making this Order, the Minister for Home Affairs must be satisfied that the nature of the information specified in this Order is such that there are likely to be circumstances in which it can be required under section 32 of the 2006 Act without breaching Convention rights (within the meaning of the Human Rights (Jersey) Law 2000).

Article 1 is the interpretation provision.

Article 2 provides that Schedules 1 and 2 set out the specified information in relation to crew, passengers and carriers. The information set out in Schedule 1 is only specified to the extent to which it is known by the carrier in circumstances where the information is to be provided before a point in time at which passengers have boarded the ship or aircraft in preparation for departure and it is no longer possible for further passengers or crew to do so.

The passenger and service information set out in Schedule 2 is specified to the extent to which it is known by the carrier.

Article 3 provides that the specified information is to be transmitted in an electronic form unless an alternative form of transmission is authorized.

Article 4 sets out the title of this Order and for it to come into force 7 days after it is made. The Order was made on 14th October 2013 and came into force on 21st October 2013.
