Sanctions and Asset-Freezing (Implementation of External Sanctions) (Amendment – Corruption) (Jersey) Order 2021.

Minister for External Relations and Financial Services.

This Order amends the Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021 to implement the Global Anti-Corruption Sanctions Regulations 2021 of the United Kingdom. Those Regulations revoke the Misappropriation (Sanctions) (EU Exit) Regulations 2020, and impose asset freezes and immigration sanctions on persons designated by the United Kingdom on the basis of suspected involvement in (or association with persons involved in) serious bribery or serious misappropriation of property.

The Order also ensures that, if provisions of UK sanctions Regulations are repealed and re-enacted by subsequent UK sanctions Regulations, then the references in the Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021 to the repealed UK provisions are treated as references to the re-enacted UK provisions.

The Order was made on 26th April 2021 and came into force on 27th April 2021.

Control of Housing and Work (Exemptions) (Amendment No. 5) (Jersey) Order 2021. Chief Minister.

This Order amends the Control of Housing and Work (Exemptions) (Jersey) Order 2013 ("the principal Order") to implement obligations under the World Trade Organisation General Agreement on Trade in Services (GATS) relating to business visitors in Jersey for establishment purposes.

Article 1 introduces the amendments to the principal Order.

Article 2 amends Article 1 of the principal Order to add a definition of "business visitor for establishment purposes" and related definitions.

Article 3 amends Article 2 of the principal Order so that a person who is a business visitor for establishment purposes and who is in Jersey for an aggregate period of 90 days or less in any 12 month period does not need a registration card for work.

Article 4  amends Article 3 of the principal Order so that an undertaking is not required to have a business licence in respect of a business visitor for establishment purposes who is in Jersey for an aggregate period of 90 days or less in any 12 month period.

Article 5 amends Article 4 of the principal Order to disregard from the maximum numbers condition in a business licence any business visitor for establishment purposes who is in Jersey for an aggregate period of 90 days or less in any 12 month period.

Article 6 sets out the name by which the Order may be known and that it comes into force 7 days after it is made.

The Order was made on 27th April 2021 and came into force on 4th May 2021.

Covid-19 (Gathering Control – Sixth Extension) (Jersey) Order 2021. Minister for Health and Social Services.

This Order amends the Covid-19 (Gathering Control) (Jersey) Order 2020, to extend the gathering control period to end at the end of Monday 31st May 2021.

This Order comes into force on 1st May 2021.

The Order was made on 28th April 2021 and came into force on 1st May 2021.

Covid-19 (Workplace Restrictions) (Amendment No. 11) (Jersey) Order 2021. Minister for Health and Social Services.

This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 to remove the requirement for food and drink premises to close by 11.30 p.m. It does not remove the requirement that the food and drink (other than to take away) are consumed only while seated at a table, or the requirement for customers to wear masks indoors while not seated at a table. It also does not affect any other legal obligation to close at a certain time, such as for premises holding an alcohol licence.

The Order was made on 28th April 2021 and came into force on 30th April 2021.

This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020, to extend the restriction period to end at the end of Monday 31st May 2021.

This Order comes into force on 1st May 2021.

The Order was made on 28th April 2021 and came into force on 1st May 2021.

This Order amends the Pedal Cycles (Jersey) Order 1998 ("1998 Order") by changing the requirements for a bicycle or tricycle to be classed as an "electrically assisted pedal cycle" and not a "motor vehicle" under the Road Traffic (Jersey) Law 1956.

Article 1 is an interpretation provision.

Article 2 amends definitions in the 1998 Order including updating references to technical standards.

Article 3 amends the requirements with which an electrically assisted bicycle or tricycle must comply to enable it to be excluded from the definition of "motor vehicle" in the Road Traffic (Jersey) Law 1956. Article 3 removes the current requirement specifying a maximum weight for the vehicle and increases the maximum speed at which the motor can propel the vehicle from 15 miles per hour to 15.5 miles per hour. The maximum power output of the motor remains unchanged at 250 watts.

Article 4 amends the requirements concerning when an electrically assisted bicycle or tricycle can be ridden on a road or cycle track. Alternative provision is made to the existing requirement for such a cycle to be fitted with a plate showing the battery voltage and continuous motor output as defined in British Standard 1727: 1987. Instead such a pedal cycle may be visibly and durably marked showing the maximum speed at which it can be propelled by a motor and the maximum motor output. Article 4 also updates the requirements for braking systems to refer to the relevant 2014 British Standard in place of the current reference to the relevant 1981 British Standard.

Article 5 sets out the name of this Order and provides for it to come into force 7 days after the day it is made.

Sanctions and Asset-Freezing (Implementation of External Sanctions) (Amendment – Myanmar) (Jersey) Order 2021.

Minister for External Relations and Financial Services.

This Order amends the Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021 to implement the Myanmar (Sanctions) Regulations 2021 of the United Kingdom, which replace the Burma (Sanctions) (EU Exit) Regulations 2019.

The Order was made on 29th April 2021 and came into force on 30th April 2021.

Covid-19 (Screening, Assessment and Isolation – Authorised Officers) (Jersey) Order 2021. Minister for Health and Social Services.

This Order makes provision for a States' employee who is employed as a Covid Safe Officer, a Senior Covid Safe Officer or a Team Manager Covid Safe to be treated as an authorised officer for the purpose of the Covid-19 (Screening, Assessment and Isolation) (Jersey) Regulations 2020, when the States' employee is carrying an appropriate identification card.

The Order was made on 30th April 2021 and came into force on 1st May 2021.

Covid-19 (Workplace Restrictions) (Amendment – Enforcement Officers) (Jersey) Order 2021. Minister for Health and Social Services.

This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 to add provision for a States' employee who is employed as a Covid Safe Officer, a Senior Covid Safe Officer or a Team Manager Covid Safe to be an enforcement officer for the purpose of the Covid-19 (Workplace Restrictions) (Jersey) Regulations 2020, when the States' employee is carrying an appropriate identification card.

Planning and Building (General Development) (Amendment No. 7 – Covid19) (Jersey) Order 2021. Minister for the Environment.

This Order amends Part 9 of Schedule 1 to the Planning and Building (General Development) (Jersey) Order 2011, which gives general permission for temporary development in respect of emergency medical and related facilities for government to deal with the Covid-19 pandemic.

The effect of the amendment is to add a further year to the limitation of time for the developments and changes of use of land, allowing the facilities which have been temporarily created to remain in place until May 2022.

The Order was made on 4th May 2021 and came into force on 5th May 2021.

4. The Chief Minister tabled an answer on 19th April 2021 to the following question asked by Deputy G.P. Southern of St. Helier –

"With reference to the recent analysis from the Resolution Foundation of the impact of Covid-19 on U.K. levels of income inequality and job security, will the Chief Minister state what measures he will be introducing to address similar issues in Jersey; and if he does not intend to introduce any further measures, will he explain why not?"

5. The Minister for Health and Social Services tabled an answer on 19th April 2021 to the following question asked by Senator S.C. Ferguson –

"Will the Minister –

1. update the Assembly on the decant programme for departments and services temporarily moving from Overdale to the old Les Quennevais School site;

2. advise whether the timetable for the decant has slipped to the end of 2022;
3. advise whether any community-facing services will be provided elsewhere and, if so, state to which services this relates and the location from which they will be provided; and

6. The Minister for Infrastructure tabled an answer on 4th May 2021 to the following question asked by Deputy K.F. Morel of St. Lawrence –

"Will the Minister advise how many unused properties the Government owns which could be used for affordable housing, either as empty sites or via property conversion?"

7. The Chair of the Privileges and Procedures Committee tabled an answer on 4th May 2021 to the following question asked by Senator K.L. Moore –

"Will the Chair advise how many complaints or reports of incidents of sexism by States Members and civil servants have been reported to and recorded by the States Greffe over the past ten years, and will she provide this information broken down to reflect separately the number of any such complaints and reports by States Members and civil servants for each year?"

8. The Minister for Health and Social Services tabled an answer on 4th May 2021 to the following question asked by the Connétable of St. John –

"Will the Minister advise –

1. what the delay is in publishing the S.T.A.C. (Scientific and Technical Advisory Cell) minutes;

9. The Chair of the Privileges and Procedures Committee tabled an answer on 4th May 2021 to the following question asked by the Connétable of St. John –

"Given the States Chamber was able to accommodate 17 Members at last week's meeting of the Assembly, and there was a maximum of 12 Members present during the 3 and a half days (with an average of 8 Members and a minimum of 4 Members present in the Assembly), will the Chair advise –

1. what action the Committee is taking to ensure Members who are able to attend in person are actually in the Chamber and not taking part in States meeting in a virtual manner;
2. when the Committee expects the full Assembly to be able to return; and
3. what alternative locations, if any, are being considered for an early return for all Members?"

10. The Minister for Home Affairs tabled an answer on 4th May 2021 to the following question asked by Deputy M.R. Higgins of St. Helier –

"Will the Minister advise members of the number of fraud cases involving financial services companies (banks, trust companies, lawyers, and accountants) and estate agents that have been investigated for each of the last 10 years; how many of them have been referred to the Law Officers' Department for consideration of prosecution; and, if known, how many have been prosecuted and what was the result of the prosecution?"

11. The Minister for Home Affairs tabled an answer on 4th May 2021 to the following question asked by Deputy M.R. Higgins of St. Helier –

"Will the Minister advise members how many suspicious transaction reports have been made to the States of Jersey Police Financial Crimes Unit over each of the last 10 years by category (banks, trust companies, lawyers, accountants, and estate agents); and of those, how many have resulted in a police investigation, and how many of them have been referred to the Law Officers' Department for consideration of prosecution; and if known, how many have resulted in a prosecution and what was the result of that prosecution?"

12. The Minister for Health and Social Services tabled an answer on 4th May 2021 to the following question asked by Deputy M.R. Higgins of St. Helier –

"Will the Minister state the processes involved in hospital patients making a Subject Access Request to view alleged complaints made against them by members of hospital staff, and whether or not it is necessary for a patient to know the surname of the member of staff in order to access these records; if so, how can patients access this information, given that hospital staff name tags only detail forenames and not surnames (other than for doctors)?"

13. The Minister for Infrastructure tabled an answer on 4th May 2021 to the following question asked by Deputy R.J. Ward of St. Helier –

"Will the Minister advise whether any record is maintained by his department of the privately-rented parking spaces that exist in the Island and of the annual income that is generated by such spaces to their providers; and, if so, will he provide this information to members?"
