Court of Appeal (Domestic Abuse Law) Rules 2024. Court of Appeal.
The Court of Appeal (Domestic Abuse Law) Rules 2024 (the "Rules") make provision in respect of appeals to the Court of Appeal (the "Court") under Articles 8 and 13 of the Domestic Abuse (Jersey) Law 2022.
Rule 1 is an interpretive provision which contains definitions. Rule 2 sets out appeals to which the Rules apply.
Rule 3 makes provision as to how appeals shall be commenced, including the form and content of the notice of appeal.
Rule 4 makes provision for the service of a respondent's notice.
Rule 5 allows a notice of appeal or respondent's notice to be amended with the leave of the Court.
Rule 6 makes provision for the setting down of the appeal and the giving of directions by the Judicial Greffier.
Rule 7 makes provision for the fixing of a date for the hearing of the appeal.
Rule 8 makes provision in respect of the participation in the appeal by a person in custody.
Rule 9 allows a judge of the Court to extend or shorten the time appointed by the Rules or by any rule of practice for doing anything in connection with an appeal.
Rule 10 makes provision in respect of allowing an appellant to abandon an appeal.
Rule 11 sets out the name by which the Rules may be cited. It also provides that the Rules come into force 7 days after they are made.
The Schedule sets out a form of notice of appeal in respect of a Domestic Abuse Protection Order and a form of notice of appeal in respect of notification requirements.
These Rules were made by the Court of Appeal on 19th March 2024 and came into force on 26th March 2024.

Road Traffic (Periodic Technical Inspections – General Provisions) (Jersey) Amendment Order 2024. Minister for Infrastructure.
This Order amends the Road Traffic (Periodic Technical Inspections – General Provisions) (Jersey) Order 2018. That Order establishes a scheme for the regular inspection of motor vehicles, which currently applies to minibuses, light motor cycles and mopeds. The inspection scheme was due to start applying to all other vehicles from 31st March 2024. This Order delays that start date to 31st March 2028.
The Order was made on 21st March 2024 and came into force on 28th March 2024. R&O.17/2024.
Planning and Building (General Development – Short-term Holiday Lets) (Jersey) Amendment Order 2024.
Minister for the Environment.
This Order amends the Planning and Building (General Development) (Jersey) Order 2011. Schedule 1 of that Order specifies classes of development for which planning permission is granted. This Order adds a class for development that is a change in use of a building, or part of a building, from use as a dwelling only to use, during a calendar year, either as a dwelling or as accommodation for stays –
• by people mainly for their leisure and not as their main dwelling; and
• whose combined duration (even for different people's stays) is 12 weeks or less in the calendar year.
This Order comes into force 7 days after it is made.
The Order was made on 25th March 2024 and came into force on 1st April 2024.

Planning and Building (Special Development – Haut du Mont) (Jersey) Amendment Order 2024. Minister for the Environment.
This Order amends the Planning and Building (Special Development – Haut du Mont) (Jersey) Order 2023 (the "Haut du Mont Order"). The Haut du Mont Order granted planning permission to Andium Homes Limited (the "developer") to demolish buildings, subject to conditions. Two of those conditions required the developer to submit detailed proposals to the Minister for the Environment no later than 28th March 2024. This Order extends the time by which the developer must submit the proposals to 27th September 2024. This Order comes into force on 28th March 2024.

Criminal Procedure (Jersey) Amendment Rules 2024. Criminal Procedure Rules Committee.
The Criminal Procedure (Jersey) Amendment Rules 2024 (the "Rules") amend the Criminal Procedure (Jersey) Rules 2021 (the "2021 Rules") by inserting new provisions relating to the Domestic Abuse (Jersey) Law 2022 (the "Law").
Rule 1 provides that the Rules amend the 2021 Rules. Rule 2 inserts Part 7A into the 2021 Rules:
• Rule 69 sets out applications and appeals to which Part 7A applies, and contains interpretive provisions, including definitions.
• Rule 70 makes provision as to how applications or appeals shall be commenced, including the form and content of the application or appeal.
• Rule 71 makes provision for the service of a respondent's notice.
• Rule 72 allows a representation, notice of appeal or respondent's notice to be amended with the leave of the relevant court.
• Rule 73 makes provision for the Greffier of the relevant court to make arrangements for the hearing of the application or appeal and to give directions in connection with the hearing.
• Rule 74 provides for the giving of notice of the date of the hearing, and that determinations of applications pursuant to specified Articles of the Law may be made by a judge sitting alone.
• Rule 75 makes provision in respect of the participation in proceedings by a person in custody.
• Rule 76 makes provision in respect of allowing an applicant or appellant to abandon an application or appeal.
• Rule 77 makes provision for a court to sit in private, where it is in the interests of justice to do so.
• Rule 78 makes provision for a court to dispense with any requirement of Part 7A, where it is in the interests of justice to do so.
Rule 3 inserts Schedules 13 to 15 into the 2021 Rules:
• Schedule 13 is a form of notice of appeal against a Domestic Abuse Protection Order.
• Schedule 14 is a form of notice of appeal against an order for notification requirements.
• Schedule 15 is a form of representation for an application to vary or revoke a Domestic Abuse Protection Order or notification requirements.
Rule 4 sets out the name by which the Rules may be cited. It also provides that the Rules come into force 7 days after they are made.
These Rules were made by the Criminal Procedure Rules Committee on 27th March 2024 and came into force on 3rd April 2024.

Education (Grants and Allowances) (Jersey) Amendment Order 2024. Minister for Education and Lifelong Learning.
This Order amends the Education (Grants and Allowances) (Jersey) Order 2018 (the "Grants Order") to increase by 4% the maintenance grant and clinical component grant payable to students for the 2024 academic year. This Order also creates an exemption from Article 20 of the Grants Order for students who began a 4 year full-time course before the 2024 academic year. Article 20 requires that a student undertaking a 4 year full-time course has their tuition fees grant and maintenance grant each reduced by 25% if an equivalent 3 year full-time course could have been undertaken instead. This will no longer apply to students who began their 4 year full-time course before 1st September 2024.
Article 1 states that this Order amends the Grants Order.
Article 2 inserts a definition of "2024 academic year" into Article 1 of the Grants Order.
Article 3 inserts new Article 6B. This new Article clarifies that examples used in the Grants Order are part of the text of the Order but do not limit the provisions to which they relate.
Article 4 substitutes Article 13B of the Grants Order. The replacement Article 13B increases by 4%, for the 2024 academic year, the maximum maintenance grant payable to students whose relevant income is less than £50,000.
Article 5 substitutes Article 13C of the Grants Order. The replacement Article 13C –
• increases by 4%, for the 2024 academic year, the minimum maintenance grant payable to students whose relevant income is less than £90,000;
• simplifies the formula used to calculate the amount of maintenance grant payable to students whose relevant income is between £50,000 and £89,999.99 (but does not change how the amount of maintenance grant is calculated); and
• gives an example of how the formula is used to calculate the amount of maintenance grant payable.
Article 6 amends Article 15 of the Grants Order to increase the clinical component grant by 4% for the 2024 academic year. The clinical component grant is payable to a student undertaking a course in medicine, dentistry, nursing or veterinary science if their relevant income is less than £100,000.
Article 7 amends Article 20 of the Grants Order. This amendment means that a student who began a 4 year full-time course before 1st September 2024, but could have undertaken a 3 year full-time course instead, will no longer have their tuition fees grant and maintenance grant reduced by 25%.
Article 8 gives the title of the Order and states that it comes into force 7 days after it is made. The Order was made on 10th April 2024 and comes into force on 17th April 2024.

Vijay is a Chartered Accountant with a Maths and Physics Degree and years of experience in diverse sectors, ranging from telecoms to the dance floor. Through his consultancy business he provides strategic and financial advice to businesses and has recently worked extensively in Renewable Energy as well as hospitality. He has advised local and national governmental bodies on diverse policy and regulatory issues, including most recently the Mayor of London between 2008 and 2015. He has arranged funding for start- ups, buy outs and development projects since 2001, as well as facilitating restructuring and turnaround processes for struggling companies. As well as consulting, Vijay is an investor and advisor to a set of privately held Renewable Energy Start-ups where he helps them grow and scale their operations, optimize their performance and access new markets and opportunities. Through his involvement with Event Management Operations and the Music Industry he has also developed skills in production and promotion along with their financial optimisation.
