Road Traffic (Speed Limits) (Jersey) Amendment Order 2024.

This Order amends the Road Traffic (Speed Limits) (Jersey) Order 2003 by reducing speed limits on roads, or parts of roads, in St. Brelade , St. John and St. Lawrence .

In St. Brelade , the following are reduced from 40 mph to 30 mph –

La Montée du Sud Access Road (or La Pulente);

La Route de la Pulente (from La Montée du Sud Access Road (or La Pulente) to Le Mont de la Pulente);

Road Traffic (Signs for Speed Limits) (Jersey) Order 2024.

This Order allows traffic signs to be placed on certain roads in St. Brelade , St. John and St. Lawrence to impose speed limits of 30, 20 and 15 miles per hour from the time of placement. On 17th June 2024, the Road Traffic (Speed Limits) (Jersey) Amendment Order 2024 imposes the speed limits regardless of this Order.

The Order was made on 21st May 2024 and came into force on 31st May 2024 and is repealed on 17th June 2024.

Sea Fisheries (Spider Crabs – Restrictions on Fishing) (Jersey) Amendment Order 2024. Minister for the Environment.

This Order amends the Sea Fisheries (Spider Crabs – Restrictions on Fishing) (Jersey) Order 2019 (the “2019 Order”) to provide that the specified period in 2024 runs from the beginning of 1st September to the end of 15th October. During this period fishing for protected spider crabs is prohibited as well as the use of passive gear within the area specified in the 2019 Order. The specified period for 2023 was the same.

The Order comes into force 7 days after it is made.

The Order was made on 30th May 2024 and came into force on 6th June 2024.

International Co-operation (Protection from Liability) (Jersey) Order 2024. Chief Minister.

This Order is made in response to the Court of Appeal’s judgment in the case of Imperium Trustees (Jersey) Limited v Jersey Competent Authority (18th January 2024, [2024] JCA 014). The Court of Appeal declared in this case that Article 2(1)(c) of the International Co-operation (Protection from Liability) (Jersey) Law 2018 (the “Law”) is incompatible with Article 6(1) (right to a fair trial) of the European Convention on Human Rights. Under the Law, a public authority (as defined in the Law) is protected from the liability to pay the costs of legal assistance incurred by another party in legal proceedings concerning acts done by the public authority’s discharge of its functions under the enactments listed in Schedule 1 to the Law (including Regulations or Orders made under those enactments). There is an existing exception from that protection if it is shown that the public authority acted in bad faith. The effect of this Order is to provide a further exception from that protection under the Law by excluding certain other types of costs.

Article 1  defines words  used in the  Order and, in particular, defines “costs” to mean  the  costs  of assistance in legal proceedings that the parties to the proceedings have agreed or, in the absence of agreement, after the Court (as defined in Article 1) has deducted any amounts that are not allowed under the rules of court that provide for the assessment of costs in legal proceedings.

Article 2 sets out the type of costs that are excluded from the Law’s protection, namely –

costs below £75,000;

costs of £75,000 or more, if the Court is satisfied that the person seeking recovery of those costs can demonstrate that the costs are only to the extent that the person will suffer financial hardship if they are not recovered; or

costs of £75,000 or more, if the Court is satisfied that the public authority acted unreasonably in the conduct of the legal proceedings giving rise to the costs.

Article 3 provides for the title by which this Order may be cited and for it to come into force on 4th June 2024.

The Order was made on 3rd June 2024 and came into force on 4th June 2024.

Road Traffic (Public Parking Places) (Jersey) Amendment Order 2024. Minister for Infrastructure.

This Order amends the Road Traffic (Public Parking Places) (Jersey) Order 2006. The amendments reduce the maximum parking periods for the following parking places –

La Ruette du Sacrement Car Park (STS8A);

St. Saviour ’s Parish Hall Car Park (STS11).

The maximum is reduced from a total period of 12 hours to a total period of 3 hours, in any continuous period of 24 hours. And a valid parking disc must now be displayed on the vehicle while it is parked there.

The amendments also correct 3 minor errors.

This Order comes into force 7 days after it is made.

The Order was made on 3rd June 2024 and came into force on 10th June 2024.

Road Traffic ( St. Martin ) (Jersey) Amendment Order 2024. Minister for Infrastructure.

This Order amends the Road Traffic (St. Martin) (Jersey) Order 1989 to impose prohibitions and restrictions on the waiting of vehicles on Rue de la Solitude, and to make miscellaneous minor amendments.

Article 2 makes a correction in Schedule 1.

Article 3 amends Schedule 2 to insert an entry prohibiting waiting along 3 sections of Rue de la Solitude.

Article 4 inserts an entry into Schedule 5 so that on one section of Rue de la Solitude vehicles are permitted a maximum waiting period consisting of a total of 12 hours within a 24-hour period. A minor amendment is made to remove superfluous phrasing in 2 existing entries.

Article 5 gives the title of this Order and provides for it to come into force 7 days after it is made. The Order was made on 3rd June 2024 and came into force on 10th June 2024.
