Social Security (Contributions) (Jersey) Amendment Order 2024. Minister for Social Security.
This Order amends the Social Security (Contributions) (Jersey) Order 1975 (the “1975 Order”). Part 1 makes a series of alterations to the conditions that must be met before exceptions and concessions are applied to the payment of social security contributions. It makes amendments that are consequential to those alterations and some minor amendments to update the 1975 Order to modern drafting standards. Part 2 makes amendments related to the meanings of “income for self-employment” and “total income” in Schedule 2 to the 1975 Order.
Part 1 – General amendments to 1975 Order
Article 1 introduces the amendments to the 1975 Order.
Article 2 amends Article A1 by introducing a new definition of the “Comptroller”.
Article 3 amends Article 2. Assessment of the reasonableness of a person’s self-imposed restriction on working will take into account any agreed training they are undertaking to improve their employment prospects.
Articles 4 to 12 make amendments to reflect changes in the processes used to deal with the following exceptions and concessions under the 2003 Order:
• Article 9A (persons in receipt of home carer’s allowance)
• Article 12 (small income exception)
• Article 13 (special exemption from liability to pay Class 2 contributions)
• Article 13A (reduced rate Class 2 contributions)
• Article 13D (Class 2 – deferred contributions for business commencement)
• Article 13E (recalculation of contributions deferred under Article 13D)
• Article 14 (home responsibilities credits)
Articles 4 to 12 –
• remove the requirement for an application to be made by an insured person for the exception;
• change references to Minister to the Comptroller ,
• remove the requirement to produce tax assessments where it appears;
• remove existing restrictions on the quarters of the year for which the exception could be applied;
• add a requirement that any evidence should be produced in the manner and timeframe required;
• update drafting to modern standards.
In addition –
• Article 6 amends the heading of Article 10 (small income exception) to “low income contribution relief”.
• Article 12 increases, from 15 to 20, the weekly hours of employment that can be disregarded for the purposes of home responsibilities credit.
Article 13 deletes Article 14A. This Article contains the time periods within which evidence must be provided for credits made under Article 10 (small income exception) and Article 14 (home responsibilities credits). The contents of this deleted Article are now incorporated into Articles 10 and 14.
Article 14 introduces new Articles 16A and 16B. Article 16A applies to all exceptions and concessions under Part 1. It provides for applications to be made by insured persons for any of those exceptions or concessions and the form, manner, evidence required and timing of those applications. It also provides for the extension of the timeframe if circumstances justify it. Article 16B provides the Minister or Comptroller with powers to extend the period for which an exception, concession or contribution can be made, applied or credited to an insured person. It also enables the Minister or Comptroller to insist on conditions to be satisfied by the insured person before it will exercise those powers.
Article 15 corrects an erroneous cross-reference. Article 16 removes the criminal offences in this Order.
Article 17 introduces the Schedule which contains amendments consequential on the amendments contained in Part 1 and minor amendments to update drafting to modern standards.
Part 2 – Amendments to definitions “income from self-employment” and “total income”
Article 18 introduces the amendments to the definitions “income from self-employment” and “total income” in Schedule 2 to the 1975 Order.
Article 19 expands the definition of “income from self-employment” to include income charged with income tax under Schedule D Case IIA, as described in Article 62 of the Income Tax (Jersey) Law 1961. It also substitutes the definition of “total income”.
Part 3 – Final provisions
Article 20 gives the title by which this Order may be cited.
Article 21 provides that Parts 1 and 3 and the Schedule come into force 7 days after the Order is made and Part 2 comes into force on 1st January 2025.
The Order was made on 2nd July 2024, Parts 1 and 3 came into force on 9th July 2024 and Part 2 comes into force on 1st January 2025.

In accordance with Standing Order 104A, a time limit of 15 minutes applies to speeches made during debate, unless discretion has been exercised to allow for a longer, or shorter, time limit. No time limit applies to either speech made by the proposer.
Discretion is exercised by the Presiding Officer in accordance with guidance issued by the Bailiff , following consultation with the Privileges and Procedures Committee. The current guidance was presented to the States in the report ‘Time Limits on Speeches in Debates: Guidance on the Exercise of Discretion’ (R.3/2021). The report states that discretion may be exercised to allow for a longer speech than 15 minutes where the member speaking is designated as the ‘main respondent’ to the debate.
