PROPOSITION

THE STATES are asked to decide whether they are of opinion -

to request the Planning and Environment Committee to remove from the Committee's informal Register of Buildings and Sites of Architectural, Archaeological and Historical Importance of Jersey all buildings of local interest until -

  (a )      f  u ll consultation has taken place with the owners and occupiers of those buildings and their agreement to the

inclusion of such buildings on the list obtained; or

  (b )       th  ere has been established, by law, an independent system of appeals against Committee decisions to include

buildings of local interest on the Register.

Report

On 2nd September 1999, the Planning and Environment Committee circulated a combined listing of Sites of Special Interest ("S.S.Is.") proposed S.S.Is. and Buildings of Local Interest ("B.L.Is.").

Having received complaints from St. John parishioners that their properties had been included in the listing of buildings of local interest but they, the owners, had never been consulted by the Planning and Environment Committee, I contacted the President of Planning and Environment. His reply is as follows -

" I re f e r to your faxed message to Senator Quérée dated 14th September on the question of Sites of Special Interest

and Buildings of Local Interest. Senator Quérée has asked me to reply to you on this matter direct.

  In r e la t ion to designated Sites of Special Interest, I can confirm that all owners and interested persons (as advised

by the Law Officers' Department) have been consulted during the designated process. Some have made no comment whatever; some have raised questions, which have been resolved by discussion, some have welcomed the designation. In cases where there has been fundamental objection in principle; designation has been held in abeyance and negotiations are continuing. Properties of this sort are shown in the Register as P.S.S.I., in other words proposed S.S.Is. In these cases the Committee has clearly made no final decision on designation.

In re la tio n to Buildings of Local Interest, or B.L.Is., it had not been the practice of the former IDC to notify owners

and occupiers of the inclusion of these properties in the Committee's Register. The resource implications of this are very considerable. However, the Committee has decided that as each parish is reviewed, Notices should in future be placed in the Gazette and in the appropriate Parish Hall , scheduling those buildings which are included as Buildings of Local Interest. Any owners who feel aggrieved by the inclusion of the property in the Register as a B.L.I. can appeal to the Committee and have the matter reviewed."

Given that for St. John some 171 properties appear in the listing, of which 108 are B.L.Is., these owners should have the right to be consulted before this information was made public.

It is not good enough that officers have visited these properties, and in some cases taken photos or trespassed on the land to get details that could not have been obtained without entry to these sites.

I believe the right of privacy is important and should be cherished. I ask States members to request Planning and Environment to remove all B.L.Is. from the listing and go and consult with all property owners on the list of 2nd September 1999 as it stands, and return to the States with a new B.L.I. list after consultation with owners showing St. John (Appendix A), St. Clement (Appendix B), Gorey Village (Appendix C) and changes in other parishes (Appendix D).
