ADDENDUM TO REPORT

The Committee has identified that paragraph  3 of the report accompanying its proposition P.117/2003 contains wording which is ambiguous and that as a result could be misconstrued. Although not material to the main issues arising from the proposition, the Committee has therefore issued this addendum to its report.

Paragraphs 2 and 3 to be deleted and replaced with 2 new paragraphs as follows

  1. P r io r to the reclamation to the West of the AlbertPier, the States had leased the entire foreshore from the Crown in 1950 and, in the 1960s,had reclaimed part ofthe foreshore in the area of La Collette (J.E.C. Power Station). Initially they relied for their right todosoon a lease by the Crown to the Publicof all the foreshore ofthe Island with some irrelevant exceptions.When the La Collette Land Reclamation Scheme was embarkedupon in the early 1970s, it was recognised that the States would need topurchase from the Crown,thefreeholdof the Foreshoreinvolved.In1974,H.M. Receiver General agreed a valuation of £130,000 and that in principle settlement couldbe effected by the States issuing a long-term Bond. In 1975, the Finance and Economics Committee advised H.M. Receiver General that itwas agreeable, in principle, to the proposalsandthe matter was referred toH.M.Treasury.However, in 1982 the Harbours and Airport Committee and the Finance and Economics Committee reached the conclusion that it would be more preferable for H.M. Treasurytobe offered a cashsumof£130,000,and in Marchof that year the formal agreementoftheUnitedKingdomTreasurywasreceived,tothe effect that the considerationof £130,000could be paid in one lump sum and in the circumstances, the States approved a request on the AprilSupplyDayfor a supplementary Vote of credit to the La Collette Land Reclamation Votein the sum of£130,000.
  2. T h e States begantoreclaim foreshore immediatelyto the West oftheAlbertPier in 1981. Initially they relied for their right to do so on the lease of the entire foreshore referred to in paragraph 2 above. Subsequently, the Crown sold the relevant areas of foreshore to the Public by contracts passed respectively in 1983, 1989 and1995.

Paragraph 4 onwards remains as existing.
