PROPOSITION

THE STATES are asked to decide whether they are of opinion

(a ) to refer to their Act dated 29th July 1980 in which they approved the transfer of ownership of

certain estate roads and footpaths in the development at Maufant Village, Maufant, St.  Martin, from the public of the Island to the Parish of St.  Martin, and authorised the Attorney General and the Greffier of the States to pass the necessary contract in the matter; and

(b ) to agree to rescind the said Act.

Note:  In accordance with Standing Order No.  18C relating to rescission of Acts of the States, this proposition is

supported by the President and all other members of the Housing Committee.

REPORT

Following construction of Maufant Village Phase  1 in 1978, the Housing Committee on behalf of the Public retained ownership of roads, footpaths (including in-situ sewers) common landscaped areas and street-lighting.

Projet P.97/1980 related to the proposed transfer of roads and footpaths within Maufant Village from the Housing Committee to the Parish of St.  Martin.

The intended transfer of these common areas and shared facilities has not been effected and the Housing Committee is now coming forward with proposals for the transfer of all such areas under P.20/2005, as previously lodged by the Housing Committee.

There are no financial or manpower implications arising from this proposition.
