PROPOSITION

THE STATES are asked to decide whether they are of opinion

(a ) to agree that a Deed of Arrangement should be passed between the Public as the owner of the site

of the Jersey Air Cadets' HQ, La Rue Carrée, St. Brelade, and Mr. Paul Christopher Little and Mrs. Samantha Little, née Hibbard, as the owners of Le Petit Reve, La Rue Carré, St. Brelade (a shown on Drawing No. 1412 D1), to agree the boundary between the two subject properties, with Mr. and Mrs. Little to bear the Public's costs in connection with passing the contract before the Royal Court; and

(b ) to authorise the Attorney General and the Greffier of the States to pass the necessary contracts on

behalf of the Public.

REPORT

Following a recent need to identify the boundary between the Jersey Air Cadets' HQ and Le Petit Reve, it became apparent to Property Holdings and the Law Officers' Department that the original boundary line had been lost and could not be set out from the original measurements.

There exists a masonry blockwork wall between the two properties, which the two parties have agreed in principle should constitute the boundary. It is proposed that the wall will be in the ownership of Mr. and Mrs. Little, who will be fully responsible for its maintenance, and will have access rights onto the Public land for the purpose of maintaining the east side of the wall, subject always to giving reasonable notice, except in cases of emergency. It is also proposed that the Public will have the right to join against the east face of the wall, provided that any adjoining structure does not exceed the existing height of the wall and subject always to the consent of Mr. and Mrs.  Little being given, which consent shall not be unreasonably withheld.

Property Holdings and the Law Officers' Department recommend that a Deed of Arrangement is passed before the Royal Court to record this boundary arrangement.

Mr. and Mrs.  Little will meet the Public's costs in connection with drafting, agreeing and passing a Deed of Arrangement before the Royal Court to ratify the abovementioned terms.

There are no financial or manpower implications arising from this proposition.

Under Standing Order 168, there is no provision for deeds of arrangement, and it is therefore necessary for the Minister to seek States' approval for this minor land transaction.
