PROPOSITION

THE STATES are asked to decide whether they are of opinion

in  accordance  with  Article 18(1)  of  the  Employment  of  States  of  Jersey Employees (Jersey) Law 2005, which is concerned with the appointment of Commissioners to the Jersey Appointments Commission, to appoint Mr. Brian Curtis , M.B.E. as Chairman for an initial period terminating on 23rd February 2014.

REPORT

Under the Employment of States of Jersey Employees (Jersey) Law 2005, Part 4, the Jersey  Appointments  Commission  is  established.  The  Commission  consists  of  a Chairman and not more than 4 other Commissioners. The purpose of this report is in reference to Article 18(2) of this Law and the Chief Minister's recommendation to the States of Jersey to appoint Mr. Brian Curtis , M.B.E., a current member of the Jersey Appointments Commission, as replacement Chairman initially until February 2014, following the resignation of the former Chairman, Mr. Alan Merry, on 18th June 2012.

  1. The position  of  Chairman  became  vacant  following  the  Chief  Minister's acceptance of the former Chairman's resignation on 18th June 2012.

  1. The Chief  Minister  required  a  replacement  Chairman.  Mr. Curtis  is  the longest-serving member of the Jersey Appointments Commission and through his experience has demonstrated his suitability to become Chairman. Having sought Mr. Curtis ' confirmation that he would wish to perform the role and established that other members of the Commission supported this decision, the Chief Minister requested Mr. Curtis to perform the role of Chairman until the date when the former Chairman would have served his term of office, that is, 23rd February 2014.
  2. Mr. Curtis , M.B.E. was selected for the role of Commissioner of the Jersey Appointments  Commission  following  a  competitive  process  in 2005, Mr. Curtis ' first term of office commenced in 2006. This appointment and his subsequent  second  and  current  term,  commencing  from  2009,  were recommended  by  former  Chief  Ministers  and  approved  by  the  States Assembly.
  3. The Chief Minister will select a new Commissioner later in the summer, following advertisement in Jersey and an appropriate interview and selection procedure.
  4. In  June,  the  States  Employment  Board  approved  the  appointment  of Mr. Curtis as Chairman.

  1. The Chief Minister recommends to the States of Jersey the appointment of Mr. Curtis as Chairman of the Jersey Appointments Commission for an initial period to coincide with the date when the former Chairman would have served his term of office, that is, 23rd February 2014.

Financial and manpower implications

There are no additional resource implications arising from this proposal, as there is already  a  budget  in  place  for  the  costs  associated  with  the  running  of  the Appointments Commission.
